It would help me to know how many of you got the apts direct from Urbasa? Is your contract with exclusively with Urbasa or does Palmeral Propt. appear on it too?

My contract is just with Urbasa, and I would suggest all the others are the same. Palmera were agents for Urbasa, and as such charged and agents fee. The contract I have does not mentions Palmaera in any way. It states that the contract is between Mr. Jose Antonio Ariza Sevilla, acting in the name of the developer company PROYECCIONES INMOBILIARIAS URBASA S.L. and was authorizied by the Public Notary Mr. Juan Manuel Clemente Gonzalez. This contract was signed and stamped with the Urbasa stamp, and I have been told it is legaly binding

AND SOME COMPLETE
WHICH IN MY MIND MEANS THEY HAVE SOME MONEY AND PROPERTY
AND IF THEY HAVE PROPERTY THE COURTS CAN SURELY MAKE THEM SELL IT TO PAY US BACK

Hi to all, just had feedback from my Spanish lawyer in Spain and Urbasa has not as many assets as you think. In fact Banco Pastor has initiated civil legal action against Urbasa as well as the original owners of the land are now claiming the ownership of the land and builiding and too make things worse it exist s a "nota simple registral" from Feb 2008 where Urbasa is fined for upaid "bills" amounting to some 800,000 EUR!! My lawyer has confirmed that at present URbasa is in a "HIGH RISK INSOLVENCY" position and that I have to initiate civil litigation immediately to first go against any properties/goods that Urbasa may still owne, falling that then it will be criminal action aganst the Administradores of Urbasa for "estafa and fraude".
I understand that some of you have the case with a solicitor or in court. I am calling urgently to any of you that have not started a civi court case yet and to join me in this as it is imperative that we get as many of us together to bring force to this case.
Pls let me know asap if you are keen to join me and will pass on info re lawyers in Alicante to start thing moving

Just to confirm my contract is the same as RED FONZ..bought through palmera but no mention of them on the contract with urbassa.....Im with all of you...if its group action...count me in........

Thanks Babsy - I gather from your reply that are not in court litigation as yet so I will be in touch shorlty with next steps. I will wait until end of this week to get as many people as we can on this but we cannnot delay action one more day.

Out of interest does anybody else have a letter from Palmera saying that in lieu of a bank guarantee that if Urbasa go bankrupt they will pay back deposit. I got this before paying deposit but Palmera said that because it is from the West Cliff on sea office and signed from and ex employee it is not valid. But of course they would say that!

if you have a letter from them saying that i think i would be seeing a solicitor here if or when they go bankrupt and i dont care were it as come from, if the company as signed it of course it is valid

hi smc...yes correct - i have no solicitors or anything in place yet..
i had a meeting with urbassa at there office in elche at the beginning of March and have posted on a previous reply the conversation that took place...now i realise antother fob off....i will keep in contact and go with what everyone feels we need to do...
as per red fonz last post - i do not have anything like this said in my paperwork but i will certainly have another look....speak soon

Palmera or/and Urbasa may say that there is a bank garantee, but Banco Pastor who is the financing body has confirmed to my lawyer that there are not any bank guarantees of any kind neither an insurance company!. My laywer in Spain spoke direct to the legal dept in B Pastor weeks back.
Anyway, I will be sending you tonight or tomorrow details of lawyers in Alicante to initiate joint legal action - are you still on for this? The "honorarios" (fees) in Spain are 10% of amount beeing claimed. As we (about 5 or 6 of us) are bringing a case together this will be less - I will be contacting them to establish what the cost will be and what initial payment will be in order to start the case. I have also been told that when the judge rules "sentencia" our legal costs area likely to be incleded as part of the devolution, but this can not be confirmed until then.
My lawyer has also said that we will need to forward to lawyers in Alicante our original contracts and the payment paperwork of all amounts given to Urbasa, Palmera or whoever.

As I said you can count me in with anyone else you can get to support our case. Maybe we should get something drafted to see who or how many people we can get together. I think that Phil may have some more information as to who is involved with this project, so maybe he can give you names
