Hi All,
has anyone had any news from Urbasa? I have been told that all the apartments in Amorion have been sold to one man who then has resold them through Palmera to us. Is seems that none of our deposits have reached Urbasa and that Palmera have to be contacted. Has anyone else heard any more?

Hi
Can someone please email me the latest contact we should be emailing/speaking to at Urbasa. I have my details that I need to send to them. I know Anca was the last contact but I'm not sure if I've read somewhere that she has now left.
Many thanks
Sarah

Hi Bill,
I have been e-mailing and ringing for the last few weeks but have yet to get any answer. The phone just rings out or goes to an answering service, but with no message. I dont know what we can do only wait. I have contacted to origional solicitors and they have sent me a copy of the cheques and when Palmera cashes them, but if that money ever got to Urbasa only they know

I bought 2 apts from Urbasa, Edificio Amarion back in back in early 2004. Delay of completion is now over a year. I met iJuly last year with Jose Antonia Ariaza Managing Director of Grupo Urbasa (one of the owners together with her sister Dolores Ariza) in their offices in Elche as I wanted my money back as per contract in the light of the great delay in completion. Still have not got my money back despite of my almost weekly calls. I have now put the matter in the hands of my Spanish lawyer. To give you a bit more info, I have also spoken this week with the Ayuntamiento (Town Hall) to stablish whether perhaps they have stopped progression of building, but this is not the case, as I have been told again that Urbasa have internal problems one of them being the site manager left over 1 year ago with his crew and they cannot get credit from the banks (my theory is that our deposits were spent in initiating other buildings and things got out of hand). The rumour in Almoradid is that Grupo Urbasa has done "suspension de pagos" that is bankrupt. My Spanish lawyer already sent Urbasa a burofax before Easter this year legally requesting devolution of my moneys due to breachh of contract - we got no reply at all. He has now sent a burofax to Banco Pastor who is the financing body of Amarion III and many others in that area. Our hope is that either the bank or Urbasa's insurance company should be backing up our moneys (according to a Spanish law passed back in 1967). We still waiting the ban's response. I have been advised by my lawyer that if we do not get a positive response from banco Pastor the only way forward is to go to the tribunal court via penal. This will have to be handled by a lawyer based in Alicante. My lawyer has also mentioned that a joint case would be more powerful that individual ones, no need to mention that share of costs incurred by lawyers and the court would be lesser. We have a pretty nasty scenario here and will take months to resolve - not necesarily to a positive one.
My hope is to get in touch with as many of you as possible.

Hi SMC
You can count me in if thats what is required, and I think it will be. The more of us that can get together the better it will be for us all in the long run. The property itself must be worth quite a bit, as its about 90% finished. If we can gather enough support, a larger group of crediters has a better chance of getting a result.

Hello RefFonz,
thanks for your reply - could I ask you who did you buy the apt from?\Was it direct from Urbasa? Did you give the deposit to Urbasa through Banco Pastor? In my case, I bought the apts direct from Urbasa and payments were direct to Banco Pastor. The reason for these ?s is that I have noticed that some of you mention Palmeral Properties? Who are they?
Best regards,
SMC

Hi Again,
like most of us I think, I bought the property through Palmera Properties. They were in Alicante, but have closed that office. I payed the deposite plus fees through a solicitor in Alicante. They have sent me statments to say that the money went to Palmera Properties. From there the dispute is who got what. As far as I can see Urbasa signed my contract to say that they recieved the deposit, but the internal audit said that they never recieved a penny. If I have a contract from Urbasa then thats the one I will go off.

Hi Redfonz
you may have a problem there and so may others without propper proof that urbasa as got your money
you may be a bit stuck my solicitor wanted writen details of who had my money and how much
without this he wouldnt take them to court
the contract was not enough, i had to get emails from urbasa and anything that was writen that would help the case

Hi Redfonz,
now I don't know who your fight is against, it seems that Palmera Prop. did not pass on to Urbasa all your moneys. I will mention this to my Spanish lawyer and find out if you can go direct to Urbasa.
Has all of you bought the apts in Amarion III thr'ough Palmera Prop.?
