IF OR WHEN WE SORT OUT SOMEBODY TO DO THIS FOR US I THINK WE SHOULD MENTION THIS POOL AREA I AM SURE I READ SOMEWHERE IN OUR CONTRACT THAT IF SOMETHING WAS TO BE CHANGED IT WOULD BE FOR THE BETTER THE POOL AREA WAS SUPPOSE TO BE IN THE MIDDLE OF THE PLOT AND LOOKED QUITE BIG NOT IN ONE CORNER AND SMALL - I PERSONALLY THINK WE SHOULD GET SOMERT BACK FOR THIS AS WELL   - THEY DID NOT ASK ME IF IT WAS OK TO DO THIS DONT KNOW IF THEY ASKED THE REST OF YOU

hi all   I e'mailed both Palmer and Urbasa last Thursday, Palmera replied saying that the builders had been on site last month but had to go and finish at another site and they would be back to complete for June This to me sounds like what we've been having all along BULLS**T  .The one sent to Urbasa has not gone through yet its in a server queue and that the account is full, this must mean they are ignoring there e'mails because there are at least 147 irate  customers bombarding them with questions  What we need is a hacker to get into there computer and if that by a small miracle happens Palmera could be next.

Hi all I ave not posted for a while very very fedup, that much that we put ours up for resale back in September. After not hearing anything rung Andrea who deals with sales and asked if any interest, and that I had heard that they where putting people off buying our appartments ? She went  quite then said that the builder as stopped the resale of the appartments ? we would be getting a letter she said. that was 2 weeks since. I dont think they have tried  to sell them , about 50 plus up for resale .So frustating,We were so excited at the beginning even up to the beginning of last year .now I wish we had never bought . A very good idea with eve1 getting together though ,

Hi debaz 10 its so frustrating isn't it. We have all come so far it seems such a shame to give in now. If you do sell I hope you come out on the winning side. We have all waited for this long we SHOULDN'T give in now , come on lets keep going, our long awaited apts must be ready soon.

From this experience we would NEVER EVER buy offplan again but there you go!!!! It seems like you just dont know which way to turn doesn't it. To sell or not to sell that is the question! To sell- would it not be worth anything till finished? But then not to sell- how long do we wait?

I know I am stating the obvious, but just remember we are all here for each other, in the same rocky boat.

Come on guys its 2007, shall we all go squat and finish them ourselves? Anyone know how to finish the pool area??

Lets try to keep hope, though we have been let down THEY WILL FINISH THEM!!!

Hi all

All for taking action now feeling is that of  being conned and personally we want to fight back, we said we wouldn’t throw any more money at the development until it’s virtually finished. But revenge would be sweet even if we managed to drag Palmeras name and that of the builder through the mud by some way of negative publicity. With regards to getting all the other buyers involved who don’t come on here Palmera will hide behind data protection laws and will not give any details. The only other small route to swelling our numbers is when anyone is over there maybe if you are at the development talk to others who are looking around with a despaired look on there faces and spread the word of this site or maybe even chalk on the walls Concerned purchasers  visit us at Eye on Spain .Com .

Hi all,

Like a few of you have already said, haven't posted on the site for a while as had nothing to say!! 

Agree that our strength is in numbers if we are to take action against Palmera and/or Urbasa but as someone has already said, we are only a small minority on this site and although splitting the cost between 10/12 of us is a great idea, do we really want to be spending more of our money on behalf of the other 100 or so prospective owners, who presumably aren't doing anything but biding their time?  I think as JPD says, the apartments WILL be finished, one day, so we need to support and keep in touch with each other thru. this forum.  I would be happier for the 10/12 of us to unite for some sort of compensation - and I'm not prepared to settle for a fridge or washing machine!  Maybe united we could push harder for a kitchen or air con.  As I say, happy to unite but the cost of employing a legal representative may be frightening if it's only split between us!  Sorry to sound so negative but we're losing the will the live over this.  However, we are definitly not giving up or selling out!  One day, in the not too dim distant future we shall be sitting on our roof terrace sipping sangria....

i am new to this site, although have been keeping an eye on it for a long time now. As with you all we are so fed up with the lies and crap that we keep being told. we were sold these with the knowledge of a kitchen and wardrobes but have been told now - on yer bike more or less - we also put a deposit down in 2002., but first we thought we had checked everything out sufficiently, we were told that the bank was funding the builder so in case he went down the pan then the bank would fund the finishing of the apartments!!!!!!!! Cobblers of course as far as we can see, would like to be included on the suggestion of getting independant solicitor involved - depending on the cost - as some of you have said we don't want to throw more money at this than we have to .totally fed up with the whole process now but there must be light at the end of the tunnel one day surely, or will they sit unfinished forever.

Hi all ,  Hi cjw  any message is great at the moment as it just keeps us all together cos we are all fed up to the back teeth with all this !Misty love the idea of chalking on the wall but I think thats what the robbers do over there looking at the crime thread on main message boards!!!! Will have to start our own codes!!! As for looking for poor buyers looking fed up, have not seen anyone there yet not even the odd BUILDER!! Only Haydn and Mo and we all sat and moaned together over a beer!!

Know what you mean lajj about throwing even more money in lets just see how many more people we get saying they are in agreement then maybe we will see if it would be worth it, I dont think any of us really want to throw any more money in , but if there are enough of us who knows!! Its something to grasp at in our hour of need!!

just got of the phone with urbasa and same old story

She told me to ring back in a months time the builders are suppose to be starting work end of February which year i dont know but this is what she told me

i will try again in a months time and see what excuse they give me this time

They must be ready for starting again soon   !!!!!!      I HOPE  /  I MEAN WE HOPE

hi all who wait patiently or otherwise,   the idea of keeping together has many benefits, we can have a moan , anyone out there will always post there experience , photos are uploaded and many other reason. The question now being asked, do we pay to try to hurry them up? Myself when paying the deposit   [ I think it was in pesetas]   rather foolishly have taken Palmera,s solicitor I'm now going to employ an independent solicitor for the completion[ when? ] what it will cost I have no idea. Has anyone else used Palmera,s solicitor and are thinking on the same lines

hello haydngi it should cost you for a solicitor about 1 percent of the apartment i have not used palmeras solicitors.

Luckily i am not in a rush to get in, but would rather have it ready, I am still saving up as much money as i can so i can get a smaller mortgage when we do finally get over there.

I am not panicking as of yet, The building is to far advanced for urbasa to stop they would lose millions and prob go bust if they did not finish Amarion 111 and i dont think they would want that to happen, I really cant see it being ready for this summer (i could be wrong tho) I personally think it is going to be late in the year now  OCT / NOV / DEC  which i suppose would be good in one or two ways  - it wont be quite as hot - we have got to get all our furniture in yet   and we are still saving money up  - less mortgage

BUT STILL CANT WAIT  -  COME ON BUILDERS  -  WERE ARE YOU

Yes, we were complete virgins at buying property abroad, and thought we were being dealt with by professionals, but there you go!. Still if they ever contact us to sign, then at that stage we will probably invest in our own solictor, but until then we are not spending any more. I cannnot see the builder giving anything in compensation.

hi all,  good idea to all get together, but how ?(write to different local radio stations, only cost price of stamp. ask people to log onto eye os spain.)  we also fed up not beeing able to get answers. even laura at urbassa in amoradi office fed up. we are not expecting them ready for summer,think it will be oct. would be nice if before grandchildren getting fed up, staying elsewhere when they go over. one way of looking at it, by time it is ready all other building work around should be finished so will look nice and we will not have had to put up with mess, dust, noise.

THE SAGA GOES ON...we've still received no replies to our two e-mails sent nearly two weeks ago to Palmera at both offices, Alicante and Benalmadena.  We decided to use their own solicitor (who incidentally had changed from the original details we were sent in 2002 when we reserved our property..and when we tried to contact the one we thought was to represent us they had moved offices and the named man was no longer heard of and we were given instructions via a telephone call to them in Alicante that someone else there would represent us as and when..all this was only found out when we called them, THEY TOLD US NOTHING).  We've written umpteen letters and sent loads of e-mails just to let them know we are still living, 'cos sometimes we're not even sure they know that much.  It's so hard to keep any positive thoughts about either Palmera or Urbasa as they've let us down lock, stock and barrel. Count us in for any joint representation provided it's affordable, ok yes that would be helping others who are not shouting aloud but at the end of the day surely we want either of two things:

1) A COMPLETED PROPERTY WITHIN THE TERMS OF THE CONTRACT . WE THINK THAT'S PROBABLY EXPIRED BY NOW ANYHOW THAT'S HOW WE READ IT, WHAT DO YOU ALL THINK?

2) OUR MONEY BACK PLUS INTEREST. YES WE WOULD LOSE OUT ON PROFIT WHICH WE COULD HAVE MADE BUT WE FEEL IT'S TIME ENOUGH FOR SOME FINALITY OF DATES ON THEIR PART, THEIR LETTER STATING JUNE 2007 WAS JUST A FOB OFF TO SHUT US ALL UP.

Blacksmith - we agree with you, spend no more money on anything (except perhaps a contribution towards group representation maybe with philansy's solicitor who seems to have worked out well), and then we will change solicitor for the final stages of completion if they ever come, or stay with that one.

If we hadn't found this forum we wouldn't even know there was to be no kitchen or wardrobes as we'd been told by the Palmera rep who showed us the piece of land in October 2002 that everything shown on the paperwork and specification was to be included  We've flown to Alicante three times in all, had appointments with James Collins twice and done all we can as so many of you have to make this happen. PERHAPS WATCHDOG IS THE ANSWER. We'd seen on TV several programmes of people caught up in nightmare scenarios on the Costas, but we really believed that buying a place high up in a block could not have many of the problems we'd heard about.

The Palmera Properties website is still advertising properties for sale, but we were told by Andrea in Sales that they are instructed not to take on resales, though some people think their's is up for resale they need to know they are doing nothing to market them. What a mess this all is. It seems then that they are also lying to new interested parties, maybe they need their deposits to get the builders back working, who knows? 4 years and 4 months we've been reserved, amazing!! All of this has blighted our dream a little, but we try to be resilient. There's mention of those who are not here talking to us, but the poor souls could have been sectioned under the Mental Health Act..so if we go missing..well >>>>>>

Hi

Phoned Palmera head office yesterday spoke to Rachel in Customer Services.  She said the builders went back on site in January but she received a phone call from one of us to say that they were not there.  She said all at Palmera were shocked to hear this and followed it up straight away.  The builders were on site for perhaps one or two days only, then they were called away to finish another building which is nearing completion.  Palmera are under the impression that the builder will want this project finished so he can use the money to finish Amarion III.  She stressed that the builder has been very near to bankruptcy.  I asked the question about the out of time Contract date.  We have a photo dated May 2004 showing the building underway so 36 months (as stated on our Contract) from then will be May 2007.  So by the end of June 07 he will be out of Contract and she said there are no other months that he can add on.  I said so at this stage we could pull out if we wanted to and ask for our money back, she said yes but the builder has no money.  I said I thought our money was insured in case this happened but she didn't seem to think it was.  So I don't think we would get our money back, unless it went to court and I don't think we will be in line for much of a compensation item if it is true that he has no money (perhaps the fridge).  She said she was sorry that this has happened and thanked me for our patience, she said they are trying to keep tabs on the builder and really do believe that the flats will be ready for June (perhaps the end of June)  The whole building might not be finished but this is the norm builders do hang around for some time after completion.

The way I'm  looking at this now, if they reckon two months to finish the build that will make it end of April that the builders must be on site to make June dead line. She said we would get 6 weeks notice to sign.  End of April is not too far away.  If they are not on site by then we will know that something is really up!!  So I am going to relax till then and think positive.

Well suzannef, we really really hope so!!

We too used Palmeras solicitior. Guess we should change him, if he really exists!

Can you imagine how the poor people who have not found this site must be feeling? We are all keeping each other going with bits of information and ideas etc but they must feel so alone. That is if they haven't thrown in the towel yet!! Hey maybe watchdog would bring E.O.S to their notice???

We e.mailed Palmera about the mortgage cos all our details were sent off Jan 2006 and we never heard any more from them. We DID get a reply with the mortgage offer and details of the bank etc. Wonder when they were going to let us know?? Mind you she did say its not binding cos the building is not yet finished.!!!!!  NO ,NEVER , you dont say and there was us thinking it was!    NOT!
