Banks responsibility as per law 57/68

Ok, I would like to see how far we can take this.  Even to raise awareness as Maria is trying to do.  I'm not about to tell anyone what to do, just to bring about a discussion and see where it takes us.  And perhaps ruffle a few feathers along the way.

My deposit was paid to Bancaja.  What Bank accepted your payment???  If you don't know, perhaps it's time to find out. 

Banco Pastor have our money.  Any other banks? 

Bancopastor for me too and I am already half way through suing them under provision 1 of law 57/68 .MM

Our deposit was paid via BACS transfer to Ambasun (Agent) who say they paid it to the Builder.  When trying to question anyone at Ambasun I am told their staff have all changed and the chap in charge whose name is M.Hurst is never around to speak to.  I hope Ambasun disappear.  They even kept the celebratory wine which was given to us when we were getting sucked in.  I hope the wine choked them !  Ambasun introduced us to Bancaja and we opened an account with them (next to useless).  God knows who has got our deposit it may even be a shepherd somewhere in the moutains !

I notice from the Forum that purchasers are trying to find out which Bank handled their deposits so that they can see if they can take them to task for laundering money and taking deposits knowing there was no Bank Guarantee which in Spain in illegal.  

Question did anybody purchase around June 2006 at SADAM from Agents Ambusun because what we would like to know is if anyone has found out what Banks were dealing with deposits at that time with Ambusun

Hi all Please excuse  malc and his rude interruption of this thread . He has a some sort of strange grudge against me and has nothing to add to this thread except stupid worthless insults .

I think this is a really important thread and for anyone with a fairly large deposit it  is the way to go .My situation is very complicated but I think I am about to get a good result using this route .

Dave  My BG like yours is with SGR but they are more like an insurance company it was not an SGR account that received my deposit ,SGR only under wrote the BG in retrospect on behalf of SJ when the build was delayed and I demanded a BG be issued immediately . This complicates things but does not negate the receiving banks responsibility in law .

This law is of far more significant  for those without BGs. I am also  in this category not by choice but by circumstance .

As for the other questions about where the deposits ended up it depends on which banks SJ were using at the time and whether or not the deposits were processed  through a subsidiary company or by SJ  directly .  Many HdT deposits for SADM  were banked by SJ .It is difficult but not impossible to find out .MM

MM  you no exactly what i have against you, and until you back up your accusations (which you cant ) i will always consider you a fraud and a liar.  So you are close to a result ?  why not share it then ?  no you would rather pm people,  what a joke you are.

ok MM  show  the proof that you keep accussing me of and prove im the liar and you arent a fraudster, then i will leave you alone. but you cant. You are happy to bad mouth people and make accusations to make yourself look good but never back anything up when challenged. 

Ill tell you what tho. for the sake of the forum YOU PROVE WHAT YOU SAY OR APPOLOGISE TO ME  then i will leave  you alone and let people make their own minds up about you.  Some how i think it will be the normal stupid response tho.

Mine was paid via ambasun June 2006 to Bancaja. (with a promise of BG within the week).

Could those of you who have written non thread based comments do the decent thing and remove them, so we can keep this for information only.

Maria, what would be the first steps to approach the banks. Would we need a legal rep to approach the bank?

I would advise you to use a legal representative. There are two different routes:

- 1) Out of Courts following judicial action if necessary
- 2) Clients´service and Bank of Spain

These two routes are excluding to each other.

I'm not entirely sure what is meant, but have asked for more detail.

For those who don't follow Marias blog this her last comment re: 57/68.  The second sentence may open up another can of worms (that I'm sure we already knew existed).
