Hi to all owners on phase 2 who ever is the owner of the apt in January will have to pay the local town hall taxes in April so it might be that people will wait to complete till February so that the developer will have to pay the taxes correct me if i am wrong?especially if the developer makes them pay some extra cost like he did to people in phase1 bye Irene

Today our Lawyer and the developer has agreed to sign papers in th first half of february. So we expct to be "moving in" in the second half of February.

Hi There,
When wichmann posted his declaration that his lawyers had contacted him with a view to completion I took it with a large pinch of salt and muttered to myself 'here we go again!'.
But I was delighted to hear from my own lawyers a couple of days ago that they too were looking to set up a date at the Notaries as soon as possible.
You wait for ages and suddenly everything comes along at once!

I'm glad to see that you also have recieved the same news, our Lawyer is signing tomorrow then 5th, the we are official owners of an apartment in Don Juan phase II .

Congratulations Wichman! When is the house warming party? This is very good news for everyone at Don Juan this means that the developer is serious about getting the site completed, hopefully DJ 3 will be also completing within the next 12months. I belive that if we can get all 3 phases completed we have a better chance of getting the road at the bottom sorted. fingers crossed!

As the habitation license has been granted for phase 2 and owners moved in, does anyone know when the eyesore of a pool at the front will be completed?
Also I noticed at the weekend a piece of rope tied from the perimeter fence to the entrance gate, is this going to be a fence to separate the garden of phase 1 from the new pool?
Any ideas?

I agree Irene it will look a mess
Wasn't there an issue at some point that the green area at the front of block 5 belongs to phase one and the pool to phase two so maybe (and i am only guessing) that they are separating both areas. Also the sprinklers were on but only on the "phase 1" side of the rope. The rope by the way ran alongside the block 5 side of the path that leads to the pool.
The occupant of the garden apt in block 5 next to the pool has put a gate in his fence and there were children playing in the green area. I thought that it was not allowed to put a gate in the fences. Personally I don't care about the gate as it is not my business and good luck to him but maybe this has encouraged a segragation fence.
Having said all that this may not be a fence at all we will have to wait and see. They could do with getting the pool sorted though!

Hi i have read some where that they do not allow a gate from peoples garden into the pool area as this would break a safety issue with getting a licence for the pool but i could be wrong.I also would be upset if all of don Juan is separate as we have friends in phase 2 so would that mean we could not be at either pools with our friends?I thought the days to be separate endeared when the great Wall came down sorry for that but i think its mad if we are, lets hope its not.I think your security guard waters your gardens at night which is the best time to do it bye Irene

It will not be possible to get a licence for the Phase 2 pool (as is also the case with the pool between blocks 6 & 7 of phase 1) because someone has put a gate from their private garden which leads to the pool area. Ironically the unauthorised gate in block 5 would not effect the licence if a proper fence was contructed between the 2 phases' property.
srs you are right that the area behing block 5 belongs to the phase 1 community. The rope you describe is not an accurate devision between the 2 communities. Phase 1 own half the gate and the dividing line then runs virtually beside the pool to the fence nearest the sea. Eventually I am sure everyone wants to see the area shared by phases 1 & 2. Regretably we may have to wait for that to become a reality.
The Phase 1 community had to pay to get their pools commissioned. I expect the same will happen with phase 2 - although phase 1 have already filed a complaint with the health department about the situation at the phase 2 pool.

Is it not possible to insist that the occupant who has put in his gate remove it? I am pleased that the health issue has been reported. I have just had a long term renter refuse the apt only because of the pool. I have seen a dead rat in it in the past which must now have decomposed and the mosquito situation is going to be horrendous as it was last year.
Also, are we intending to stop new owners from phase 2 using our pools until theirs is sorted? Of course not, that would be ridiculous and petty in the extreme! So we need to start as we mean to go on and "share and share alike".
If this is a fence to be put up then the developer by past experience will put it were they like and once it is up it will be difficult to remove. As I said above the solution may be to nip this in the bud and insist that the occupant removes his gate as soon as possible.

We have asked GICS to inform the owners of the 2 offending gates that they have to be removed. I don't know if they have acted on the instruction but I will add chasing them up on this issue to my list.
You raise an interesting point about Phase 2 and access to our pools. We have issues with the developer who controls phase 2 but not with our new neighbours and I personally think we should let them use our pools. However this has not been discussed by the committee yet so I can't give a definite answer at this stage.
There is some repair work required to the phase 1 pool between blocks 6 & 7. It is also doubtful if we will have a licence for it in time for the summer but as the main pool would be very crouded if it was the only one available we hope to have it open even if it on an "at your own risk" basis as was the case last summer. It is possible that the phase 2 community could do the same.

You mention that the license has not been granted. We went to the Town hall in January to find out for ourselves if the Habitation License had definetely been granted on Phase 2. They also informed us that the pool license had also been granted in January 09.
