Hi Paula,
It really is impossible to say. Right now there is no water supply to Phase 2. This and the issue of how the 2 communities will work together needs to be sorted out before the licence is issued. The Town Hall is under pressure from Arrohabitatge but I don't think they will issue the licence until these issues are sorted out.

Hi,
For information, we have had our lawyer to investigate the situation about phase II. She had an architect to go to the Town Hall, to ask all our questions to both construction issues as well as what is holding the licence back. We recived the report 2 weeks ago (it's in spanish, so it took some days to read and understand it ).
The report we have recieved from the architect conclude that there is only one remaining issue to be solwed before the Town Hall will free the licence, and thet is the have the water situation in place. This is expected to be in place for us to take over our apartment in January 2009.
Please be aware that I'm not refering to my own expectations, I have stop expecting anything, it's only a short summery of the report we have recieved.

Hi Wichmann,
I heard from people that they received a letter from the developer stating that all legal problems are now solved and that there is nothing in the way of the license. I can’t judge if it’s true, but there are some indications that this could well be the case (f.i meetings between Nuria and Don Juan jr.; inspections of phase III, etc).
Phase II got at least water for the gardens as Gestaqua installed the necessary meters. I don’t know how the water supply for the blocks themselves is arranged. I thought they also went through phase I and that we agreed to supply phase II but I can be wrong. Anyway there seems to be solid progress towards completion.

I have to make a small correction on my earlier post. The gardens of phase II had water after Gestaqua recently installed their meters, but it’s disconnected again. I assume it’s done by our maintenance company. I don’t know why; maybe David knows.
Some people asked if I expect completions of phase II in December. Of course I don’t know for sure, but it’s unlikely that (even if everything goes well) it will happen before the second week of January as local holidays would make this difficult.

According to the old man himself, Don Juan senior, the license for phase II is assured. The water problem is solved by an independent supply so the problems with phase I are no longer an obstacle. He claims that they already have the license in possession but we heard similar things when phase I completed and still had to wait.
My own estimate of the situation is that it is realistic as five major problems have been solved:
- phase II gets it’s own water supply and is no longer dependant on phase I
- the road along the railway is beyond the town hall and the developer’s power so won’t be an obstacle to the license (and they improved the other road a bit to compensate)
- the decision has been taken by the town hall to bypass phase I demands completely establishing completely separate communities
- the work license for phase III has been granted so the major problems with the town are clearly sorted.
- The developer paid 300.000E for his contribution to the costs of the new road connecting the Avenida Carvajal with the highway (going behind our development, down through the valley)

Thanks Max for this information.
With regard to the 5 major problems that you say have been solved - is this just your own opinion about each point or have you obtained this information on good authority?
Having a separate community established for Phase II was probably always on the cards - however it also means that we will have to cooperate with each other and possibly reach agreement on shared grounds/facilities. As long as the developer is in control which is likely to be for a long time yet this will be tricky.

The information supplied is based on reliable sources and my own fact finding. I try to refrain from idle speculation.
Regarding phase II people thought that we would form an integrated community. My opinion has always been that a cooperation between the two phases –preferably formalized in a superstructure- would be the best we could achieve. I would say that by now we lost what leverage we thought we had and will have to wait until phase II is willing to make agreements with us. Phase II already has an administrator and I don’t expect them to stand up to the developer.

Isn't it amazing how the developer can find 300,000 Euros towards the cost of a road, but is unable to pay all his community fees on time. As they say in life, " What goes around, comes around."
Regarding the communities of phase 1 & 2, I think it was always going to be the case that in the first year of phase 2, the developer would be in some sort of control. In the meantime, we need to make strong ties with the owners of phase 2, and hopefully after their first year, they will see the light, and merge as one community. That surely has to be the best way forward. Its crazy to have the community split.

Happy new year to everybody in DJ,
we just returned of our Christmas Holiday from Gran Canaria and went to my office. There I got a message of someone, who pointed out that the constructor got the Licencia de la Primera Occupation and want to fix a date for the Escritura. Tomorrow is a day off (holy three kings) in Spain, so I won´t be able to call anybody. Can anybody confirm this issue?

Hi Vossi,
I haven't seen the licence, but based on all available info before Christmas I announced first completions in the first half of January. Most of phase II owners will get phone calls from their lawyers end of this week or the beginning of the next one.

This is indeed a Happy New Year,
We have just recieved the licence for use of our appartment, and we expect to sign hand over papers within 2 weeks.
So to all Phase II owners, if you havn't seen it yet, it's only a matter of delay in tha mail or at your lawyer.
I still need to look into some details, however this has been confirmed by our Lawyer.

I expect Arrohabitatge will try to get Phase 2 buyers to pay their mortgage cancelation fees and Plus Valia tax just as they did with phase 1. Although it is in the purchase contract that you have to pay these taxes and charges the clauses requiring you to do so are abusive and illegal in Spain so if your lawyer is any good you should not have to pay them.

Hi all,
A short update on our status: we expect to sign hand over papers, before end of January. Our Lawyer and the Promotor are trying to find a date, and we expect that they agree either today or Monday (we need 7 days to do money transfere, so it should be around the 26-28 of January).
Has any other phase II owners heard anything from either Promotor or Lawyer?

Hi Wichmann,
I can assure you that there are other owners who got informed. Apparently they don't post on EOS, but they have informed me that they are invited to complete. Due to the current economic circumstances there are multiple buyers who hesitate to sign for completion.
