A resale purchase

Hi All,
The last 3 weeks have been hectic and hard going organising things. Although it was arranged discretley at the request of the other parties I did try to drop hints that we were influencing the process. This has all been made possible by us working together and please do begin to realise SARC is a purchasers group working to help all.  Regarding questions  to ask, we did listen to what was being asked on the threads.

I would like to thank Linda and David for agreeing to come to the meetings and helping with the translation of conversations etc. Without their much valued help we would not of achieved as much as we have. Please bare with us whilst all the information is put together, as soon the report is finished it will be posted on the SARC site for all to see plus emailed to SARC members, whose email address's we have on the data base.

I will not preempt the report but concur with Linda in saying that everyone was very positive and we were made very welcome but maintained our independance.  I hope that when the report is published you will realise that we have ensured that Linda is happy with the factual content.

I have absolutely no axe to grind with you and as I have stated I am extremely glad you were there  . My comments are in no way directed at you but  at others who in my opinion are being underhanded . I knew these meetings had taken place before you posted and at no time thought ill of you wish I could say the same of others.

The sooner the Judge ,lawyers and all other creditors /banks etc are made aware of these meetings the better. Of course they  too have had meetings  with administrators etc but always with the judge present or at  the very least with his knowledge

           Sorry to be a bore but JA you clearly show that you have no Idea about the VA process which is a shame as I did upload it onto this forum and our website but when you are to busy rubbishing the grammer and such, you have missed a vital bit of information. There was nothing illegal in the meeting but sometimes discrestion is required and as the Mayor was holding the meeting we accepted his request. He also stated that after the meeting we would be allowed to inform everyone as to the outcome at the meeting and its content. please do read the role of the administrators it is not a hatchet mans job they are there to try and keep the company afloat and solvent if possible.

Thats exactly right but I dont give a damn about the solvency of a company who have told  me  nothing but lies for the last 5yrs and are still now trying to string people along and just to top it all off as I have said before you are foolish enough to help them Only time will tell but I know what I know. You will not get the outcome you want.The judge will decide.

I appreciate you feeding into us but can you honestly trust all that you have been told? Lets face it you have had lunch with a group of people (albeit important people) whose job/ personal circumstances absolutely depend on owners not requesting their money back. They have had discussions with you "off the record" which can only be described as conversation not fact. the only fact will be what is discussed in the court. the remainder will be full of spin and deceit as their record has showed.

Brian you said it yourself; the administrators sole job is to keep herrada del tollo afloat. they are therefore not going to be anything other than positive with you as to be anything other with severely diminish their chances. they want you to believe that it may go ahead as this is the only thing which will allow the slim possibility of re-financing.

But believe me if the company does go into liquidation (which I believe it still will as do 90% of Spanish businesses that go into administration) then they will not meet with you then..I promise you.

The only hope for everyone I believe is that the judge appointed to this case is not corrupt or easily bullied.

This is not a criticism of yourselves at all but a dig at the lengths the developers will go to to manipulate and con. Full marks to you guys and I look forward to reading your report.

Hi Julie-Anne, as you already have a copy of the notes taken at this meeting and know whats going to happen,  could you post a quick synopsis while we wait for Linda's/Tonys/Brians notes please.  That way  no one would be going to bed this evening without some bullet points of what was raised and answered if you would be so kind....then we can compare both sets?

Hi Guys lets get this cleared up Tony and I stayed 20-30 mins just to be polite as I am sure anyone with manners would have done. And as for being gullable. I was definatley Impressed with the town council members and we did not go blindly but went to find things out. I was at all times on my gaurd and fell a bit better knowing certain things that Linda and Dave explained to us after the meeting. Anyway I also await lida's report with anticipation.

I have thought long and hard as to should I reply to your last posting as I do not want this topic to go down the same route that took place when the first posting of the IWMH started, saying that I feel that I cannot let some of your comments pass. I stated that there was no disrespect to either you or any other forum member this is not nor should it be about personalities or egos and I speak from the heart when I say this.

 I made no assumptions and only responded to the comments you made, nor did I think that I was being aggressive. Like all forums when you post you must take the good with the bad and realise that everyonehas views or opinions and mine were not being represented at what was a very important meeting. You state that it was a fact finding mission but the fact is that only those that wanted the same thing of pursuing the chance to purchase at Jumilla were at this fact finding exercise.

You went in search of the truth if it could be found but truth is subjective your truth is that there was a feeling of optimism and positiveness from all concerned around the tables but that is because they all want the same thing the build to proceed!. My truth is somewhat different  I want my money back but was given no voice at the table, you speak of finding factual information that  needs to be somewhere it can be seen in its pure state but facts can be manipulated to suit by those that have vested interests.

I understand that reasons you were invited and pleased that you were on hand to help with the translation etc. You are right Tony and Brian are to be applauded for their initiative but I question the wisdom of their actions. To arrange this meeting is the equalivent of arranging a  forum G8 summit no mean feat and I salute them its  taken me 3 days just trying to get a certificate from my bank. Would the IWMMB have had the same success somehow I doubt it SJ would not honour their own contracts and we were told see you in court.

We have now been told  that the administrators do not want the special fund to be used in returning the deposits to their rightful owners US! but to be added to the general pot and for the build to proceed. The meeting has now passed and we still do not even have an outline of what was said at this meeting.

I stand by my previous posting the fact that you were sitting down having lunch with SJ who In my own experience are dishonest and dishonourable fills me with dread, I question their motives and wonder why the are being so helpful in wanting us to be made creditor's.

The time is fast approaching when we will all have to make decisions we can not both be be winners, nor will we be able to sit on the fence, if the IWMH get their wishes I may be forced kicking and screaming along the same route so the divide and conquer SJ is the biggest winner of all.

Good post Arlene with many of my sentiments in there.

Can i also say the postings have been put back into the arena of 'the administrators purpose is to keep herrada afloat'.

This is wrong, the Administrators job is to represent creditors, this is people in all stages of build or non build.  If administrators are discussing 'positives' with creditors, in one direction or one ambition.....this is in breach of the process......read it and you will find out.....ask your solicitors and you will find out, its not a secret.

One of the reasons i wanted to have these visitors ask questions is that i wanted to be represented and find out facts.  The facts i want wouild have been in conflict with the parties having the discussion, so i wasnt represented.........

I look forward to a report but sadly it seems that my anticipation is now low, because it looks like it may be 'the truth, the whole truth and nothing but the truth' with a lot left out.

 Hi again....for instance i have placed this e mail in the arena of all SARC subscribers, just before Tony and Brian went to Spain and had the meeting.  They are both aware i have a major concern in the area of the text from the e mail listed below.  This was sent to them on Saturday 5th July, which is very close to the meeting.

The comments of Tony and Brian that they represented all creditors at this meeting......To Linda, keeper of notes and the truthfull representative i simply ask..............did this subject get raised, was a question answered?

I think a concern as important as this should have been brought up......dont you?  If it wasnt brought up the implications could be that SARC is not concerned if the build is being subsidised by other sites and SARC is not concerned of other creditors outside their own desired outcome.    These in other words could be the bits left out.....big bits eh?

Given that you didnt stay too long it seems to be taking a long time to write the truth as you see it. I find it highly inappropriate that  you would not share at least some of this information with people who have their life savings tied up in this. Even if it purely bullet points.

It would have been better for you to say nothing at all as the impression you give many is not positive

Apologies if you do not like this but if you have anything of worth to say then I think you should have the decency to tell people

I know that there is written proof of the separate account received from the court. My lawyer has seen it and has said they will send me a copy.

This is the post regarding the proof. Briando55: I'm a solicitor, and I've appeared in the Public Intervention before the Court. Specially, about the special account, we've required the Court to block it, and the Judge asked the bank to say what disposals have been made in the account, and that's the answer from the bank. They've disposed circa 39.000 €. Best regards.

For information Lucas and Antonio are working together on this case. Anna has just posted confirmation that Antonio and Emilio have both seen writte proof and Antonio will send it to Anna to upload on her site

Anna has also posted that the administrators and director of herrada del tollo are meeting with emilio on tuesday. I believe that this will be the truth, whole truth and nothing but the truth. It will be very interesting to see how this account differs from that of Tony Brian and Linda ( and this is not meant to be in any ay a dig at them) I am discussing purely the different tact that may be taken.

No doubt your notes will be done by tuesday so we can compare?

Hi All,
You moan, you whinge, you sit and go on and on moaning.  There is nothing that would satisfy some of you and to be honest I am not even going to try.  SARC has complied to its mission statement and aims and objectives establishing dialogue with organisations. What are we all supposed to do, sit around listening to rumours and do nothing?

Well i am afraid that there are a lot of us who really do not think that is good enough and we are prepared to do something about it. Did we have to include Linda? No!  Do we have to share our findings? No! But despite your insesent whining we are going to share it with you, and why? Because that is what you do when you work together!

Those of you who do not like it and are unhappy, well you donot  have to read the report and you can carry on howling at the moon for all i care.

And the majority of you I hope that as soon as we have the report finished I really hope it is of help to you. Me I am knackerd, i had the flu last weekend, i take 2 days non paid leave, spend money and dash about Murcia with Brian and arrange Linda and David, who you all know and respect to be there. That all took a massive effort.

Lincoln the truth is there is nothing much to say .It is just the same old same old SJ rubbish we have been hearing for years.the only thing I am waiting for with baited breath is to see the way the notes are interpreted once again as good news by Tony and Brian to make people believe all is going to be well.The mayor said all is well with the licensing .SJ are confident of refinancing and want people to wait just a liitle longer,SJ have acted in good faith and want people to have their houses. Water in Spain is no problem,The Spanish people welcome such a huge development to improve their communities and commerce,The concurso was to protect all. Sj can not be held responsible for the legal holdups,or the current economic crisis  yada yada yada

Tony sorry to be a pain but I think the reason you have got criticsim is because you havent worked together you have worked fo yourselves and happen to be sharing things with us at some point in the future when we get to read it

Tony and Brian would it not be best to just post on the SARC site instead of ramming this down eveyones throats .People know where your information is if they want it.You keep going on about your massive  self  sacrafises others are doing things too .Perhaps they dont want to be thanked and praised for it  all the time and dont even tell you what they are doing cause it may not suit the outcome you want. JA

Just What have you done JA and as for Lindas report I personally thank them both for their presence you seem to think that having a pop at us will depress us it is just the other way If their is a chance then I will take that chance and if not then take the money but I want my house if at all possible.
