polaris have come up trumps.
reading between the lines, you dont need a solicitor, who cares if theres a habition licence or not, it will come in time and to avoid mortgages charges (which seem very high)you should pay with cash from a top up mortgage at home.

Every house I have owned as it turned out I could have bought without a solicitor as there was never any problem, but I didn’t know that at the time, I considered it insurance.
I have never claimed on house insurance, buildings or contents.
I have not had any claim against me on my car insurants.
I have never had to claim on my holiday insurance.
I have always been of the belief, don’t insure something you can afford to stand the loss of, but without any one of the above I could have been finished finically.
All those who are buying from the builder San Jose (a big builder) who haven’t got legal representation and bank guarantees, I would think, don’t think it such a good idea now to not have them.
Those without proper building consent and habitation certificates that have had the house pulled down would wish they had done things differently.
Would I chance being without any of the above in the UK NO.
Would I chance being without any of the above in Spain NO NO NO.
All those with hindsight I congratulate you, but until I have it myself I will just keep protecting myself.

Well said Phil, its easy to say 'you dont need' until something goes wrong, like yourself and prob most others insurances are there for a reason, NOTHING in life has gaurantees so better to be safe than sorry.

Well said Phil! As a lawyer, I am well aware that people regard solicitors as a pain in the ass and when everything has gone smoothly, it's probably easy to decide you could have done it without them. But - and it's a big but - how do you know that things only went smoothly because you had a solicitor?
I didn't think that our Spanish Solicitor had done much work for us in the purchase of the apartments at Condado - I have not really heard much from them but knew they would let me know if there were any problems. But when we were at the Notary's office for the completion appointment, our Solicitor's file for our purchase was several inches thick! I assume that he has been provided with all sorts of documentation that he has checked thoroughly and which we are not even aware of - presumably the equivalent to our planning permissions, building regulation consents, searches, details of any restrictive covenants etc etc. It certainly made me realise that the solicitor has probably done far more than we are aware of to make sure that we are buying a property with a good title. I wouldn't attempt to buy a house in the UK without using a solicitor experienced in conveyancing but certainly wouldn't even think about not using a solicitor in Spain.
How many programmes have we all seen where people in Spain have lost their homes because of 'illegal' building. At least if that happens and you have used a solicitor, you have some recourse through your solicitor for professional negligence!
The correct advise has to be don't risk it - use a solicitor and let them take responsibility. You are making a big investment and it is not worth the risk just for the sake of saving less than £1000.

Here is a tip for all who are completeting. As the stress kicks in, reach for the wine bottle. Fill your glass and enjoy. Do this until the bottle is empty. You will feel relaxed and calmer. You will not feel guilty because you have had only ONE GLASS. It works for me everytime. hic. hic hic.

Past completion date now although habitation certificate arrived lawyer awaiting "fin de obra" now extract below:-
"We have received the confirmation that the habitation certificate has arrived. We are waiting now about the "fin de obra".
I am in knowledge that at present the property has not got the "acta de fin de obra" in place, which means that the architect has not signed the property as finished, that the property has not been registered at the land registry as finished yet, and we have no proof that the builder has finished the works according to the license obtained.
Please, undertake the risk that this might carry if the builder does not take the action of registering the property as duly finished at the land registry. "
so another wait, what has happened to those who have already completed, do you have fin de obra which I translate as end of works

Hi Dringman - Sorry about all the hassle you're having regarding this "fin de obra". What I can't understand is, if that means end of work, how come they released a habitation certificate for it? It's just an idea but if you can't get the info from your own solicitor, have you thought about posting on the general forum to see if you can get any help there? They have Maria who seems to be a resident solicitor, she may be able to help. Hope everything gets sorted soon. Best wishes

Not heard about this "fin de obra". Received e-mail from our solicitor this morning to say that our completion took place yesterday by POA and we can collect the keys from the solicitor's office in Mazarron when we go over in August.
How are completions going this week? I seem to remember that there were a few people with completion dates of 17th, 18th, and 19th June - although perhaps others have had to do Power of Attorney as we did on 3rd June because the Habitation Certificates weren't available.
It's just a pity the Town Hall don't get their finger out and get the Certificates issued and up to date as it seems that everyone is having to postpone the completions but only by a couple of weeks.
Good luck to all in Murcia at the moment who are completing (or hoping to!)

“acta de fin de obra”
Interesting one this I have been looking for information on the general forum about it.
Fin de Obra means literally end of works and it is the sign off that work has been completed on the development and is compliant with all the Licences and procedures. Without it there should technically not be an LFO (License First Occupation)
Maria de Castro, who is a Lawyer that regally contributes to EOS says in one of her threads:
“The " End of Works" certificate is issued by the Architect or Engineer who directs the works to certify :
* He has directed the works according to the Project, technical documentation and good building’s rules and that has had control on the quantity and quality of the building activity.
* He also certifies the work has been carried out according to the Project licensed by the Work License and it is suitable for use according to the instructions fore use and maintenance. All as per stated in the in force Technical Code of Building.
This Professional often issues too the " end of Urbanization works certificate"
This certificate with the approval of the Architects´ or Engineer s´Association.
These documents are required for the obtaining of the First Occupation License.”
Hope this helps, I will be ensuring this and any other papers that are supposedly provided before the LFO is issued before I complete.
Those of you completing soon, it may well be worth you asking about these papers and let us all know what response you get.

As the EOS lawyer indicates in her thread that this document is required to obtain the Licence of First Habitation, it would seem that this must be in place for the Habitation Certificates to be issued.
I would guess that this document is copied to solicitors in advance of completion and is probably something that we are not even aware of - as I said in my earlier post below (in an attempt to defend the lawyers amongst us!!!) solicitors do a lot of work in a conveyancing transaction that purchasers are not involved in - hopefully this is an example of that. And if the solicitor has allowed completion to take place without this document being in place, then there is a potential action against them if you suffer loss as a result.
Just demonstrates even further why we should all be using solicitors - if anyone still needs to be convinced!

Just arrived back from a 2 week stress free holiday to my Brother's place in Torrevieja. Now back home to the STRESS! First off, congratulations Ruth it must be a big relief for you to finally complete, wish I had. Good luck to you.
Dringman, I went to visit illucom near Torre Pacheco, mentioned your name and Sadie told me to send you her regards, they've got a great selection of lights, have you used them and are you having aircon done by them. Also next door to them is a furniture shop and they were very helpful, they told me they work together with illucom when it comes to fitting your apartment. Inside the furniture shop I was introduced to a gentleman called Don Marshall who is an interior designer, he was with a couple from Hacienda Riquelme. He quickly told me that he will do the decoration for you, curtains, kitchen utensils, bathroom accessories etc, the lady with him said he gives the apartment the WOW factor.

Shampers, the questions you asked me to ask for you while i visited Condado, we went on Thursday 5th June, the rep who took us around was Sergio, I asked about the Corvera airport and he told me that on Wednesday 4th they had the FINAL approvals and that the airport will be ready for 2011, bit later than i thought but hopefully they will get going on it now. Your other question was how far to the new Foro from garden 4, well I would say about 10 to 15 mins steady walk, 30mins back cos i'll hand you a beer as you go past my back terrace on garden 9. Sergio also told me that the Oasis should be ready by 2010, they are really pushing to get this complex up and running. The Nicklaus signature course he said will be a PGA course which would increase the value of the properties.
Anyone visiting the site soon will not be disappointed, we took the new toll road there, had the road practically to myself, after paying the toll at the end turn right on to the RM3 heading for Totana, about 12 KM you take the RM23 exit 11 for Alhama and your only on this a few minutes and condado's on your right, the main roundabout now has a big granite stone and tree's in the middle with Condado de Alhama on it, looks really impressive. Take the first right and head down to the next roundabout where the sales office is. Unfortunately we could not go to our apartment in garden 9 as they were still working there, we were shown around and the place is awsome, the gardens are beautiful and the finish in the apartments is very good, hope they all will be of similar standard.
Now I'm back and i still haven't had my mortgage approval from cam, still not had my bank account details off them to send money over, not answering my e-mails and i'm starting to panic a bit cos completion is only 13 days away, Don't know if polaris will give me a couple of weeks grace if Cam don't come through for me. I know it's not only us who are in this position but that doesn't make me feel any better. Anyway, sorry it's been a long reply i have been away for 2 weeks and it took me ages to read all that's gone on.
