Two thoughts on this situation, either Huma are running out of available funds and need to buy time, or the decision on Acc is as we all expect imminently and the hopefully good news would be enough to make people change there minds and see it to compleation !

Or maybe as i suspect a combination of the two, but hopefully the latter proves to be the  final outcome!

We opted to withdraw from purchasing in September 2007.This was due to several reasons, obviously the time factor was one and also a report on the condition of the building that has taken place was another,as well as several other reports we received from an independent group that we commissioned in the area.

Our solicitor received the two cheques for the deposits we put down on Friday 11th January 2008. This was about four months after we issued instructions to withdraw.Our solicitor has charged us 600 eoros for this.

One cheque has been banked, the second is post dated 25th February.Sadly, this is theree years to the almost exact day when we visited the site and signed up.

The only compensation is the low euro against the pound...

AndylynnW: Why not bank the 2nd cheque? It is ilegal to post date cheques in Spain & no bank will refuse the cheque. If there aren't sufficient funds in the account you should receive what is in the account.

Don't wait, bank it now!

That would establish just how much they have in their bank account - which may be more information than we need to know!!!

I e-mailed our solicitor today and she replied that it is NOT illegal to post date cheques in Spain.....

Will check with the Bank....

Your lawyer is correct, my mistake!!!

I should have said that post dated cheques have no legal significance in Spain.

It doesn't matter what date is on the cheque, if you have the cheque, you have the right to pay it into your bank & subject to there being funds available it will be cleared.

The person giving you the cheque may ask you not to pay it in for a period of time, that is up to you. It depends in this situation, how charitable you feel towards Huma.

I'd bank that cheque ASAP if I were you.

I've just had a phone call from Huma HQ,  telling me I'm sure to be interested in their new development in Tabernas.

So if they've got funds to press ahead with that, there should be sufficient in the account for you!

You are not  acting illegally by banking it early, btw.

Hi all,

 

Just to let you know we have been down the b.g route via Andersons and the bank, Andersons now have our cheque so that is good news for us and proof that this route when followed properly can be successful. This will not stop us pursuing Huma via Andersons for all other related costs. I will also vent my anger at Parador and seek my after sales monies back from them. They must be under enormous pressure as their bank will be demanding answers I would imagine as to why they are not refunding people

hi all,we too have post dated cheque with aldea,,waiting for it to clear,,,how long is a piece of string pops to mind,as for parador,we got our after sales back over twelve month ago ,get on the phone and demand it back now,they will pay just to get rid of you.we live in spain and are very content,but my god !wish we had never set eyes on parador or almanzora country club,good luck to all,will post if our money does come through,,although not so sure now after reading posts.

Hi All, Would just like to make you aware of our situation, we have constantly been promised to be given our BG by Humas, and still waiting, consequently we instructed a Spanish solicitor, Domingo Ordonez at Abagobados, to get our money back,............... we had to send the solicitor 2,000 euro, today we have just been told that  Huma are not responding and have been informed that we need to take them through cout proceeding , the solicitor has requested 10, 000 euro for this to cover work, court apperances , expenses for travel to court food accom. cost ,normal?? and can anyone offer advice? any feed back would be greatly appreciated.

we have been totally let down by our british agent, Alma at international/Spanish properties Astley bridge,Bolton and also the selling Agents, John at Andalucian S jayel (office in aguailas)who basically sold us our dreams and have offered no help whatsover to be accountable,or helpful.

Ayn help/advice very gratefully received!!!!!!!!!!!!!!!!!
