Hello all,
I get the impression that there is a groundswell of feeling that there should be some type of action taken against Palmera / Urbasa, whether it is to get compensation for the inummerable delays or some sweeteners in the form of a new kitchen or white furniture for kitchens.
I think that before any individual actions are taken,we must all get agreement on the best way to go forward to achieve our aim, which is I hope, to get our apartments built and completed as soon as possible.
I also think that it should be established as to who should we direct our concerted actions against. In my opinion it should be Palmera as they are the people who we have signed the contracts with, so they must be the people who are legally liable for any shortfall in the execution of their part of the contract of which they have signed in all individual cases. Urbasa are not under contract to any buyer in any way as they have not signed any contracts with the buyers.
If the legal time scale of completion of the apartments,January 5th 2007, comes and goes, it is Palmera properties who are legaly liable as they are the contracted parties to the buyers and to the builders.
I suggest that the meeting that was cancelled in Bolton should be re arranged and relocated to a more central point in the Midlands so the a lot more people who are buying can attend.
Your opinions would be appreciated

hello all,
Just a rider to my last message,I sent a copy of my contract to a spanish lawyer who gave me the legally binding finish date, he also stated that no action can be taken against Palmera until that date passes. However,it would do no harm if any decisions that were made by the buyers of apartments, were disemminated to Palmera Properties, in the hope that they would see that we are speaking in a unified voice and that once the timetable passes some type of action will be taken against them and it may give them a kick up the jacksee.

Jim,
Being new to the forum I wasn't aware that you had already tried to get buyers together on a previous occassion. I think it's a great idea. We're based in West London, so the Midlands would work for us.
At the end of the day all we really want is the keys to our lovely apartment, finished to the standard and quality that we were led to believe we would be getting when we paid our deposit to Palmera.
On a hugely positive note, this forum has certainly made us keener to get in to our apartment having met (in virtual terms!) our future neighbours and knowing we're no alone in this long drawn out process.

Just to point out that it was not me who tried to arrange the previous meeting, however if people would like to attend a meeting in the midlands I will quite willingly arrange it. Birmingham or Nottingham would be good central locations.

where in the midlands are we talking about i live in the nothwest - bolton nr manchester - but i will try to attend if it's not to fare away and if we need somewhere closer to north west area we can hold a couple of meetings and get together on net to talk about it later
anyone close to bolton i will arange a meeting if you want ?

The meeting sounds like a good idea we are in Bristol so Birmingham or somewhere there abouts would be good. I agree that we should do it in January - at the moment they are still within their contract - who knows it might all be done by then!

jamrock, your lawyer seems to be on the ball. Would you be willing to share his details with us, i'm still looking for a good un.
As to the meeting. It is still gonna be a bit to far for me to travel to, but i'm all for you guy's getting together and knocking your ideas about.
My views on the January deadline, is either fitted kitchens and wardrobes, or compensation of some sort. I also don't think we will find similar properties for the prices we have paid, so a refund is not a good way to go (me thinks).

I'm with you Dave regarding refunds, having searched the websites we would struggle to get anything close to what we have for the same money now - even though the properties are not finished they have gone up in value and for Palmera us walking away means they can re-sale them at a profit. I am not sure about everyone else but I have no inclination to give them that opportunity. We are also looking for a good lawyer so prehaps us all using the same lawyer might help

hi all
I am open to suggestions of where a meeting could be held. I think Birmingham is the most central point for everybody who is buying in the uk as for dates I think it would be a good idea if we got together before the finish date so that we have a clear and agreed plan on what to do if the apartments are delayed further. However if people could give info on when they would like the meeting I will try to arrange it to suiteverybody

Many thanks for offering to arrange a meeting (sorry, I hadn't realised you hadn't arranged the previous one - I didn't mean to lumber you with work!).
However like Kerrie, we all work so a weekend would be best for us too and as I said before, Birmingham would be ideal for us.

hi to you all, the idea of a meeting is good , myself I would be able to attend at any time or place as I am out of work due to the fact I'm retired . I'm sorry I was unable to take any 'photos that are any better than the one's already posted but the work going on around the site seems to be drainage or the like as they have dug a large hole on the road at the end of the building. the young lady at the urbasa did not know what it was for.

I HAVE JUST BEEN ON PHONE TO GRUPO URBASA IN ALMORADI
and they are saying they have the builders and they are just waiting of the town hall now, Then they can start work again, She said the builders are starting work in 2 weeks and she is going to send a letter out to us
Also she said it will be finished at the end of the year ( we'll see )
I suppose we may as well wait and see what happens before we have a meeting you never know they may actually do some work

Misty’s husband here good news maybe from Philancy, would just like to put in my thoughts from a builders point of view, the only reason s that a builder would leave the site in my opinion so close to completion is
1 If they haven’t been paid by the developer (Urbasa)
2 The work was stopped by the building inspector due to substandard work
3 Or the developer was in such financial difficulties that they were being run by accountants who wouldn’t sanction any future work until funds were available and direction of the developer became clearer.
My view is the truth lies somewhere between those three, saying that’s from a UK perspective not Spanish, also remember Urbasa would rake in around 7 million from completion of the development, which would only take around 8-10 weeks in my opinion so they wany completion as much if not more than us..
With regards to the penalty clause you are all correct as Property prices have raised so much during the last 3 years be daft to take if offered, a similar 2 bed 2 bath new property in Almoradi would cost you 125,000 euros, also we would only be entitled to the builders deposit +3% not all the other payments we have already paid, so we have little choice but to hang on and pester their life’s out
