Yes im sure its nice at El Pinet, or will be when its done. (Why did you put the we want our house at el pinet on the end of the last message? i knew that already )
I really wanted what i bought into though, and im hooked on golf, which was the reason we decided on Albatera. I dont think we could stand year on year of different phases of developments going on around us, like some places we saw are. Hope it works out for you.
We seem to have decided we want what we wanted in the first place so its a non starter to settle for anything other.
If you hear any snippets of Albatera let me know, you can never have enough information eh.

Oh Brian,
I shudder to think that you are holding out for Albatera, my husband is hooked on golf too he plays off 5 and always winning in competitions, he was devastated about Albatera. El Pinet will only have about 700 houses and around 400 are already built so there wont be much building at all, we could not put up with that either.
There are about 4 golf courses nearby though, if you have not looked at El Pinet you should give it a try it will be very exclusive.

Hi Friend
I first heard of bouncing cheques in February this year, we were told that we may be able to go to Spain and collect a cheque...we told them not to talk silly, we would only accept payment in the same way we made it, by secure transfer.

Naw..we gave up on Albatera some time ago.....despite the 'positive' talk of SJ for two years!
When we have settled down and the administrators have decided what can be done and not done, we will have to make a choice based on options..........if its not possible to get a refund we will have to look at whats available but im not one for being forced to do something against my choice.
Its not going to end up either have a house or have a deposit back in my view....too many out of contract to do that and it would be a legal nightmare.
If we end up in your area tell your husband if he is winnig stuff all the time playing off 5.......then i play off 20, just to get my own back lol.

Pragmatism is my middle name....I probably owe everyhone a bit of an appology for the amount of posting im doing at the moment....!!!
Im home alone for a short while, Mrs Briando is in Weston and is delayed returning....so i have been giving the forums probably an unhealthy amount of time just recently....ha...its better then the TV and you are an interesting bunch i have to say.
If the weather is ok tomorrow i will be back in the garden and on the golf course though...you may miss me !!!!!!!

So, as it was last year and there are funds of deposits held in a "ring fenced" account, yet banks did not honour the cheques, we can only assume that the struggle to make repayments on loans dates back to last year and it is not events of this year .
It is strange that as funds were in a "ring fenced" account, that the cheques were not honoured, unless banks were instructed accordingly.
If you issue a cheque to someone and there are sufficient funds in your account, why would the cheque not be honoured?
Perhaps the account was "ring fenced" but was used to support loans and overdrafts?
Can anyone help on this. Perhaps it was one of the questions which was asked at the meeting and we shall find the anwer to when minutes are published.

So they could not of been issued from the "ring fenced" accounts of deposits?
That is starnge when surely that is the account they would have been paid into?
Unless, as I have already said, the account was being offered as security for loans and overdrafts and could not be allowed to be reduced.

I have put that subject into my abagados hands some weeks ago....its a fundamental question and hadnt escaped me....my friend.....ta
I doubt if anyone here will be able to answer it so may be unfair to ask.....it runs the risk of stirring things up a bit.....as well.
I placed the same point in a different way when i said the administrators may find money moving back into accounts near to the administration starting and how can they be sure the account, albeit at the right level of funding, be the same money that went in as a deposit....etc etc....subsidy....etc etc

The ring fence is an accountancy description or a company budget type policy.....not something a bank does with an account.
As Far says...insufficient funds....if there is enough money in an account and its a properly made out and presented cheque the bank has to honour it......the cheque was either drawn from the wrong account..or the account has the money missing....thats the only choice to go with.

I don't dispute your description of the ring fenced account, but it is as it says, ring fenced for security and not by the bank, however, can be used as security for a loan. As anyone who had pensions with Maxwell knows unfortunately.
You rightly say that if there are sufficient funds in an account and a cheque is properly made out and presented, the bank has to honour it. Unless instructed otherwise.
Time will tell.

Were the people who got the cheques purchasing at SADM as I understand the money in the so called ring fenced account is for SADM only .There has been no mention of any money in accounts for other developments like El Pinet .I wouldn't expect there to be any money left in the deposit account for El Pinet especially if the legal bill for fighting the environmental group could be considered as associated building costs. If it was legal for SJ to use deposit money for these costs there will definitely be nout left for El Pinet a 3 year court battle the cost of that does not bear thinking about when you consider what our legal costs are for the admin actions.

I am buying at El Pinet however I also have an interest at SADM through circumstance not choice.
I have visited El Pinet many times and have stayed in all types of SJ properties faults and all .
El Pinet is a beautiful development and it is unlikely that any other development will be built again so close to the beach.
I truly believe that if ever finished it will be an exclusive development , this is one of the few sales pitches of SJ that I have ever agreed with.
There are four good golf courses within easy reach . I have visited each and can vouch for their quality.
El Pinet is already a community with many permanent residents and weekend / Holiday Spanish owners. Beach is 10 min walk ,village about 15 min walk . I have always found the village and local people welcoming and friendly even tolerating my brave attempts at the Spanish language which are trying to say the least .
There is however the huge urbanization of La Marina close by (about 6km away I think I did not like this it was the most un Spanish thing I have ever seen in Spain and it disturbed me.)
El Pinet is a little bit of paradise it is a truly wonderful place . If I can get my money back I may consider buying a resale property in the village which is what I should have done in the first place.
At risk of feeling like an SJ sales person ( God forbid ). this development is worth a look however I fail to see how anyone can be swapping to here from other developments as this site has been completely sold for years. To my understanding property swaps were only ever available if a buyer pulled out.
