Hi Redman I have also been badgering my MEPs MPs amd MSPs relentlessly over the last year. I even have my MEP writing to the bank who issued my BG ,every little helps .I would like to see the funding which the EU  threatened to remove from Spain as  a result of the Aukin  ? ( Spelling )  enquiry being removed in reality not  just  a threat . Spain is one of the most subsidised states in the EU .

Only last week I read that Spain gave millions in aid to a third world country  .Nice gesture  but who's money was it ,mine yours and all the others who have been robbed by the Spanish system  .Who knows ???????? 

Every one no matter what property abuse they have suffered ,no matter what the circumstances or situation is  ,should sign on to Suzanne's petition. The numbers and vast amounts of money  involved in this is being  grossly under estimated by the powers that be .If nothing else the true extent and costs of all property abuses in Spain should be in the public and political domain .What have you got to loose stand up and be counted Best regards  .MM

Developer's clients face eviction

"WHY has the building company San José the right to send us a letter asking us to leave the apartment?" asks Graham Leadley.

"The company has our money and we don't have the home we paid for five years ago.

"We feel like we are being thrown out on the street."

Nearly 20 expats living in an apartment block owned by Grupo San José in Orihuela Costa received a letter from the builder asking them to pack up and leave on New Year's Eve.

They had all purchased off-plan properties from San José three to five years ago in three different developments - Santa Ana del Monte in Jumilla, El Pinet in Elche and Albatera golf resort.

The building works of Santa Ana and Albatera golf resort have not been even started - and work in El Pinet stopped several years ago.

"As compensation for the delay San José offered us the opportunity to live in one of their apartments in Orihuela Costa," Mr Leadley explained.

"We were only supposed to live there for about two months."

However two years have gone by and the buyers have paid up to 100,000 euros - 50% of the total price of their homes.

Although some of them had bank guarantees, they have not had their money refunded because they decided to wait for their dream homes.

Now the builder has declared voluntary suspension of payments.

David Butler told CBNews: "We trusted the builder and their reps at the show houses at Santa Ana Del Monte, when they told us all licenses were in place and that the build would go ahead.

"When our original completion date had passed we accepted the builders' explanation and accepted his offer of compensation of an apartment rent free at La Zenia.

"We believed them enough to sell our business, our house and sever our ties in the UK and move lock stock and barrel to our chosen new country of Spain, even though less than a month later they went into voluntary administration."

Following their solicitor's advice, the expat buyers are refusing to leave the apartments as some of them have nowhere to go.

According to the terms of one of their contracts they are allowed to stay until December 31 - or until the properties are finished.

However a spokeswoman for Grupo San José said the decision had been approved by the company administrators.

"We cannot make any decision because we are in voluntary suspension of payments," she said.

The expats buyers say they are ready to fight for their rights.

They have joined the list of creditors and some of them will contact their local MEP.

Mr Butler said: "This abuse must be highlighted in the European Parliament.

"We want to make people aware."

Mr Leadley and his wife want their money refunded to buy another property in La Zenia.

Update relating to the current situation of the developer Herrada del Tollo S.L. and the

insolvency arrangement no. 275/2008 R.

Further to our last update, we now take this opportunity to provide you with some information

on the last developments at the insolvency procedure.

The Judge has started to deal with some of the petitions and although we have only received

a few rulings it is quite clear that he is adopting a general approach to this matter and

considering all purchasers as ordinary creditors.

He is also recognising your right to terminate the agreement and receive a refund plus

interest. The right to a refund of the deposit paid has been classed as an ordinary credit. On

the other hand, the right to perceive interest has been classed as a subordinated credit,

which places it at the bottom of the rank of credits.

As you are probably aware, the developer Herrada del Tollo SL filed for insolvency on the

19th May 2008. This date is quite important to understand the foundations behind the

Judge's rulings. The Judge has divided the claims between those claims where the property

was supposed to be completed before the 19th May 2008 and those where it was supposed

to take place after the 19th May 2008.

According to the few rulings that we have seen so far those purchasers who were supposed

to complete before 19th May 2008 will be considered ordinary creditors because the breach

of the contract took place before the date in which the developer filed for insolvency, which

as you know was the 19th May 2008.

Does the above mean that those who were supposed to complete after the 19th May 2008

will have to be classed as privileged creditors? Unfortunately not, as it appears that the

Judge has also considered those purchasers as ordinary creditors. His reasoning is that

although the breach of contract took place after the 19th May 2008 it was still quite clear that

the properties were never going to be delivered on time and therefore it can be deemed that

the breach also took place before the 19th May 2008.

As previously mentioned, the above is a topic that has divided the legal doctrine. Some

believe that purchasers should be classed as privileged creditors (or, using the right word in

Spanish, credits against the mass) and others believe that they should be classed as

ordinary. It appears that the Judge in our case believes that the latter should be applicable.

Lucas & Asociados have their own reservations about the Judge's decision and have

suggested protesting the decision. The protest will be raised before the Spanish Court of

Appeal (Audiencia Provincial) who will look into the case and may change the Judge's

decision or confirm it. Lucas & Asociados will proceed to protest the rulings as soon as they

are received and this will be done on an individual basis.

In the meantime, the Judge will continue to issue rulings for each petition. He is dealing with

more than 700 petitions and therefore it is quite likely that he will be dealing with these for

what is left of July and probably whole of September. As you probably recall from previous

updates, the Spanish Courts will close in August.

Once all the petitions have been resolved, it will be the turn for the administrators to issue

the final report which will be followed by a decision on whether the company is viable to

continue its business or go into liquidation. At the same time, the protests will be dealt by the

Audiencia Provincial. This could easily take from 6 months to a year but will probably not

affect the procedure as it is quite likely that the current procedure, whether the company

continues to trade or end up in liquidation, will continue to move at a very slow pace.

On a different note, we are currently in negotiations with the banks and companies that have

issued the bank guarantees. A few bank guarantees have been paid so far and it is quite

likely that the majority will be paid shortly although the guarantors are proving quite slow and

examining every case on an individual basis. If you have a bank guarantee you should hear

from us shortly with an indication on likely timescales.

Those with no bank guarantees will have to wait until we get more news from the Court and

the administrators. If the protest does not succeed, you will be classed as an ordinary

creditor which means that you will be entitled to get a refund of your deposits plus interest.

The repayment of the credits will be done in accordance to the proposal issued by the

administrators, which in some cases could imply a reduction in the amounts to be received

or a delay in the payment. In some cases, it could also imply both.

It is too early to know how the credits will be repaid because the Judge still has to deal with

all the petitions and once this has been done, the administrators will have to issue their

opinion on the viability of the company as well as repayment plan.

On a different note, I will be on holiday from the 27th July until the 5th August. As explained

before, nothing relevant will happen probably until September. Lucas & Asociados will keep

receiving rulings in respect of the petitions filed and will then proceed to protest them on an

individual basis.

I  understand your frustration and angst but I hope that you can see that  SARC is working on behalf of those who wish to have their property built and those, who for what ever reason, want their money back.

I personally want my house but i still support your right to make your own decision & ask for your money back.

Just had a reply to an e-mail

Dear Mr. Blagden,

   With regards to Herrada del Tollo we keep on working in order to
carry out the project in Santa Ana del Monte (Jumilla Golf) and that way
let you know as soon  as possible about its continuity and time scales.
In the next few months, it is expected that the outstanding motions will
be sorted as well as the completion of the final report by the
Administrators, such report is estimated to be issued before the end of
the current year. In the meantime, the company in working with the aim
of putting forward an agreement that suits best the creditors either to
purchase a property or to get a refund in a reasonable period of time.

As soon as we have the different proposals we´ll contact all of our
clients to let them know so that they can make the right decision.

Hi Blaggy (and all)

I don't think there is any real news to share.  As I understand it, the judge is still going through all the individual cases (a long and very sloooooow process).  Once this is done, then the administrators can make their final report as to how to go forward.  In all reality, there is little chance, in my opinion, of them coming up with a solution that would be acceptable.  Therefore they will then start the bankruptcy procedures.

Some see the dispersal of HdT assets as a good thing, as they will then have money to pay us back.  Great in theory, only I don't see that money being safely ringfenced for us and other creditors (our deposits were supposed to be ring fenced also, but that's another story!). 

Interesting that you got a response from HdT - although I have not tried contacting them direct since this debarcle started.

sorry to sound negative, but this is the reality as I see it.  I am sure there will be posters that disagree!

I am really sorry for everyone concerned including myself ,but this should tell you all you need to know .Crooks crooks crooks ,are they concerned with the developments that they have started ,sold on and left unfinished or do they want to ditch us in the abyss of their farcical  administration process and move on ??????

No tee off for Dolores Golf

ADMINISTRATORS supervising cash-strapped builder San José Inversiones and the judge of Alicante’s mercantile court have prevented the company presenting a 4.5-million-euro deposit to start work on the Dolores Golf scheme.

The company went into administration in May 2008 and all major decisions must be approved by the court administrators.

San José owns most of the land at the site and was awarded with the tender to build the infrastructure for 2,600 homes and an 18-hole golf course before going into administration.

However the town hall will not now allow them to start the infrastructure work as they cannot pay the compulsory deposit which is approximately 7% of the whole investment.

An estimated 5,000 people were to live on Dolores Golf resort, although the town has a population of 7,300.

According to Sra Rodríguez the sales campaign of the scheme had not been launched when going into administration and no properties in Dolores Golf had been sold.

This attempt by San Jose to resurect another assult on more unsuspecting innocent people in Dolores has been scuppered.  This I believe was to be funded by German investors.  I think the company was EuroVillas.

I wonder if this is the same German investers that Almudena had told Tony were coming to save us?  

Although I suppose it could have been seen as a chance for us to sue the company once they start trading again, and hope for the thousand of investors from Molins, but the judge and the local council saw through them for once.

The only news I've had recently was that the administration were now allowing SJ to sell properties as well as land.  And that their dept is up around 130 million euros as against the initial 73 million they first stated.  So not good news.

We need to continue let everyone know that we haven't gone away and nor are we going away.

Hi

If your lawyer has been to court with regards to your property in Jumilla then your contract with the builder will have already been cancelled.  The Judge will have ruled this in your favour and your deposit, costs and legal interests should have been awarded to you.  What you should be making sure of is that your lawyer is still fighting to have your credit made 'preferential'.
