Please see a mail below which was received this morning from our solicitor. I hope this gives everyone the latest information re all phases. Hopefully this will hearten those in Phase 4, even though it is some way off, as it does acknowledge a commitment, albeit in principal, to complete this phase too.
We are in Phase 1 block 3 & hope that this isnt dependant upon Phase 2 being granted a licence at the same time....but we're not holding our breath!

With reference to your property purchase at Arenal Duquesa, the Developer has provided us with the following update:
Phase 1
Blocks 4, 6, 7, 11 & 12
The Licence of First Occupation has been granted. However, water and electricity cannot yet be contracted and builders supply of water and electricity will be made available until such time that this is possible.
Blocks 8, 13 & 14
They are awaiting the Licence of First Occupation which they expect to be granted in January 2008.
Blocks 1, 2, 3, 9, 10, 15 & 16
They are awaiting the Licence of First Occupation which they expect to be granted in May 2008.
Phase 2
Construction work is 90% complete. They expect for work to be finished in March 2008 and the application for the Licence of First Occupation will then be submitted. They would expect for this to be approved some time in May 2008.
Phase 4
Construction work is 54% complete. Work is expected to be finalised in January 2009.

Good luck to you all in Arenal, we are just up the road in Coto Real, we have to pass Arenal all the time and it has been such a shame you couldn't all be in by now, it looks lovely and was there two weeks ago and they seemed to be doing a lot of work on all the gates, we thought it must be moving fast and at last you will get your keys.
We often have get togethers when we are out there with other members of EOS, watch out on the general forum for the dates.

Here we go again! I am in block 16. I was told the license would be granted in December and we would complete sometime in January, February at the latest now it is May! It just goes on and on. I strongly hear the cry of cancellation calling me again. It really is beyond belief. Many thanks Sean & Leema for the update.

Thanks for the update - at least there is hopefully a commitment to complete Phase 4 by Jan09 (?!?!).

Thank you to Sean for the latest.
I am in block 6 so I am assuming that my block has been granted the licence this has been confirmed by my solicitor in Sept. However, I am concerned about the lack of service supply mentioned in Sean posting. A "Builders Supply" is a temporary supply, it is not guaranteed and can give low voltage, assuming that the "Certificate of Habitation " has been issued for the blocks mentioned I cannot see why the main electrical and water supply cannot be connected? I would be inclined to refuse to complete until the mains have been connected, surely an essential part of the internal snagging procedure is testing water and electricity? Admitted whilst using the "Builders Supply" we will not be paying for services or local taxes to the Town Hall and this may seem attractive until the service fails. How long will this supply continue for? Needless to say not happy I feel the connection of Electric/water to the main supplier should be a priority.
I know we need to watch our Carbon footprints and it may be quaint to use the candles and portable bar-b on the patio but if the electric fails whilst using my hair straighteners all hell will brake loose!

Laurdan, has your licence really been confirmed. I have yet to find anyone who has seen documentary evidence. I think you may have been misled by your solicitor.
However, I agree that a builders supply is really not good enough. The water supply will not be drinkable and you will have to use bottled water. Also, do you really believe you won't have to pay local taxes?

WE are not happy with going on builders supply,its either completed or not! But I may worry that Priensur can make us complete once contracts are issued.But if we stick together then there is no need to worry over the bully boy tactics that they may impose..This company are obviously not bothered about us as individuals and would not i fear have any qualms on cancelling our contracts at a stroke.Our solicitors dont seem to have much "clout" about them and would probably go along with Priensur.Whats other peoples thoughts please

Pdrich I have not personally seen the licence and I assume neither has my solicitor, it’s elusive as the goals last night at Wembley were! I would imagine the developer holds the licence if it has been issued?
I think it is safe to say that if the licence has not been granted then it is not advisable to complete. We cannot be bullied into completion without the licence; I would need to check it out legally to make sure. Maybe someone out there has already enquired? But I am sure that we cannot be forced to complete without the licence of first habitation.

Nothing in this little drama has been straightforward and how can a LFO be granted if the water isn't drinkable? Once again there appears to be more to this than meets the eye.

I'm sure I recall a message on this site previously which mentions another development by Arenal....was it Arenal Golf?? had completed some phases, although they were still on builders supply, so it is not unheard of that people may have to complete with a builders supply, although please treat my comment here as hearsay, not fact.
I had actually thought it might be a bonus to have a builders supply, as I would wonder how they could reasonably charge you...so you might get lucky. Once again my thoughts....I would suspect that any water supplied by the builder would be supplied by a water bowser & that it would be suitable for human consumption.
Finally, I understand the scepticism over the FLO being granted, however I do believe that too many people have been told it has been granted by different solicitors, for it not to be true.
I guess its the old weatherforecaster syndrome....I never doubt them when they tell me it will rain, I never believe them when they say its gonna be sunny...maybe this is setting into our psyche and we dare not believe good news until we see it with our own eyes, as there have been too many disappointments.
Hang on in their you lucky "early release people" im sure you'll love it when you're in your apartment whilst us second release people will miss out on Easter & early spring, whilst you enjoy your havens....smiling sweetly & piyfully on us yet to complete.

Hi everyone,
We are on Arenal Golf in Benalmadena and living in a rental on Phase 3 which was completed and handed over to the owners from Autumn last year. We were on builders electricity until the end of August this year. All it meant for us was that the supply was connected but not to individual meters. Once we were connected to our meter we started paying for it! We guess the same is probably true for 'builders water supply' although we couldn't swear to that.
We are still waiting to get into our own apartment on Phase 4 which has been finished since last December but has not yet been released due in part to the situation of which we are all aware. The local council have only granted a provisional occupation licence to Phase 4 until all apartments are connected to their own meters and satisfactory reports have been provided by the electricity and water companies. They are also insisting that all external telephone cabling is in place for the Phase, so our wait and those of other purchasers continues!

The web master of the Arenal Golf site invited Querens, who are the company dealing with Sales for Prienesur ,to make use of the web site to provide info and answer questions. If you look on www.arenalgolf.com you will see what happened! It was a pointless exercise. Most of us have given up visiting the sales office as either they tell people what they think they want to hear or they say that they have no information.
One of the contributors to our site has managed to make a contact within Gerens who occasionally emails him with what seems to be fairly solid info. People were getting so down that we started putting weekday daily posts on the web site reporting only on what we had seen with our own eyes or what we had experienced. We back this up with photos as appropriate. It seems to have been appreciated.
On the positive side we are quite impressed by what we have seen of the Gerens project team as things seem to be moving forward now on a considered and organised basis. Quite some time had to be spent in clearing what was a very cluttered and disorganised site. Work is now going ahead quite quickly.
We are also happy with the quality of finish in the apartments as having lived in one on an earlier phase than ours for quite some time now we would have spotted any major problems!
A lot of the current delays seem to be coming from the local council who are quite rightly playing everything by the book. Some of the Spanish residents on the earlier phases have been lobbying a local councillor with regard to the problems they had encountered re electricity, phone lines and the lifts which were erratic due to poor phone connections.
The Malaya scandal to which the original developer was linked has made the authorities understandably jumpy . Unfortunately the impact on us as buyers has been an extremely negative one!

I just find all these people quite hopeless, and their communicative approach to us customers a disgrace.
My headache is coming on again..............
We have forward booked to come over Jan 08, May 08 and Sept 08.
We discounted the Jan trip as regards moving in, but surely we thought May was a definite runner, but now it looks even Sept could be touch and go.
When we were over three times during 07 we were specifically looking for a retirement apartment for 2014 (which we think we have identified in a good development), with the Duquesa apartment as a holiday base until then.
If Duquesa isn't finished until 2009/10 (or further) it now poses a timing problem for us because we need to sell the Duquesa apartment and our own house here in Norn Iron to move to our retirement apartment.
I don't know if that is now worth the hassle strategically - maybe just wait until 2014 and do it in one clean sweep.
We remain very positive about the development itself but it means we would be buying and selling again within a four year period.

I can understand where you are coming from Will, it will be sad to see you go if you decide on that path your enthusiasm and pace for the project is great. I have woken this morning to a very frosty St Albans...Just checked flights going out of Luton to Malaga early December and I can return for £40.00. I really thought that I would be in my apartment by now and this time last year dreamed that I may be celebrating my birthday in Duquesa, but another year has gone by and still we wait. Obviously having a bad day today...eventhought of cancelling briefly. It is all so annoying! .
