Hi Taxiparrots if you go on the general forum go to BG thread then thread Abusive BG my lawyer tells me to accept it .I do not always get the answer I would like but all we have to go on here is the experiences of others The legal eagles don't even agree on what is best and are reluctant to advise they are leaving the choice to us. The courts are bursting at the seams right now .If you read the Spanish newspapers the courts are at breaking point with all these cases .I have no agenda as some believe I am confused and just wonder what others are thinking of doing for the best outcome .JA

I don't know if anyone else has noticed but you are quite a catalyst nae instrumental a huge mouth peice in most if not all of the silly arguments on here .You never have anything informative or useful to say infact I can not think of one single useful piece of info you have provided to your fellow purchasers .Some of us are trying to move on from the usual slagging match although throughout all the arguing , unlike you , most of us have managed to contribute some small amount of info or add to the debate in a useful way despite the bun fights .Perhaps it would be better if you stuck to conversing with SARC they will appreciate your lack of anything useful to say as they do not appreciate their members having vision or commenting on issues not sanctioned by them infact they prefer their members to have no knowledge and to bleat . I guess you have found your niche Chrissie so why don't you stick to SARC and let the rest of us get on with the events in the real world .Good night Chrissie and Sleep well.

Hi JA, good points raised for those of you with BG's. They certainly do have a gun to your heads yet again. It must be quite a dilema as you now have to 'trust' or fight the banks to do whats honorable. I know I dont have a BG but your point about the Lawyers contacting individual banks is perhaps the only route you have right now. Its more expense but it may give some reassurance before signing away any more rights to claim from SJ/HdT. They would not offer this unless it was to their own benefit to lessen the amount of Creditors they have against them on paper. Kind of passing the buck. Nothing they do or have done in the past was for the client so we have to assume its the advice they have been given for their own gain. If it's to YOUR benefit then I hope you can grab it and the process doesnt prove too painful. Oh joy, life again as we knew it!!

if the banks are not going to pay up then you might as well go to court and take action against them both. It seems, and I would like to be wrong) that all this does is alleviate a small amount of potential interest that SJ could end up owing against their creditors statement and the bank will probably still not pay out and you will be forced to go to court. So we may as well take them both at the same time and get the interest also. I think all the lawyers are currently negotiating with the banks to understand whether they will honour the guarantees or not. I think it is this that will influence lawyers advice to individual clients.
the Financial markets are not sound however regardless of all the bailouts and to give money away without any guarantee that it will be returned is going to be a far more bitter pill for the banks then usual.
I was hoping for my money back for christmas. And it could be possible for 2009..2010..2011?????

I was at the home of another SADM buyer last night who has done exactly the same as we did and gone ahead with their dream,
they have changed solicitor as their old one did not execute the BG on May 5th BEFORE administration when told to do so
Anyway to cut a long story short the new solicitor has filed for the BG money plus interest which comes to a hefty sum
No expert but I would imagine the administrators have advised SJ to renage the contracts if we don't claim interest that will put many thousands into the SG pot from getting out of paying the interest

Its terrible isnt it. Linda your bank guarantee should still stand. Have they agreed to resolve your contract with the rest of us? there is some famous case I believe where an expired bank guarantee was paid out and became a test case for all other such claims. the ruling was that in every way yours was valid and should be treated as such.
I am hoping to hear back from my lawyer this week and this will determine my course of action. It will be based on a written promise for the bank to honour the guarantee. Mind you this whole experience does make you wonder whether the term 'contract" has any meaning in spain.

Below are the main points I have taken from a report sent out yesterday by Abolex. Many of you will have this anyway. Some may be slightly different depending on your circumstances. Out of courtesy, I have asked Martin if he has any objection to me putting this information on this forum. I have not copied it in its entirety but retyped so any spelling mistakes or otherwise are mine.
16 October.
For those with a BG (even a copy) it is recommended to reverse the contract as proposed by San Jose. Reversing the contract without taking SJ to court will save money and time as these agreements can be concluded next week.
If reversed the client will no longer have the option of the house but instead will have the option of executing the BG directly through the bank. Executing the BG directly means the full amount included in it will be paid by the bank. If the BG does not fully cover the amount paid as a deposit, the remaining amount will stay in the administration process.
If the banks do not pay straight away The Judical execution becomes necessary. It is important to know that clients will still be part of the administration process for the full credit until it is paid by the bank through the BG
Next week SJ will be signing termination agreements as approved by the Administration members.
Clients without a BG.
It is important to understand that legally SJ owes you the execution of a contract to purchase of a house. This equals a credit for the amounts you have paid so far.
If the contract is terminated, you will loose the position of a buyer and will become a creditor of the same amount as before, except for the fact that there is no chance of obtaining interest or maybe legal fees. This credit will still be in the administration process with the same credit as if the contract had not been terminated. This option will mean incurring more legal fees and end up in the same position as before. A creditor with an ordinary credit.
Some colleagues were already sueing SJ for the termination of contract prior the the Administration process starting and some have decided to sue since. On the 24th October it is expected to have a court session to decide on these cases that have already started. The court decision will let us know if it is in your interest to litigate for the termination of contracts.
The following inforamtion comes from SJ representatives.
SJ are negotiating with foriegn investors to take over SADM development or, at least part of it, where all clients who wish to have their house built would be concentrated.
With regard to the other developments, like El Pinet, many houses are partly built (over 60%) and the remaining licences have been granted. They are pretty confident that this development will go ahead and that San Jose Inversiones company will sign deeds for sales in the near future which will give them room to breath.

Just in case the guidance regarding if you require consent is lost.
There seems to be some who believe that you must obtain permission from your advisor, to publish the content of a letter or report from them to you.
It is your property which you pay fees for. It is yours, you can put it on a forum or wherever you wish. You have paid for it.
If you buy a house from a builder (assuming they come up with the goods), you can show people around, take photographs and publish, without their consent. It is yours.

Once we have posted onto an open forum a posting becomres part of the general domain. Therefore, reposting it, as long as it is atributed to the original author is not an issue. The issue is when you either alter its content to change its meaning or claim to be the author when you are not. Any way you, Fin etc have been trying to burry it, I just exhumed it from the bottom of the pile, are you upset as people can now see it then?

Tony I suggest you consider all threads and Chrissies behaviour before you are so quick to give us the schoolmaster from a carry on film act. People are annoyed at Chrissie not be cause she wants her house but because the whole of last evening she was being nothing but a total pest and constantly intterupting useful debate .
As for the post you have just made may I remind you that Linda's lawyer went to great lenghts to show the comment about refinancing was " Please note the following information comes from San Jose representatives " Therefore the report from Linda's lawyer did not say this at all .The report from Linda's lawyer contained information from San Jose representatives not quite the same thing . When put back into the correct context .The way you report fact is as usual very misleading .This is a prime example of the way SARC play with information to their own end.It is really not acceptable . So instead of doing the the school master routine perhaps you should go back to school and take Chrissie with you .
No wonder people don't want to post any information here with you rejigging everything to suit yourself . I had reservations about Linda posting this info I bet she does now too. JA

I was under the impression that there was a court session today, for those already sueing and that we would be informed post "meeting" of the outcome and advised as to whether we should now also reverse our contract.....................now its the weekend!!...............the wait goes on.
