re El Pinet court action
Sorry I missed your post . Yes SJ are now suing the AHSA for costs as SJ won the case . However I think it is futile as they are a charitable / voluntary organisation who have lawyers amongst there ranks and who give their legal expertise and time for free.
So whats to be gained from this action by SJ . The only thing I can think of is if SJ were awarded court costs it would not matter that AHSA did not have the funds as SJ would not be liable for costs as said action was in their favour. Thus perhaps saving SJ from 1000s in court fees .Which would not be a bad thing for any of us.

The following message was on an albatera thread today......does anyone have any information they can share to help with this at all?
Just a quick line to find out if anyone purchased through Pauline at Regency Homes. We have tried to contact her to no avail. We would like to know what course of action other Regency clients are taking, are you sticking with the lawyer that was reccomended by Pauline (there should be a few?) We were told that her clients were given a FREE bank guarantee by San Jose! Any imformation would be appreciated at this time.
Pauline, if you are on this website, then we would appreciate a call just to answer a few questions and try to set our minds at rest

Are we to assume that you are currently holding a board meeting with your committee members to change your terms of reference and objectives. You obviously have chosen to share this report with members of your gang rather than anyone else which means that you have broken the terms of your own organisation.
so lets get this right you have gone to meet people without letting anyone know and then only telling certain people. You are really acting in the interests of others. I would have expected better from managers of the NHS (whose whole function is to help people..regardless of criticsm)

I have just spoken with Anna. She tells me that Emilio is meeting with the administrators and director of san jose NOW and also speaking with the judge. There shold be an update on her site tomorrow morning. I imagine this will be the truth the whole truth and othing but the truth. (and that will be posted) www.santaanadelmonte.net

Hi Almred,
You are very sad if you think that purchasers do not have the capacity to organise themselves and work for what they believe is the best out come. I am like the rest in SARC a purchaser and I know that if I jump out of the frying pan into the fire that I will not only spend along time paying for a legal process that will be lengthy and only get some of my money back. Could you explain how going to court to get my money back is a better option and how I would benifit from it, how long it would take, where we come in the line for payment and how much of our deposit would we get back if HDT fails?

Lincoln you will find there are alot of people who would like their house who dont bother to post. We are split in our household and we were buying 2 properties, at the end of the day if we are offered a1 of our properties with compensation ie free this free that we will then look at it all again, what tony and co have done is tried which is more then most of us have done. We will make our final decission after the judge makes his decission like every oneelse will, because if he says you can only have your property and nothingelse what will you do? take him to court and fight for a cple of years. Why doesnt everyone stop bickering coz no none knows what is going to happen. All that is being said is irrelavant coz noone knows. We are losing alot of nice sensible people on this forum because a stupid few. Now go on and shoot me you lot. BUT I DONT CARE AS I WANT MY HOUSE OR MY MONEY PLEASE.

I like the rest of SARC members would like my house if posible, a swop if not and then lastly money. So we have a choice and you give yourself none.
I wish you well and hope that finally we can all just try to respect one and others view point.
I want my House.....as I truly believe that is the quickest and most likely financially benificial result compared to court.

I have read the report and thank you for sharing it with us. It was very well written but I believe full of san jose spin. San Jose do not have any licences for a golf course or commercial centre with shops so their timelines are absurd. They cannot guarantee any of these things to buyers as they do not have correct permissions for this to happen.
Also I would query what you mean when you say the administrators know where our money is invested. This would imply that you were told it was not in a separate account but spent on some sort of asset? more spin maybe
I do not believe the project to be viable now (without anyone withdrawing - let alone half the families) If it was then they would have financing and not be in this position. It is because it is not viable that they cannot get credit. I do not believe that they have 80 families lined up for purchases. Think about it...if these claims were true then they should be able to offer us our money back but they will not. This is because there is no way the project can continue with even a small number of people withdrawing and probably not anyway.
In so far as communication. They have had this site and they have had Annas. They have lied for the last year at least and to say they could have improved on communication is a bit of an understatement. No doubt Anna and no doubt Justin have tried repeatedly to get news and updates. A leopard does not change its spots and they have consistently refused to inform and have actually lied on numerous occassions.
This report does not fill me with any optimism just makes me feel sorry for the people who still fall fo san jose spin.
I really do feel sorry for you for believing this crap and bull**** (sorry about the language) I just cant believe people still fall for it. Anyway it is your money and your choice and you need all the luck you can get

You are living in a dream world if you think you are guaranteed either/ or. There is a very real possibility that you will get offered neither - especially if you do not actively have a lawyer capaigning with the judge on your behalf. 90% of all of these processes in Spain end in liquidation. That is a very high statistic. There are a lot of people who would like their house - probably most of us but most of us live in the real world.
Most people dont come onto this site for factual information anymore. They come on for entertainment value listening to the latest.
Malc I respect your right to want both options or either but surely you must have read this report and felt, objectively, that its full of the same old bull. I am merely having my point of view as you are having yours.

Hi, thanks for the report
Couple of quick questions that spring to mind from the report, which i know people have been asking about.....concerning movement of deposit and changing phases.
You put down in point.....K that moving deposit to another plot is possible, based on individual circumstances. Before you went out it was a common question. So what is the explanation on this point, its surely not an answer you need to travel all that way to get is it Tony/Brian......? Come on you two.....what did you find out, people want to know.
Its also stated that its possible to move to an earlier phase because there will be cancellations.......so the cancellations on plots, these are plots with deposits on them....which must mean there will be payouts, otherwise the re-locations to cancelled plots will have 2 deposits on them??? hows that work?
Come on chaps your managers in an important industry, you need to ask searching questions.....if you look at my humerous though a little cynical posting from earlier today.....which i will paste after this......i wasnt far wrong, and i really wanted to be wrong.
I dont think there will be anything new in the notes, i have stopped looking for them now...at a rough guess i would say the main points will be.
Good news....the licences to build are available at the town hall when the funds are paid.
Good news,,,,the administrators have said that given adequate financing the builders can carry on building
Good news....the builder can build the infrastructure to the development if there are enough buyers interested
Good news....there is enough irrigation to support a golf course
Good news....the sun'l come out tommoraa
Bad news.......there is no bad news....repeat...no bad news...there is no need to ask or think about selling houses at this time, re-sales value figures are for wimps, there is no problem getting mortgages, there is no problem with letting out your property because everyone still wants a holiday in Spain, The builder has done everything they can to protect us and our money, they will be completely exonerated and all your money will have been safe all the time, they only bounced cheques for your own good, the Spanish building industry is really well organised,,,,,,,lassie will come home, glen miller will turn up and we will all live happily ever after.
Thats my prediction....

Hello Everyone,
What exactly is the problem here? I am trying to work out why some of you are giving Tony such a hard time, is it some kind of power struggle? Why is it such a big issue that things were done in secret? If this was the only way Tony and his team could be present at such an important meeting then why can some of you not accept that and be thankful for his help.
I am in complete agreement with him, pursuing the money back is a long tedious process, expensive with no guarantee of a successful outcome except for the lawyers of course (they are on the pigs back)
I know of people who have endured this process, won their case only to be told that San Jose are appealing against it resulting in another long process.
Now you may be wondering how can San Jose appeal, well it does not make sense to me but seemingly they can and all the time some of these lawyers are saying luvly jubbly bring it on and are laughing all the way to the bank!!
I for one are not going to cut of my nose to spite my face, i want my house preferably at El Pinet and for me this is the only way to go, for those of you pursuing the money back then you are in for a long and expensive haul.
The people i know who have been pursuing the money back for a long time now, if they ever do get it i will make sure and post it here, meanwhile their lawyers are saying "More money Please"

I've not given Tony a hard time, and infact asked people to lay off in a previous post, just adding some realism to his report. With that report I would have expected san jose to pay for the flights to be honest. This gives you no more information than you could get from a ten minute phone conversation with Pilar as is about as factual. although in terms of the way it was written this was very clear and concise.
I have got no problem with Tony and clan and their desire for a house. I just want to add my view that this adds no further prospect of that goal to anyone. No competition just a balancing of the argument
Far, to make your point downplays the legal right of people to get their money back and presents the legal action as a very long process. The later is not true at all. You mention expensive. 3% is not expensive and if successful there would be no fee at all. Most people trying to pursue money do so without an administration process as a framework. We have one. This actually makes our job potentially much easier in terms of reclaiming money
You are suggesting that people should except crap beause there is no other choice and that is misrepresentative

im not on santa anna and not even in HdT but i have been keeping options open and looking closely at how things pan out and what kind of business is being run by San Jose.
Im not impressed anymore, they couldnt deliver when times were good and i m really not convinced when times are bad either. I thought a trip to Spain with a meeting arranged in the centre of the main people could have been a chance to be challenging and rewarding, put some heavy questions to them, be tough. I thought Brian and Tony would have been like tigers and got to the heart of some issues.
I think i am at the mercy of the lawyers or the builders......devil and the deep blue

I notice that Martinsa Fadesa has gone into voluntary administration today (huge spanish construction company). If this goes into liquidation - which it will as it cannot secure financing it will be of the biggest corporate failiures in Spanish history.
There are far bigger organisations than san jose hitting the wall and in the scheme of things san jose will be a small loss in the complete crash of housing and construction service in spain.
The future is dire..please ensure you have lawyer who is actively campaigning the return of your money. To not do this is extremely risky
