We could, according to SARC, have had nothing now but no we must wait for 5 years to get 65% of nothing! I give them 3 months at most before they are back in administration again. How many people want their house on a pitch and put course and who are they going to sell all these properties to? It makes no sense at all.

I think in my humble opinion that we should wait until we have the official verification of the vote and if it is in favour then we take the next course of action which is possibly to go after the banks who accepted our deposits. I personally will be contacting my solicitor who also represents quite a few of us to further discuss this option which has been mentioned briefly previously.

Hi all
read my posting on sarc 6 june,I hope the NO voters will form our own sindicate and take a class action if Hdt gets the go ahead.
Once the result is known and not in our interest, I would ask for all like minded people who would like their money back to band tohether and go for a class action.
I would like to know your views, and I would like to work with others once the result comes in, if it is not in our interest.
I vote NO I do not want to waite 5 years for something that will not be built, I have waited long enough and want an end to this.
I will be posting soon, suggested Tony and his mob buy my plot if they are so sure that in 5 years they can make a killing.

Dear All
If as almundena says they have enough people voted yes to carry on, does that mean that all those who voted no to the proposal can be jettisoned without any come back, surely HDT must understand that those of us who said no to the proposal would look at all other options to try and get our money back, or do they expect us to just to tag along with the proposal?

The way i understood it was if you voted yes you were letting them off the hook for any future action against them but if you voted no it is open season and go for what you can get..
Not forced to be accurate but it is my understanding.

You might be interested to know that I have my Lawyer (a UK and Spanish based one) in Warwick County Court next week for a directions hearing before a full hearing is listed.
If anyone else is taking the same action against their lawyer for not providing a B.G please p.m me and perhaps we could share info and if anyone would like to act as a genuine witness to all the goings on with B.G's or just attend to support me at my full hearing that would be very helpfull indeed.

This is my first time on the site and I also want my money back. Is it not better that HDT are back working and bringing in some money so that we have a chance of a refund. We bought in 2006, like most of you, and went over to Spain for supposed completion in 2008 only to be told that the firm were in liquidation. After 6 months we came home, homeless, rented for another 6 months then decide to buy a house. We are in our 60s and needed to be settled again.

Reading your comments was very interesting, especially as it is your first time here. I assume that you are now back living in the UK and that is where you bought your house?
We are in a similar position, also in our 60s, however we had signed a rental agreement in Jumilla in April 2008, expecting to move into our completed property in December that year. When Herrada del Tollo went into voluntary administration in May 2008 we decided to stay on in the rented apartment and look around for another property to buy, although obviously with a more limited budget. We have now been living in Jumilla in our own apartment for just over a year and are very happy here. We will be even happier though if we manage to get some if not all of our deposit back!

We should have moved into our apartment in Jan 2008 but were told it was held up until June and we would be eligible for part payment of rent while we waited for the completion, that's why we decided to go over and rent in May. I think we were just disillusioned and after 6 months decided to come home. Needless to say, we didn't get help with the rent because of the firm being in liquidation.
I'm glad to hear that you have somewhere and are liking it. How are you finding the laws in Spain? Yes, we are now in a bungalow at home in Perth, Scotland.

Whereabouts did you rent when you came over to Spain?
Yes, we were told initially that HdT would pay half of our rent, but then we discovered this meant that they would reduce the balance of our payment by half of the rent x the number of months we had to rent for! As you say, that turned out to be nonsense once they went into liquidation.
Luckily the purchase of our new home went through without any problems, so apart from the problems with HdT I reckon we can say the laws in Spain are OK (Hope that I'm not tempting fate!)

Ken,
we do not know the identity of those who post & it is likely that there were some trying to get HdT liquidated and block SADM going ahead who were not purchasers. These may of been ecology groups or people trying to get the assetts cheaply & now the vote has been made they would no longer need to try to influence purchasers by posting.
That is why I asked that posters identified their plot number and UK/Spain locaction.

As for the vote any rumours regarding the outcome is mere speculation at the moment !!!! still posting drivel. But there were a lot more people who posted spitefull comments and untruths that then disapeared when the vote was concluded. As you can see from reports from Jumilla town hall that the licences are rerady and waiting and that the town hall won their case in Madrid so maybe after these long two years we will finally get our propereties and those that want their money can get theirs

Surely you mean those that want a portion of their money back ie 65%, what will happen to the other 35% of our money, is that an administration charge, or will that be their cash flow for when they start the project, why can they not pay back 100% of the money even if it took longer than the supposed five years to get our 65%.
Just my thoughts
