I will call the lawyers this morning and find out how many we are in now, fees, next step, etc - they will be sending anyway all of this info in writing. I will send coments, if any, to you all to your private email address.
I have got another 2 people interested, I hope they can join in too.
Cheers

Hi all, have been out of contact for a few months, have recently had a baby and so have been a little preoccupied!!! However, catching up on the forum I definitely would like to join so will give the solicitor a call tomorrow to see what the process will be.... SMC, is it worth dropping you a PM with my email address to receive brief message from solicitor? I'll drop you one now anyhow, just to save time.
Oh, I received an email from Urbasa yesterday - a reply from my original email about 2/3 months ago! Basically, they have told me that they had just one client who purchased Amarion III (Mr. Hanania Melouil) and that monies were paid to Palmera and Mr Hanania and that Urbasa never received anything. They went on to say that, no payment aside and as the developers, they are looking for an 'economical solution' to complete the build, but that finances are not great! Errr, obviously forgetting that I am no longer interested in the finished product and just want my money back - maybe they lost my cancellation letter.....
This email has just made me so angry, how long do we have to hear the same old story, passing the buck - this has been 5 years now (more for some). All of us have parted with really hard earned money and these people think they can just get away with it? I could go on but will spare you!
Anyway, hopefully there's still time to join.
Ciao

Hi CJW,
yes, it is best if you call the lawyers direct with any questions you may have. The documentation they need at the moment is copies of your contract/s, any payement receipts to Urbasa, Palmera...and any other paperwork relating to, if applicable, the termination of contract. They will not be able to give you an indication of costings at present as they need to evaluate our case first once they have all the information from everyone. Then , they will give us what is called a "minuta" with details of the process, stages...and fees.
Details below:
Costa & Asociados
Jose Costa, Principal Partner
Calle Luis Vives 6
Tercer Piso, Puerta 8
Valencia
Spain
Tel: 0034 96 392 1403 (office is closed Friday afternoon)
The person who some have been spekaing to recently is called Eli Castillo, one of the other lawyers.
Hope this helps.

The solicitors usually charge 10% of what ever you are claiming
with all you going together it may be cheaper, i dont know but i would be going of that if you want a rough price
also they usually want some up front, I had to pay 1000 euro's to get it started off
you will have to pay this 10 % win or lose
hope this helps

hi everyone,
we have a letter from palmera office in westcliffe on sea, states YOUR MONEY IS SAFE; initally, the deposit wil be held by palmera properties in a fully bonded and insured client account. when building starts, the monies are transferred to the developers bank client account, which is also bonded and insured
ANYONE ELSE HAVE THIS LETTER..
IF URBASA NOT RECEIVED ANY MONEY FROM US WHY HAVE THEY NOT SAID BEFORE.
we were taken to see urbasa directors at start, also in summer of 05,
our sellers agreement states urbasa as the seller.
our paperwork is now with lawyers in spain
regards

Hi, just to let you know I called the solicitor this morning and scanned over all my documents - they've confirmed receipt so we're in with everyone else.
At last we're doing something and it feels good.
Enjoy your weekends.

HI el Robbo
We have a letter from Palmera saying that if Urbasa go bankrupt they will pay us back the monies paid in lieu of a bank guarantee, However when I discussed it with Palmera they said that the letter was of no significance as it was issued from the Westcliiff on sea office and the person it is signed by no longer works for Palmera! Hence a copy of that letter has gone to the solicitor!

Hi Danny
if you have a letter from them saying that it should'nt matter who signed it, they represented that company
and they should pay you back
am not a expert in law but am pretty sure thats how it works

Oh well, looking in here at latest messages it's all still going on with so many trying to get something positive. Nothing has happened for us, we've e-mailed and sent letters by post to Urbasa, no replies to date, will post anything that happens here, but it all looks pretty grim. Our lawyer has said he feels it could take a lengthy time to sort this out, and wants 10% win or lose. So we could end up handing back about £3,000 for legal representation even if they did pay us back. Seems like a distant dream living in Spain, I guess that if it goes on long enough they think we'll get fed up and go away. Has anyone given any thought to going on Watchdog? not sure if there would be any mileage in that. Knowing that Palmera now have interests in places like Morocco have you thought that perhaps our money has been milked off to there?
a thought eh!
