First some facts and if you do a little more research you will find it!
I own a property near Huercal Overa- the builder was slow and 9 months late and I had a financial penalty clause to cover that
When I received the deeds I kept a substantial retention to cover the completion of the infrastructure
I was fortunate that the developer did not go into administration like so many others in Spain but at one time I think it was touch and go and it took quite a lot of effort and time to make sure that the villa was completed and I received the deeds
You will also find out that I purchased another property where the development was mothballed and I received my 30% deposit back via a bank guarantee plus interest @ 6% for two years – legal cost of achieving this was 1000 € and it took circa 3 months
Many ACC buyers have been in touch with me direct and I have explained my own reasons but I have also, both on this forum, and privately stated that ‘ if you have a BG then you should cash it in’
Otherwise, get to know the facts and make your own mind up
Can you remind readers of the Thread how much money you have at risk and the current situation regarding your legal case, if you have gone down that route
Now as to me offering my professional services to buyers with problems on ACC or OTCC, I can not get involved as there would naturally be a ‘ conflict of interest’ as a person who has changed from ACC to OTCC
In the development you refer to, I quoted an ‘initial budget fee ‘ of 4.000 € to cover the cost of the initial meeting of an Action Group, dealing with the appointment of competent lawyers and setting up the strategy
The cost of a ‘Group Action’ is very much more expensive than this figure!
Posters have talked about a Group Action on various ACC Threads but there has never been much positive enthusiasm and most buyers seem to have gone down their own route
I have nothing more to add re OTCC at the moment besides what I have posted recently and only your ‘ lack of attention to detail and research’ and you implied rudeness, meant that I should set the record straight
