could you confirm thatwhat you are saying is you have a copy of the building licence for phase 4 apartments ? if so when was the approval date ? do i understand it correctly that calidone are saying that up to block five will be completed within six months ? ie dec 2008 - may 2009 this sounds an incredibly tight build schedule , you also state that it is within the 18 months stated in the contract it seems very strange that calidona are saying they have only recieved the licence last week and are guaranteing to complete within 6 months of recieving the licence . i for one would welcome the granting of the licence but as a phase 4 owner have heard nothing . as regarding incentives i would imagine they would have to offer something as they are responsible for the delays and in my particular case the unit will cost me £40000 more than originally envisaged , whilst this is not calidonas fault as they are not responsible for currency fluctuations , they most are responsible for the delays or miselling in the first place . i will look forward to recieving my copy of the building licence and the dates will be very interesting , most unusual of a developer to guarantee completion within six months when they have eighteen months in the contract . i must admit i did not envisage having to complete on a unit that will be worth considerably less than the contract price !!

Har rs anyone seen when CALIDONA where given permisson to start building your phase.we have bought on CORVERA and we where told our apartment would be ready in MAY 09, AS IT STANDS today we have not seen any building licence and therefore no building has begun.18 months after we gave them 80,000 euros,how they can give those dates seems very strange,if they have just been given permisson to start,also it seems that they are now bribeing people to complete,if you where to put 80,000 into an ISA it would have paid out more than what Calidona are giving you.

APOLOGIES FOR CONFUSION.The completion date is MAY 2010 NOT 2009 as stated in my last post.Vanesa kindly e-mailed the license and a copy of the letter being posted out so it will take a few dates to reach the respective people.

hi paul and carol , in responce to your posting if phase 4 of roda is completed in may 2010 as indicated by the earlier posting , calidona will have had 134000 euros of my money for four years earning them interest !! and they flatly refuse to offset any of that interest against the purchase price even though the phase is two years behind schedule (nice people to do business with!!) all of this with the real possability that your unit will be worth 30% less than you are contracted to pay how long will it be before your unit is worth what you paid let alone move into posative terratory . whilst i appreciate that calidona are not responsible for the state of the market they are most definatly responsible for the delays and questionable selling practise and appalling customer service .

Hi,
Just got back from Roda today, I have a place on phase 3a. There were signs of building, but only on the villas. There was nothing happening anywhere else on phase 4....sorry! any phase 4 people interested in buying on phase 3a, pm me your email and I will send some pictures (fully furnished)

Hi called into roda last week and they said construction is to start on the phase 4 apartments in late january or start of feb, they are just signing contracts with the builders and then they will start ,they were aware that may2010 is the finish date so she said there would be no hanging around in the new year,she also said there was a near full take up on the loyalty offer to date ,wheather thats true or not we will have to wait and see ,
HAS ANYONE NOT GONE AHEAD WITH THERE OFFER AND IF NOT MAYBE COULD YOU PM ME WITH YOUR REASONS AS I AM NOT TOO SURE ABOUT IT MYSELF

Our lawyer just told us that blocks 1-10 have been granted a licence and we are on block 11, if they have no licence by April or started building then we can get our money back, I have asked about the solar panels on the penthouses but Vanessa has not replied- no surprise there then! although our lawyer says the can not put these on the property they have to go in communal areas? I would like some proof to that effect as their lack of customer service makes us suspicious.

im only guessing here, but there is an area on the roof of our penthouse where there are some sort of generators, its cornered off, and doesnt affect anything.
my point is that perhaps this is where the solar panels might be on phase 4. They where fitting solar panels across from my apartment on some Villa's( i think), they where quite small.

Ray is right there is a communal area on the rooftops of all of the penthouses in Phase 1 where the generators for the air conditioners and any television aerials erected by the community are kept. The area is clearly walled off from all of the penthouse terraces and I would imagine that the solar panels which look to be relatively small will be housed there.

We have a penthouse in block 17 which was due to complete mar 2009 then sept 2009, we are not going to complete as we feel it has been mis-sold and with the euro and spanish prices in general we would be stupid to go ahead, we were offered the 30 days accomodation and 3,000 euros to spend at Roda but will not be taking this as it by no means compensates enough.
we have read today (erinjake) that the licence is up to block 10, is this factual and how do we get a refund if they do not start blocks 11 onwards by April.

As I said in my previous email we have heard nothing from our solicitor or Roda re having the build icence for block 10.
Is there anyone out there who knows catagorically how far the build licence has got to? Are block 9 and 10 included? Can we walk away?
Will we lose our deposit or can we join and fight this as mis-selling and get our money back? Earlier emails say not.

Our solicitor confirmed that it is block 1-10 that has the licence. He said if there is nothing in place by April we can ask for our deposit back as the 1st bank guarantee will be up and we will not be renewing due to no commitment by Roda to reassure us that everything will be built. Lets face it, how long will it take them to do the commercial centre and hotel at this rate, how can you get good rental return on an unfinished resort. I am sure Roda will be amazing if and when finished but we have lost confidence on our investment and are feed up with Roda's lack of customer care. We probably won't get our money back so we are stuck.

I do not have details of your contract but in most of the off plan contracts there is a finish date plus extra time for delays outside the control of the developer
So you should have a definite date when you can cancel the contract
On another development in a similar situation the buyer has been advised that when the point in time is reached when it is impractical for the developer to meet the contract date [ or extended date] the buyer can cancel the contract , get a refund or call in the bak guarantee
You do not have to wait for the date to expire
By impractical I mean that the time it would take to complete the building is way beyond the contract date
Taking this route may involve legal fees but they should be recovered plus interest on your deposit when you succeed with your legal action [ if it goes that far]
Take legal advice and even alternative advice
Almost every builder/ developer world wide will be applying delaying tactics often because their banks make them!.....that is the financial world we live in at the moment
Now if you are happy to stay with the development then that is your personal choice and no one can argue with that [ Roda will I think end up very good] but again you have to make sure that if you go beyond the contract date that the bank guarantee you have rolls over and continues.....this is an aspect you need definitive advice on
As I have said above I think that Roda will end up a good Resort but you always have to make sure that you have the 'i' and 't' ....I speak from experience of not doing so [ in my early days!!!!] but where I was fortunate to be able to get a satisfactory resolution
Whilst 2009 may turn out to be a good year to buy a life style home in Spain.....it is not a year for risk taking!

We do not have a date on our contract. It states 18 months from the date of the build licence. We were told that all licences were in place and signed the contract. Just goes to show how you should have an expert go through the contract with a fine tooth comb before signing and not taking the word of solicitors. We can't really blame anyone except ourselves for being so naive.
