Hi is there anyone who is still waiting for their money back through Andersons as we are, only it seems to have gone quiet I was told 9 people received their cheques after the 1st  meeting about a month ago,  we were told we would have our money in a few days ,no cheque, then it was 10-15 days ,and we are still waiting what a surprise !!! Huma have asked for a few more days ,here we go again!!! I am seriously thinking about getting watchdog involved who do they think they are treating us this way and keep getting away with it. any one feel the same?

How long have all the Anderson clients been waiting and have they received interest/compensation.

 

I am with Aldea lawyers and signed power of attorney for litigation in Spain on 16 Nov.  I am not sure what happens next .  I am just hoping this will get me my mioney back.

Hi Marilyn we changed to Andersons from the solicitor Focas recommended  mid Aug ,and are still wating for our money  they wouldn't give interest or compensation we would have to take them to court to get this but we decided just to get our money back and get out of this mess, but this is becoming a mess as well ,i'll let you no what happens.hope you get a result.

Hi,

Have just received an email from our solicitor who we appointed last May, after we lost patiance with Aldea. that they have received a full refund for us plus funds to cover the legal cost from Huma.

Since September more and more people who have been waiting some time seem to have been getting their money back

I wonder if this means that Huma are confident of re selling when they re start and are now more than ever certain it will!!!

Most buyers are staying in and some are now getting their bank guarantees renewed without asking!!!

The reason for all this 'may perhaps' be influenced by the 'credit crunch' as there are rumours of a Spanish Northern Rock......OK but short of cash only because banks stopped lending to each other.....Bank of Spain says everyone OK but I would be surprised if any bank wants any bad press about renewing their guarantees!!!

Developers will not want to look suspect at this time also!! 

Steve, are you still interested in buying in Spain ?....good time to buy and I do not mean picking up the cheap properties in poor locations but good ones at realistic prices

In fact if you are looking and making an offer in Dec/Jan you will not only be buying at the quietest time but also be able to use it in the Spring

Hi Brian, I am just interested in what you are basing your assertion that most people are staying in, on?   I would say that the evidence shows that more than ever are leaving!! 

I stress again - everything on this site is opinion, but in my opinion Huma would have to be barking mad to be confident they can sell the unsold plots at the moment.  I also think that people generally  forget that not all of the first phase was sold in the first place. All we were told was that 'most' plots had been sold.  Add the rest to the resale plots, and Huma have a pretty big problem.

Just a feed back I get from people I deal with in Spain , buyers I am in contact with and  others I have talked to when I'm there

One example was a couple on site when I visited in October 2007 , who had bought elsewhere because they wanted to be there now ,but had retained their reservation so that when it is built they can move to ACC.....because they like it

For many the end of this year was the limit  they wanted to wait .....and want Spain now and can afford it and for them getting out is the sensible thing to do

Then there is the tendancy to hear more from those getting out than the silent majority who are staying in!

When ACC is built ,I doubt if there will be a problem selling them.....location, location,location and a well built product at a competitive price !

All unknowns though Brian, and many like me will have retained the plot having paid 3000 but have very little intention of going on to buy now!!  Again, my opinion, and while I do like the setting of ACC - it is not as good as other sites, and the biggest attraction was always the price - very, very low.  I have said all along - if the facilities are not built, then the houses will not easily sell.  I am not being rude - really, but your sources have not been very accurate up until now.

We heard from our Solicitor in Spain today ( Tuesday 11th December).

She said that she had an appointment with Huma next Tuesday (18th December) when she will pick up our cheque which is a full refund without interest or compensation.

This has taken since 21 st September which is the date we exchanged cancellation contracts. She had an initial Meeting with them on 5th November so fingers crossed next week will see our cheque.

Intially we were relieved but there is a feeling of sadness as ACC  was our dream.

We liked the look of Turre previously and property prices reasonable.MCC seems to be gaining popularity as well so mat be worth considering.

What we certainly want is an Estate Agent who comes recommended !!  Any nominations will be gratefully received !

You sound as though you are still interested in buying in Spain

Is it just this part or are you prepared to consider elswhere?

I suppose it depends on the property you find

Now is a good time to buy either new ready now or re sales and I dont mean just picking up a cheap property in a poor location!

The good properties can now be found at a 'realisitic price' and it all depends on what you are looking for 

The prices on the well located good new developemnts are relatively firm but after your experience with ACC I assume that you will want something now or at least ready by next spring

With re sales find what you want ....make a reasonable offer just as you would in UK .,..and see what happens........you can always increase it ,if it is not accepted first time!!!

There are good profesional agents who provide a comprehensive service and a number of them like myself post on this forum 

If you would like more info PM or e-mail and I can send you some details to give you an idea what you can get .....and perhaps a little re assurance that not all agents are bad!!

We have had an e-mail from our solicitor today he has a executed our bank guarantee for our first stage payment.and has a bankers draft from the bank which he will pay into our spanish account today This has only taken 5 weeks from instructing him to recover our monies.

He assumed once Huma knew he was executing the BG they would pay up in full so they did not lose a line of credit with bank holding the BG but it looks like they dont care as they have refused to pay anything.

Its legal action time for us now to get our deposit and second stage payment back. I would have been quite happy to get just all money back without legal action but not now. If Huma think they can string it out and offer to pay our money back on the "court steps" they can think again they have p****d me off so much now I am going all the way money back plus legal fees intrest and compo

In hindsight I wish I had kicked up a big fuss until I got a BG for our second stage payment

We were due to get our cheque on Tuesday but the appointment was cancelled as HUMA did not accept a copy of our BG.

I have had to send over the original so that on Friday 21st they can see my solicitor again and give her a cheque.

This refund is in two cheques. One is post dated for 2 months time the othe is dated Friday ( I assume !)

Why is this done in this way and not we with straight refund ? 

HUMA finish on Friday and then are on Christmas Holidays until 7th January.

Can anyone tell me ,under what circumstances would it be neccessary to have to visit the SPANISH CONSUL in LONDON when signing over power of attorney to obtain money back from Huma? Has anyone else had to do this?

You can do PAO via a local solicitor with notary powers to avoid going to the consul

look on www.thenotariessociety.org.uk/find to find the nearest one to you.

There have been a number of posts on various forums from buyers who have received their money back without a BG during 2007

However I suspect that just at the moment ,with the re start decsion expected shortly, that Huma will tend to want to have everything on hold  

However no harm in asking and I would do so as soon as Spain goes back to work on Jan 6th 2008 but plan your approach
