We took posession of our new apartment in Block 1 on 8th June and for those interested and I have downloaded 9 of the photographs I took the day before we left.  It's a bit different in that we had the wall between the kitchen and the 2nd  bedroom left out creating a nice size kitchen diner, leaving the lounge for lounging.  We only have one bedroom, but that's Ok by us.

Hi

I was hoping somebody might be able to help me clarify something regarding completing on our new apartment. I was hoping not to take possession of our apartment until the habitation cert had been granted.

I have not gone to get my NIE number, visit notary etc. as I was waiting on the cert to be granted and then go out and do all that together, However, I got a call from my solicitor today saying that in the contract it states that I need to purchase the apartment once the architect issues his/her certificate - this was issued a number of months ago. Could somebody please clarify this? I was planning on waiting for the hab cert but my solicitor said that the builder could cancel my contract if i don't complete on the apartment in the next couple of weeks

Thanks

Joe

Hi Joe l do not think they can force you to sign with out the habitation cert (F,L,O,)even some banks will not grant a mortgage with out it, send a pm o mariadecastro the resident lawyer on eyeonspain she will explain it all and tell you how you can inform your solicitor and builder of your rights.Regards Pat.
