I went on a £50 trip and no pressure I had been looking for 3years or more and had seen just about everything on offer

I went to a "Spanish Property Exhibition" and almost left as soon as I had gone through the door but decided as I had gone 30 miles I may as well walk round I sat down to watch a film about a new golf developement in Murcia called Santa Ana Del Monte and was asked if I would like to go to Spain to look round. It cost £98 for the 2 of us and the girl who was our guide took us to Jumilla we loved it immediately 

That's the tale of our buy thought we had seen it,done it been there till we hit JUMILLA

Hi Darren,

Thanks for your comments. I know you have said this before on an earlier post when I was asking for information. I feel others will benifit from the input.

You are right in what you say, and as the malva is marketed as an invesment, it is not sold in the normal way as a holiday home.

I do think the Jumilla golf is sited in a great location, and the new airport will only push up prices in the future.  The fact that the PJA tourniments will also be played on the golf courses should also make the location highly desireable.

I was also told that as the water supply would be comming from Jumilla which has a limited amount, and the land is mostly agricultural no other developements will be built in that vicinity.

I suppose it depends on what would be classed as the Vicinity.  Between 2005 and 2006, 30 companies had the intention of building urbanisations around Jumilla.  In total this would be 45,420.782 square metres, 77,449 properties and 13 golf courses.  Doesnt bear thinking about.  To the best of my knowledge most do not have any approvals or for the present have been refused.  Listed below are those that have  achieved some level of approvals but that does not mean they will go ahead or that this info is not out of date.  It could also be years before any of them get up and running.  SADM is the only one with all approvals in place.

Montenatura Golf resort - Inicial approval - Valle del Hornillo - 2 golf courses approx. 10,000 properties.

El Valle de Jumilla - Inicial approval was in public  exhibition 14.3.07. - El Ardal - 1 GC - 7,500 Props.

The following 3 have presented plans or in Spanish Cedula Urbanisation.
Torre del Rico, Jumilla Golf Resort, Golf Resort El Castilla.

You need to ionsist and keep insisting bombard them with emails everytime you log on you are entitiled to a bank gaurantee and San Jose are breaking the law by not providing one read the article down the side of this forum to find out more details

One point that hasn't been raised (or if so, I haven't seen it).  Are SJ entitled to charge for a bank guarantee and, if so, how much? Presumably it costs them something to provide one.

It is a requirement by Spanish law that the developer has bank guarantees in place before work starts otherwise they are liable to pay 25% of the guaranteed amounts in a fine. 

Also they should be FREE, no one should be charged for one.  The agent may say that they have paid for it but you shouldn't be charged for one.

Many developers drag their heels about giving them out, but you need to keep chasing them and your lawer.

Hi folks. Just to remind everyone that myself along with two friends will be at the offices of San Jose on Friday 11th May 2007 and will not be leaving without some sensible answers from them. If there is anything at all that you wish me to speak to them about on your behalf then please send me a private message. Outline what you want me to raise with them on your behalf and I shall let you have their response by private message as well. I cannot promise that anything will be forthcoming from them or that it will be to our liking but we shall do our best to extract some information from them without the use of base ball bats!!!. Whatever the outcome I think that this will be my last posting on this or any other forum but I will get back to any of you who choose to respond. Keep cool!!!

I spoke to my solicitor this afternoon, they still haven’t received the bank guarantee that San Jose promised last week. As the developer is legally obliged under Spanish law, to provide the guarantee, the next step is to issue a burofax which is a legal notice demanding the document. This can be followed by a complaint to the authorities. The downside is that it will cost me €150, I am therefore going to wait until Friday before I instruct my solicitor to act. I have also sent an email to Eva at entregas@sanjosegrupo.com informing her that I intend to instruct my solicitor to issue the burofax. Hope this is the right person/department.

Hi everyone,


With regard to bank guarantee from San Jose, i received the following information from our agent.

Due to a new european union law issued earlier this year, bank guarantee or the renewal of one can only take place under certain circumstances and the fact that San Jose do not have the correct building licences in place (referring to albatera, not sure about SA)
 prevents theirs from being renewed. This is what our agent has been told, he and his accountant have a meeting with person in charge (Almudena is on maternity leave) at San Jose this friday on our behalf.

CAN THE EYE ON SPAIN TEAM EXPLAIN THIS NEW EUROPEAN LAW,ISSUED EARLIER THIS YEAR,WHEREBY THE BANK GUARANTEE OR THE RENEWAL OF ONE, CAN ONLY BE ISSUED UNDER CERTAIN CIRCUMSTANCES?

Can't understand this, my solicitor says that the licences are in place and my agent has received copies of the licences from San Jose.

Licences are in place and have been since last December. Sj are just waiting for the paper work to proceed to the next level of building on what they've started.

I have in my contract stating that a bankers guarantee has been granted. Not knowing what a banker guarantee looks like i assumed this was the guarantee. After further investigation this is only a document to approve the guarantee. So does anyone have a bankers guarantee? or do we all have to wait for the elcections to be completed in Jumilla in May?

Received an email from Tomas this morning saying that they are in negotiations with banks about guarantees which could take 1,2,3, weeks. I replied that I will instruct my solicitor to issue a borofax (legal document) they will then be liable to a fine.

PLEASE NOTE IN VIEW OF NEGATIVITY ON MESSAGE BOARD I ASKED QUESTIONS OF SANJOSEGRUPO - HAVE RECEIVED THE FOLLOWING ANSWER -

With regards to the work on the site of Jumilla, I inform you that these have stopped only because we had received licenses to build the base of the property. The licenses are given by stages and we have to receive next week the following stage licenses, in order to actually lift the structure and proceed with the foundation of the other plots, where this had not been done yet.

We understand the impact of not having workers on site, from one day to the next, but we do not want to cause any problems that may influence in a negative way, the issuing of the following building licenses.

Therefore, there is nothing for anyone to worry about and let you know that the whole site is on its way to became one of the regions most important resorts.

That is very reassuring and thank you for taking the initiative in asking San Jose what was happening (or not!).  We are going to be in Jumilla next week, so let's hope that they get the next stage licences on Monday so that we can see some action when we go to the site!

I am now going to make myself a cup of coffee (and shut some windows!) as it is cold in our house.  Hopefully next week I will be lovely and warm.

Re:  Bank Guarantees

Regarding the comments and questions about bank guarantees.  We put down our deposit on our Azucena in October 2005 and were told we would receive a bank guarantee.  Initially this was not forthcoming and it took several months of emails to our Spanish Lawyers to get the guarantee.  When it arrived we were asked to pay for it.  As we understood it should be free, we refused to pay and there followed several more months of emails before finally we were given this for free.  Apparently it is up to the agent to sort this out with San Jose (if you have used an agent).  In all it took about five months to get the guarantee.  We now have on our files a certificate from San Jose saying that the company Herrada del Tollo will guarantee the payback of the amounts paid by us until such time as the property is handed over.  We also have a document from the bank BBVA, dated 27th February 2006, setting out the relevant details.  It says "the maximum period of time of this bank guarantee is until the 1st April 2008".  I assume therefore that we are OK until that date.  I am hopeful that our property will be built, or almost built, by that time as our contract date is December 2007.  I hope this information is of help to anyone who is not sure whether they actually have a guarantee or not.  My advice is to bombard your agent or Lawyer with emails until you get one.

Thanks janelouisestockdale ,I am bombarding my solicitor and San Jose for the guarantee, SJ seem to think that we are doing them a favour buying one of their properties, they are very arrogant.
