We tend to agree with SRS too much emphasis is being placed on this 'face to face' meeting. The issues that the concerned neighbours have (which incidentally are of concern to us also) - have already been pointed out in various posts on this site and have been discussed and considered over the previous months already. We agree that the committee needs to make sure all neighbours are kept informed somehow on a regular basis of work being done and any actions being taken by whatever means possible. This hopefully would alleviate peoples worries and stop any paranoia developing.

Persistantly insisting on an EGm and 'face to face' meetings seems a bit like rallying the troops for a battle which is the worry as though there is a some sort of hidden agenda. There is nothing in the points made that we can see that have not already been raised and would actually benefit from this face to face discussion and would actually speed up any resolutions. If there are other situations that really should be pointed out to the community - ~(as BrettD seems to be indicating and perhaps should PM everyone with whatever it is) -then they should be so we can make an informed decision on whether this EGM is absolutely justified and would be beneficial.

There seems to be too much innuendo going on which leads us to believe this is not entirely general concerns atall. Let us be made aware of everything if we have not been already.  We are sure that all committee members are approachable or contactable in some form  and why the' worried neighbours' are not contacting them direct is beyond us. Max and Saskia have always been very active members of the community and will always try and help as they are some of only a few permanent residents there, (and their efforts should be applauded of course) but let us remember  Max is no longer on the committee by his own choice and we are sure would rather be approaching and treating the board the same way as the rest of us and not appearing to be part of some sort of a revolt. It is best for all of these 'worried neighbours' to stop imposing on their good nature and deal directly with the existing committee to get their concerns dealt with positively in the correct manner. The tone of some of the posts on EOS is enough to indicate that the meeting will just be a massive slanging match and will still not achieve the results that every one is seeking. In fact it could potentially harm the existing committee and lead to members standing down - why would anyone want that ?  We need continuity. There are many cultural differences but our fears and needs are all the same and the only way forward is to work harmoniously together.

Why not let the committee ( who have been elected by us ) answer the points raised already  - most of which are outside of their immediate control at present and some were left unresolved from the previous committee, who certainly had longer than 100 days to try and resolve them. We should all be able to voice our concerns and be taken seriously at any time and the committee members are all aware of their responsibility and will deal with everyone one of them when they can. As David stated let them be judged at the end of the term by the results achieved. They are our neighbours aswell lets not forget and will always want what is best for us all and Don Juan. Elected governments get at least four years and still don't get it right or appear to achieve anything.

Trying to discredit our committee will never achieve any sort of unity which we will need in abundance if we are to take on and deal with the major problems that are still with us and probably will be for some time.

I don't want to repeat my arguments as I contributed enough to this topic and community matters. I just want to clarify that I don't know BrettD and Carol12. Neither am I the ringleader of this movement. On the contrary I have done everything within my possibilities to prevent what is now happening. I have spoken at length with Rene on several occasions to warn the committee that there is a growing unrest especially with the (semi-) permanent residents. The evening I was asked to join a meeting to discuss the firing of Tonia I have first called Rene to warn him. During the meeting I called him again to inform him of the rumours going on. On several occasions afterwards I have made suggestions how to put the lid back on the kettle. To no avail unfortunately; maybe things were already unstoppable.
 
Thats why I am convinced that a EGM is the best solution to give people the chance to air their views and in some cases apparently suspicions, use their vote to set priorities and get all this out of the way. If I was sitting on the committee I would be the one demanding this meeting instead of ignoring the request, but alas it's not up to me :)

Good evening,

I limited myself to gather all messages that have been written so as to form an opinion of what is happening.

I am really worried, because I think that there are serious discrepancies, innuendos, insults, etc. so I would like to know the truth.
The explanation that the board has given me my worth, because I have not heard what I told my neighbors and stakeholders.

I am very worried, because if it is true what is said, and the actions of the current board are outside the law so WE CAN BRING SERIOUS CONSEQUENCES AND COSTS TO ALL NEIGHBORS.

And I'm very worried, because I insist that we talk about police, prosecution, slander, insult and abuse of power, and if as a result of all I HAVE TO PAY AN EXTRA FEE for solving the problems that the current Board in administering our can cause, then they will be neighbors to demand that the board and its administration.

Therefore I am seriously concerned, and the reasons given by the Board have their reasons but are true?. 

So I think the Board should seriously raise their actions and their consequences, because as I HAVE ALL THE NEIGHBORS TO PAY FOR THEIR PERFORMANCE will be punished not just leave the Board but with lawsuits. I insist that I am very concerned that the Board has no money to address these issues and we will have to pay for all the neighbors, so ask the board to conduct its work in the right way, not get carried away by personal matters and especially to hear the neighbors.

Hi all

I have just read some of the last few days messages. Its amazing how all of a sudden we have all of these new people joining our forum, Toni 1, Brett D, Carol 12. etc. Brett D trying to catch our interests, Carol 12 with her concerns. Toni 1 trying to save her job.  Not being funny, but where have their concerns been for the last 2 and a half years that we have all been working together on this forum to make a better community. We have had problems from day one. Have they been told to put messages on this site? Are they new owners ? Is it the same person using 3 or 4 user names ? I like others would love to know, as all of the regular names have all introduced themselves, telling us where they are from, which block they are in, are they a family etc.  I have no objections whatsoever about any of you putting messages on the board, it just seems a bit of a coincidence that you arrive after 2 and a half years.

At the moment I think all these rumours, what if's and maybe's is just doing damage to our community. A lot of it seems to centre around the termination of the cleaners contract. The committee have already given the reasons for the termination, what more is there to say.  We have all known from day one, the biggest problem we have had is with the developer. We should be focusing our concerns on him. It is him ( and others ) that owe us a stack of money for non payment of community fees that is holding us all up with making improvements to the community.  If he reads this forum, he must be laughing his ar*e off with all of this inhouse bickering.

Dear Sir,

I have no problem in identifying, where I live, so I'm not I'm going to do in a forum, if you want to send a personal message in which you were also identified.
I have been reading this forum several months ago and I have not seen fit to write until now. It is likely that many other people are reading and start writing now, is going to say they're all the same person?.
That defense of the junta ustes makes me think you can do is a member of it and is using several names to justify their actions.
This was not thought of it until you said, you think something is because it is capable of doing so.
Stop judging people, to insult and slander. I just said that I'm worried and I want as many residents of the community that this is resolved, which clarifies the doubts that are saying that the board and focus on important issues such as unpaid. I insist on saying that the explanations of the board are his explanations and can not be true, and another neighbor said there may be other personal reasons.

Then just ask for clarification, and the neighbors will say what they have to say and to stop slandering each other.

Is it too much to ask to hear the neighbors? With the message you sent indicates the ability of the board

Do realize that out of 208 owners this forum over the last year had about fifteen contributors from phase I. Most of them posted just once or twice. Subtract the current board members and these rare posters and you end up with something like seven active posters.
EOS is no democracy and the opinion of  these few people does in no way reflect what the owners are thinking. I know this community quite well and the EOS posters don't reflect some majority feeling. There are more people reading here, but they voice their opinions by mail and some of them want this EGM. Even counting these readers EOS doesn't represent a majority within the English speaking community, let alone the Spanish who can't use this forum. Let's be glad that at least one Spanish neighbour took the trouble to post his views.

Dear All,

This forum has become more like a toxic waste dump than a community forum. It has been useful for sharing information but is, sadly, no longer performing that function. For that reason I have decided to withdraw from the forum. I will continue to carry out my duties as Vice President and can be contacted by PM or e-mail. 2 comments before I go:

Being on the committee is quite time consuming and having to spend time and energy defending ourselves leaves us little time or energy to do the work we were elected to do by and on behalf of the community.

I and the rest of the committee took on this job for no other reason than to do our best for the community. Leaving myself out I consider that we as a community are very lucky to have a group of decent able people willing to do this work. Many communities struggle to find people willing to do it. If this call for an EGM is successful it may well be that, as a community we will in future have huge difficulty finding suitable people willing to pick up this poisoned chalice.

Hi everyone,

I've been reading comments on this thread for the past week and its been a  great source of amusement. Grammar aside i understand that there are those replying here who are not English. However i applaud those who are not English for replying as i am crap at Spanish.

I believe you are all being lead into a battle of wits and this is beginning to destroy all that you have built. 

Last year i looked to Max and Davmunster for advise on what was happening in Don Juan and you both were very very helpful and cooperative. Your rapport with each other through emails was professional.  What happened?  You all need to ask yourselves; Who would stand to gain most from your division?  Who stands to gain most from the breakup of your committee?  I am sure you are all more intelligent than to allow your emotions to interfere with your judgement.

Please please wake up and smell the roses.  The committee needs your support.  You elected them.  You cannot suddenly decide to contradict them after i read posts for them to do something about the cleaning contract that you have all complained about for the last year!!  I applaud David for taking the most uncomfortable decision to dismiss the cleaner from their present contract which he, as the elected official, is entitled to do. A decision he was prompted to do by the neighbours of Don Juan.  I urge you all to stop and think before you explode into comments on this forum.  If you have comments to individuals please PM them. This forum can be read by anyone who signs up for it.

Sorry i am not a neighbour of yours but i hope to be soon.  I was informed that Don Juan is a good place full of good people.  Remember also that these apartments have been paid for by hard working people who need this area for relaxation and stress free holidays or even retirement.

My Grammar aside i wish you all well for the future.

Is is disappointing that a simple request for an EGM has turned into such a big issue of "if you're not with us you're against us", like David is making it now. I don't understand why this request feels as such a threat to the Community Board. It is not meant as a motion of distrust, nor does anybody wants to replace the current board. It is just the most effective and formal way of asking for explanations _and_ have your voice and vote heard. Disagreeing with some of the decisions taken doesn't mean that you dissaprove of the Board as a whole. There have been such occasions last year where the Board had to change their (proposed) course of action because the community had a different view and voted differently. Nobody had a problem with that.

To explain once more: the problem we have with the firing of Tonia is not primarily the termination of the contract itself, it is the way it has been done that will surely have (costly) legal consequenses and is unnecessary damaging for her personally.
 
The meeting we had last wednesday with a few of the comitte members was very useful for us to hear some explanations and let our opinion know, but there are a lot more people who want to have there vote heard and ask clarifications. Also, there were only a few board members present so they couldn't do any promises without talking with the other members. It would be very inefficient to have every neighbour with questions get a seperate meeting with the Community Board, while these issues could be much easier settled in an EGM. The meeting last wednesday took place in a very pleasant atmoshpere and I don't expect an EGM to be any different. Again, I can understand if you don't see the need for an EGM and then you can ignore the request, but I don't understand why anybody should be actively AGAINST it. What is there to lose?

Hi Mozza,

BrettD's grammar and choice of words is clearly Spanish, but what is wrong with what you call 'bad translations' . I don't know what Carol's origins are, but again what does it matter. He or she takes the trouble to write in your language and you get paranoid? That's not very welcoming.

Mozza suggests an Italian poster which I happen to know you're not :) Google says: 1 - 10 of about 522,000 Spanish pages for brettd. (0.46 seconds) so it's quite a common nick.

Let's put this aside. This forum is for all people. I'm no native English speaker, nor are some other people posting here. However they form the majority of this community.

 As agreed on the meeting with the commitee members last Wednesday they would think again about their decision to end the contract mid term (in a three month contract!) with the cleaning company. There hasn't been a formal reaction so far so I'm afraid that the plans to contract a new company will go ahead.

Based on the information from people who know more about labour laws I'm concerned that we will have to pay double for the cleaning. The very personal letter intending to end the contract mid term full of reasons which won't hold up in court  was signed nor dated so will not be accepted as a proper end of contract. And certainly not before the formal end of the current three month contract which I think is somewhere in May
 
The current company is still cleaning our premises although they received this undated letter (good for us, otherwise it would be filthy by now), but what I have seen they have received new letters threatening to involve the police etc. to stop this activity. I fear that we will end up with paying for two contracts for the same cleaning.
So I hope and trust that the committee will abstain from signing new contracts in the near future to avoid extra costs until this is sorted and hopefully discussed at an EGM as it's decided that contracts are to be dealt with in accordance with the general opinion of the home owners.
 
Personal emotions should never be an argument in handling this kind of community affairs. If people have trouble with each other they should be extra careful to avoid getting involved in ending contracts. Everything what possibly could go wrong went wrong in this particular case due to personal emotions or intentions which are not even shared by the whole committee. David should certainly not feel insulted by this thread. I don't think there is anyone accusing him of any wrong doing. 
 
I have been there and I know how difficult it can be. People accused me of favouring myself, they publically called me a liar, made vague, but even more damaging accusations, etc. It's no fun but I have always tried to respond in a polite way.

This is very funny. It is investigating the nationality of each person. And they are investigating based in the level of their English nickname jejeje. I Know that there are people in this community from many different places: Europe, America, Africa, and so therefore the level of English varies widely. And what is the problem?
It seems absurd to be paying attention to this matter, and not what is asked.
Only a rmeeting is being asked to clarify several issues that also may have implications for the community as they say in some messages. I do not understand what the problem is.
Perhaps the Board is not necessary, but the neighbors do.
The Board may think that there are neighbors who are outside from Spain and should not be mobilized, as in other meetings to come to come and those who do not then no, the Board has made decisions without anyone's opinion.
Perhaps there is a Board member who is outside from Spain, they know that this could happen when they accepted the post and if requested by the neighbors will have to come by plane.
So do not know what the real motives of the Board, Why? Why? Why?. Instead send emails, letters and advertisements on the websites Why they do not meet personally with neighbors like these are appealing. Do not spend more money on paper and say these things in a meeting.
 I also sent my mailing to vecinos_donjuan at hotmail com with my signature, and request those who are collecting signatures if they have enough requests please request a meeting and so we can finish this matter, as it appears that the Board is willing to make any meeting unless the law requires them.
In short, do not listen to the neighbors is also regrettable and unfortunate to have to apply by law.

And Sorry for my English, my academy was not very good or I was not very good student jejeje

If the main calling for the meeting is concern about the termination of the cleaning contract and the way it was handled then how about the following:

I can understand why the existing contractor is still cleaning as in their mind they have not been officially terminated so they will carry on fulfilling their contractual obligations until they are (again in their mind ) legally terminated.

The contractor presumably still wants the contract and the community still wants a contractor.  If the cleaning was not done to the required standard and the cost was too high why not give the contractor a chance to prove themselves? 

Renegotiate the contract and put them on a 3 month probationary period.  If they want the contract badly enough they will agree as they too do not want a costly law suit.

They have a contract, we have a good cleaner at the right price and everyone is happy!  For the time being.

srs, your proposal is exactly what we have asked the board to do on the meeting last wednesday, (except for the renegotiations because that was already done before the last contract was signed. Hervas then agreed to meet to lowest price that was offered by other cleaning companies).  Javier and Ana promised to discuss it with the other board members.

Hi All

Sorry for not replying quicker to some of the recent posts, but I had a problem getting into the EyeonSpain site. My anti virus software was telling me that the site had been attacked by a virus / malware, and would not let me in as it would damage my computer. It still does not work as normal, but at least I can reply now. Has anyone else had these problems.

First of all, let me just say, I in no way wish to insult or slander anyone. So hopefully that clears up the issues that Carol12, BrettD or anyone else may have.  I was simply putting forward a question that people pm'd me about. No problem with that, is there. I thought this was a forum for everyone to put their questions and opinions.

Max: At no stage have I said that EoS was a democracy. I don't care which country people are from that post here, it's irrelevant. The question that was asked, was who these new names were. It just seemed unusual to have a group of new names join our forum in such a short period. No harm in finding out who our new neighbours are.

 We are finally without cleaner. Tonia's lawyer got an official letter stating that she had to stop working now so she gave in and handed in her keys as requested. We will now face a court claim for damages and illegal breach of contract. As the 'burofax' was almost identical to the original silly letter we have a 90% chance of losing in court. Let's hope the committee will see the light now that David is here and save us all huge expenses.

I see that the Board still does not listen to the neighbors. Who will represent? Not me.
