AS YOU CAN SEE YOU HAVE THE OPPERTUNITY TO MOVE TO ANOTHER PROPERTY. WHEN I SAID I WANT MY DEPOSIT BACK , THEN THE CONVERSATION CHANGED AND I WAS LITERALY FOBBED OFF THEY COULD NOT GET RID OF ME QUICK ENOUGH. ALL THEY SAY WHAT THE COURT HAS RULED DEPOSIT BACK 60% 5 YEARS TIME CANT WAIT !!!!!!!!!!!!!!!!!!!!!

The trouble is there may be organisations and systems that keep the company going long enough to hide the assets they have. Then take what ever money is left out there from decent folk, and then go bust. 5 years should be long enough eh.

Have not been on the forum for a couple of years but kept on looking now & again.

Just thought would let you know what i received today from courts via my solicitors

A contract to be signed for repayment of my deposit (or i should say 65% of it)Main point being nothing for first 3 years,repeat nothing for first 3 years,10% in year 4 and remainder in year 5.

What a load of Sxxt,whoever voted for the proposal put forward by HDT should have their head examined,SIgn these contracts and HDT can go into bankruptcy anytime they want in the next 3 years and we get nothing.

We have all had contracts before. Do these come with a bank guarantee? And. Next time they go bust we can all pay the lawyers to represent us again, and have another campaign of people saying. I still want my house. It's completely barmy

The answer is absolutely clear to me .Get a good lawyer  !!!!!

Martin de  la herran  will give you the truth the whole truth & nothing but the truth.

I know !!!!

He got me my whole deposit  back plus 6 % interest plus the whole court costs  & it only cost me 2K, money well spent  !!!

Hi JA, thanks for your advice and I am happy ypi had a good result.

To balance off your comments, I have the same lawyer that you do, or did, We have paid a similar amount that you have.

Before your recommendation is taken up by anyone in the market for a new lawyer, please have the following information to make your deciosion more balanced.

I feel that not having a bank guarantee when we should have had one is against the law in Spain.  I feel the builder is culpable for not providing one when we gave over our deposits.

I also feel the Builder should have been made to answer to that point in the administration process, and that the lawyer should have made a point of taking this up in the strongest regard. 

I wrote to my solicitor to ask for information on this point a few weeks ago and I had a reply that he would look into it and send me a reply, I still await a reply.

I am dissapointed that the lawyers have not gone to town on the builder with regard to missing bank guarantees.  My view is that this was against the law, and my lawyer was paid to challenge any broken law by the builder.

There are no shining stars in the sky in this awful mess, only facts and litigation.  The lawyers should be good at it, its what they are paid for.  Dont choose your lawyer on the basis of that last post, look very very carefully and choose with caution.

Hi All,

Is it not a shame that a few people and particularly those who are not purchasers or creditors of SADM/HdT feel the need to carry on making snide and daft remarks.  As for Maria's blog,  the final water licence has been presented to the court for the new phase 1 at SADM but arrived late and the court are going to have to review it in January.

There you go. Thunderbirds are go straight away. I Thought there would be a simple explanation to it. It's not that it was an important document after all this time eh. Start as they mean to go on, professional as ever.

A few things you should know, I brought into SADM September 2004, i consider therefore i have the right to post.

In my opinion you have acted as an agent for SADM/HDT ever since the formation of SARC, so much so SARC's moves have been quite transparent :-

Campaign for a yes vote

Campaign to dissuade investors not to take legal action against SADM/HDT

In fact you have made the case for SADM/HDT every step of the way .

I have a place in Spain not far from Pinet, should you ever need to stay in Spain because you are about to sign your contract at SADM you are welcome to use my casa free of charge (i do not expect this offer to be taken up, you will have a place supplied by others i expect.

Hey Blaggy thanks for posting this news .However not a great translation for those who do not speak Spanish.Can we post a better translation ? I will have a look and see what I can do .

One of the problems on here is that every time anyone  posts an article so much is lost in translation . People get the gist but not the facts.  I believe  you  are fluent in  Spanish  but others need a better translation. to get to the facts of the matter .Perhaps rather than using an on line translators those of us who speak Spanish could translate a paragraph each ,that way it may make more sense especially the court/legal jargon.Perhaps Sue could help as her Spanish is now really good .  Just my thoughts as it irritates me when so much is lost in translation .Cheers JA

My question is Why did it arrive late ? Does Almu not understand the seriousness of this situation  peoples life savings and  future's depend on this .If I remember correctly many things tend not to be in on time .I fear she is leading you a merry dance .Excuses excuses time and time again !!!!!!!

Thank you for suggesting that I could help with the translation, however my Spanish is not "really good".  My level before we moved here was very basic.  As a matter of courtesy, I always try and learn enough words to get by when I go to a foreign country, so I did know some Spanish words and phrases but not a lot.  My understanding was not helped by the fact that when I was at school I learnt French.  After moving here we started going to Spanish classes, which has improved my Spanish to the level of basic rather than very basic - and of course being over 60 hasn't helped me remember all the words we learn, as my short term memory isn't as good as it was! 

Seriously, I am all too aware of the problems caused by somebody who doesn't have a good grasp of a language trying to explain something complicated to other people.  We see it on forums where some native English speakers don't express themselves clearly to other native English speakers and cause confusion!  I am not qualifed to translate legal jargon in particular.  Yes, I believe I understand much of what has been written, but is my understanding correct?  I would prefer it to leave it to people like yourself who are fluent in Spanish.

I have been down with a very nasty chect infection after going down with the flu, which I had whilst making my last posts.

As for Ja's postings I am afraid I am no longer going to respond to them ,as I view them as purely spitefull mischief making from some one who is not in the same boat as the rest of us.

How I see it is that there are many who only wnat to read and believe one side of the story. JA gives the other side and get slated for it.
Why.
Perhaps if you had someone like JA commenting when you were about to purchase, you would have thought twice and not be in the mess some find they are.
