Sue , if only it were just the few !!!!!! I do not dispute that decent Spanish people are suffering as well but the Spanish property and judicial system along with Spanish politics , local , regional and national is rotten to the core .
Sorry it is sad but true !!! Spain needs to wake up or forget about attracting tourists or foreign investment ever again . MM

Blaggy,
We have heard absolutely nothing. We have had no response from our Solicitor for months. I thought we were all supposed to receiving an email/letter about voting, we have received nothing. Feel like we have been left in the lurch and don't really know what to do next. HELP!!
What has happened to Tony and Brian? Have they been abducted by Aliens from the planet HDT?

The latest information I have is that the Proposed Agreement is still with the judge. That was about a week ago.

The date for the 'draft' proposal is supposed to be the 6th March, but the final decision has to be made in May sometime, so you will have till then to place your vote, and remember you will be sending your vote to your legal rep, not the courts.
You will only get to vote if they offer less than 80% of what they owe you.
So don't panic as there is nothing to vote on yet.

Redman do you mean if they offer us more like what we are owed we wont be voting? would this mean they will be carrying on or will the judge be telling them what to do? Is this so if they are offering a lesser than 80% then some will be unhappy and then could force them into liquidation? This offer coming out has to be that def. then so we know where we are going.

Whatever their proposal is, they have to convince the judge that it is achievable, they can't just offer something they are unlikely to fulfill. (Although this has never stopped them before).
My guess is still that they will offer the minimum of 50% to be paid over the next 5 years in the hope they can get a stay of execution.
My question would be are people willing to wait another 5 years only to find out they still can't pay up.

Come on now you all know what will happen they will pay the 50% then go into Liquidation and start trading under another name it happens all the time they are just stalling the date is 6th march to be returned by 6th May which will be 2 yrs from the startof Administration

We dont have anything to loose we have already lost it. There is no choice as far as I can see. One has too wait 3, 4 or 5 years unless one has a BG. There are no choices. If you push the company into liquidation then ok those with a BG will be paid out as there will be nothing the Bank or Insurance company can hold the money back for (legally). It really is that simple for many of us, unless one wants to throw a load more money at legal processes that are very hit and miss, that will take approx. 5 years, after appeals and getting the money if you win is another story all together. Somebody give me an alternative please that does not cost me any more money (which I dont have). Up front and straight from the hip.

Can I clarify something Linda and Auntie Linda?
previous to todays posts,I had understood that the theoritical 50% would be paid over say 5 years and that is all. From reading both your posts today, I am reading we could be offered 50% back now and then the remaining 50% over 5 years
(I know this is all theoretical, but the offer is very different)
Can someone clarify

Reading the previous posts it would seem that some people never learn .Where is the money going to come from to pay back 50% now or in five years .Can we really believe SJ are just going to hand this over or as past experience tells us will they squirm out of paying anything .Ask the owners at El Pinet what they think ?
Linda don't know where you get the idea that those with BGs need the company pushed in to liquidation to be paid out .Many have been paid out on BGs including myself with out liquidation .Any body who is being told by the banks that they will not pay out on a BG because SJ/HdT are in liquidation/administration should consider a different lawyer !
As for the choices for those without BGs in certain circumstances if the deposit is large one it is worth pursuing . The the law can be used to advantage with out costing a fortune . In fact my actions to recover monies with no BG cost me less than recovering the payment of monies with BG. MM

Alantracey. I have not seen the proposed agreement so I have no idea what the proposed terms are. They have no money to pay back so I have to assume that the whole amount being offered (whatever the percentage) is to be paid over a period of time stated in the proposed agreement.
MM. I know two creditors with Bg's who are being told the company needs to go into liquidation before they have their money returned. It is in my opinion a delaying tactic only and these couples will be paid out with the help of their legals eventually. I am pleased that you yourself have had a successful outcome.

they are offering 65% back over 5 years paying 10% of this on the 4th year and rest on the 5th year so you will not see the full 65% till 2015
if you want your house they hope to start the urbanisation in 2011 and houses from 2013 till 2017

my solicitor has sent me a plan de convenido(plan of arrangement) offered by herrada del tollo the 65% that is it no mention of any interest this is only an offer this does not mean it is going to be accepted
