Given all the comments below I would question the solicitors involved here.......when we reserved our phase 3b apartment and sent off the preliminaries to our solicitor we were strongly advised not to make the initial payment on the grounds of a) the monies should not be paid until commencement of building of the phase and hence the developer should not have asked for them prior to this; b) the building licence for phase 1 had not even been issued at this time far less phase 3; c) there were no specific plans available for our property or descriptions of the room sizes; d) they could see no details of the bank account opened or details of the insurance company that would ensure our payments through the bankers guarantee. This was qualified by a statement that even if our funds were protected from the developer gong bankrupt it would not protect us from delays to the completion as the contract did not give us any protection against the developer spending years obtaining licences and completing the project.
Roda of course required the payment to progress or it was a no deal so we ignored the solicitors advice and went ahead but at least we knew what we were dealing with and made our decision in this knowledge, so really we have no right to complain about anything.
We purchased on phase 3 (before it became phase 3b!!) in July 2005 and completion was due in July 2007, we are eventually due to complete this month. We've not been best pleased with the delays but we are confident in the product and I would say that we have never had any issues over getting new bank guarantees - we are now on or 3rd or 4th!
Hopefully this will at least give some of you peace of mind!

ezzor have you not seen other thread about them so called having licensce for phase 4 but "JUST WAITING ON A FORGOTEN SIGNATURE" check it out

We have tried a couple of times the last weeks to get an update of Phase IV from Florina at the Customer Service. She was ever so nice a year ago, but we are not getting any response from her this year. Has anybody got a currect e-mail contact in the Customer Department? This waiting and not knowing is not very nice!!

florina did my snagging last week, when i asked her, she said that all the lic's where approved at the last town hall meeting
there is conflicting messages in eos on this subject but i can only tell you what she told me

Had the e-mail below from Florina today, and thought I had to share the good news. Hopefully this means that work on Phase 4 apartments will start soon!

We have finally obtained the building licence from the Town Hall. You will very soon receive by post a communication from Roda Golf saying that we have the licence and a copy of it.
And of course the date that we begin the building.

Well that backs up in writing what i was told by customer services so it looks like we will now have to wait till they send out these letters so we can then fast forward 18 months to give us an idea when they may complete

It's my first time in this forum, and it is out of desperation that I am writing here. Roda Golf, through its solicitors have done nothing but avoiding me and make me waste my time, so if anyone knows of a lawyer in the area who is succesing in getting the money back please, let me know. I propose to all of you to make a joint action.

We signed up in September 06 and were told completion would be May 2008. We too are devastated. From lawyers we get the impression that succeeding with an application for the contract to be rescinded depends not only on the time delay but also the reasons for the delay. We are informed that Roda made late changes to the plans, which then took time to approve, but we do not know if this is a sufficient reason. We meet our lawyer soon and will ask more questions. We shall seek to rescind if our property has been moved at all in the new plans and the view or the relationship to the sun is different from when we contracted.

Thanks her grace. I have exactly the same information you have and the problem is that to prove that the delays are sought for by Roda Golf and therefore they have acted in bad faith would take time, money and a court case. We have tried to get the money back from the bank, but we are still expecting news. I still think that the best way would be to unite all people in the same situation and make Roda Golf take some real action about this. If it is true that now they have the license to build, we still have 18 months ahead (but meanwhile our money is in their hands, and at the current interest rates that's a lot of money).

Like most people who have purchased on phase 4 I'am in total agreement that firm desive action needs taking in order to bring this shambles to an end. I have read with interest all the differing thoughts on what is happening, but the bottom line is Roda are avoiding making any statement on what is happening and are holding our money, without recourse.
comments posted recently suggesting that the licence for building phase 4 had been granted have been firmly rejected by my solicitor, who recently wrote to the Roda management asking them to submit in writing an explanation of what was happening this they failed to do, suggesting who knows what?. It is clear that the Roda management believe that they can hide behind a contract, which I beleive now has run it's course.
My lawyer has suggested that while we all continue to fight seperate battles we will loose, however should a number of us get together and share our resources, using one lawyer then we would stand a better chance of forcing the issue with Roda.
I would be pleased to discuss this issue with anyone who feels this may be the way forward.

i have spken to our lawyers and asked them to clarify the position re phase 4 building licences , they infromed me that they checked with the town hall and they have no knowledge of building licences being issued .
if anybody has a definative answer on this matter i would be very greatful .

If this is the case and the town hall has not granted the licences well what about KENSOLS post below which florina from the customers services has put in writing in an email that they have just got them ,if that is a lie in writing that we have all seen on this forum is there anything we can do about this???

When I read Kensols post I emailed Florina a few days later, Oct. 3 to be exact. Florina replied to me by return stating that they have received the licence for phase 4. She also said that very shortly all the purchasers in phase 4 will receive a letter with a copy of the licence enclosed and more importantly the date when building will commence. If anyone would like me to forward the email feel free to send me your email address and I will do so.

i have no idea , i can only comment on our lawyers responce when asked to confirm that building licences had been granted .
there is a message from another member whose lawyer is saying the same thing .
i would suggest contacting your lawyer and asking him to confirm with the townhall as we all appear to be getting different answers .

Today I received a phone call from Ana Escribano who is the clients director at Roda, she had some good news and bad. Firstly Ana apologised for the lack of communication and then explained what had taken place and what was now taking place. The good news is that the application for the licence for phase 4 has now been past by the town hall but has yet to be signed off. Before it can be signed off, a letter has to be sent to all the residents of phases 1/2 and 3 on Roda asking if they have any objections to the building of phase 4, Ana assured me that they would be no objections. Perhaps someone from phase2 or 3 could confirm if this happened to them.
The bad news (well it is for me) is that Ana said if no objections received then building could commence sometime in November but that the 18 months build would be required, meaning that we would not have access until around May 2010.
She also said that she we be contacting all current purchasers of phase 4 to discuss some form of compensation. I have asked that she send me an e-mail confirming this.
