I have today received an email from Almudena. For what it is worth this is what she said!

 

The infrastructure works are due to be completed within 2 to 3 months which will then allow the company SJ to receive finance to enable the building work to start.

Priority will be given to finalize the properties that are already sold, completion dates will be discussed once building work has taken place.

 

PLEASE DON'T SHOOT THE MESSENGER!!!

Overall, not good news for everyone, but at least it sounds in line with what they have said previously in terms of the actual plan, even if the timescales are once again slightly out.

It looks like the street lighting is finished. Does that mean we only have to wait for the second layer of tarmac on the roads, before we can get our certificates ??

Its good news about the lights, like you say we need the roads finished. Then the green areas. So its still some way off, I'm sure. There is the snagging ie the leaking swimming pool etc. But all good news so far.

Whats happening with the commitee and the administrator they employed. El Pinet is now three area's?

Has anything happened with the cost of the electric are will still paying for rest of Alicante. Has the meter been checked?

Has anyone else received what looks like a bank demand for 60 Euros per property from Mediterraneo in last couple of days. I was not at the early january meeting so I have no idea what new payment requests were agreed, and I have, until now, been paying the 2 payments of 50 Euros and 20 Euros per month as agreed. The Mediterraneo invoice looks like something for community fees, however at 60 Euros for 8th Feb to 10th March, it seems very high.

This sounds like something sent out by the new Administrator who works for Cam.When I was there in January I understood that a letter would be sent to all owners in February.

Until such time as services are connected individually Non Residents should be paying 40 Euros per month towards electricity and water plus 20 for Community Charge. Residents pay 70 plus 20.

Seems like the new Administrator is doing his job  including chasing non payers.

I got one too, without any warning.  If there was an AGM this must have been discussed - why have no minutes been distributed?

And what has happened to all the funds paid so far?

I have received no letter but have heard rumours. No way as a non resident will I pay this charge. Not a community charge but a subsidy for residents and  San Jose. Totally illegal. No legal admnistrators yet for el Pinet until the site has been handed over and we have received our certificates.No legal committee. A sly way of frightening people to pay .A community charge is only for the upkeep of common assets eg the one pool on my deeds. A reminder that the debts are not the owners but San Jose's.

And for what it’s worth, here is my view on this sorry situation,

I have a holiday home on El Pinet and last year I was asked to contribute 20 Euros (community fees) and 40 Euros (water/electricity) per month. I made these payments regularly and in good faith until I went over there for a holiday last Summer, then the following issues made me reconsider;
 
1.       There was a water shortage whilst I was there and we had to pay (again) for water to be delivered by the tankerload. (I have no complaints about this).
2.       When I arrived I was not allowed to have a shower after an extremely long drive from the port because the water had been "turned off for the night". (I was now paying for water twice, but I have no complaints about this either).
3.       My electricity was running at 135 -175 volts so all the appliances kept tripping. (Still no complaints - that’s life!).
4.       Then some Irish holidaymakers told me in a local bar that their neighbour, a resident, was giving their garden a full soaking every night as soon as the sun went down. (Whoa hang on there! How many sets of rules are there?)
5.       It then also transpired that some residents were refusing to pay anything at all towards fees, even if they were running private pools and aircons. (Mmmhh, it’s definitely time for a rethink).
 
I paid up in full for the time I spent there, and then stopped paying altogether as I consider the whole arrangement to be unfair.  I live in the UK and pay £31 per month for my water and £138 per month for my gas and electricity – that is a total of £169 or around €192 per month. The residents of El Pinet voted to pay 70 Euros per month for all of their services and voted for the non-residents to pay €40, even though we use virtually nothing.
 
Worse still, it now appears that the money which we all paid into our Community fund in good faith was used to pay for excess electricity without any notification to us whatsoever. If this is true, then these funds have been misappropriated.  Yet even after all that I am now being told, without any kind of notification, to pay 60 Euros per month and let some unnamed/unknown guy spend it on whatever he sees fit – quite simply this not going to happen.
 
I will make no further payments whatsoever until I am assured that community payments will be used for that sole purpose and that electricity and water fees are apportioned on a fair basis. I use water and electricity for a couple of weeks per year and I am happy to pay more than my fair share towards them - although it will be far short of 480 Euros per year. That said, I will no longer be subsidising the lifestyle of others.

Hi Rolypoly,

I totaly agree with you. I have said all this over a year ago. We are being ripped off, community fees are for the upkeep of joint community areas and not for paying sevice bills.

With reference to Vagabonds reply below, I would first of all like to clarify that I would not consider myself a non-payer. I have paid what was asked of me up until the end of the year as was previously agreed. I have heard nothing whatsever since the meeting in January which I was unable to attend, and therefore quite rightly have made no further payments in the meantime. I have no problem starting to make payments again, but would have appreciated being told what I was now meant to pay, and to whom I was meant to pay it.

As much as I also agree to an extent with Rolypoly and Patandlinda, and also feel pissed off at the lack of clarity, I do feel however that we should all be paying something. The agreement was that we would pay until a set time and by that time we could move forward legally. At this point those who were taking advantage of being residents and using more water etc than was available, will be left to face their own individual higher costs. I am only there about 5-6 weeks a year but feel that unless I make my contribution then what I expect for the 5-6 weeks I go there, will not meet my expectations.

Perhaps those who have the details might do us all the courtesy of communicating what is going on, what was agreed at the last meeting and what is to be expected in the coming months.

If the person who sent the bills to me is as efficient as they seem then please start to show it where it matters. I am not paying another penny until I hear what I am paying for.

I totally agree with rolypoly and profe and to some extent others. Clarity is needed. Non- res MUST NOT be subsidising RESIDENTS AND THOSE THAT LET. In the summer of 09 there were many gardens looking 'lush'. Clearly well watered....mine was turned off and plants died yet I was 'making contributions' that I considered to be fair. Community money has been mis-spent, it was for maintaining the community areas. In anybodies book that is FRAUD, THEFT, OBTAINING MONEY BY DECEPTION.   Do the calculations  270 properties (an estimate) x 60 x12 is over €190 000   for a couple of pools. Lets get real. I would be overjoyed if I was  getting my water gas and electricity here for £65 / m.    IF YOU ARE A NON RESIDENT PAY PRO RATA        IE IF A RESIDENT PAYS €100 / M   THEN PAY €25 FOR EACH WEEK YOU ARE THERE.  THAT IS FAIR.

It looks like all owners are being asked to pay €60 per month community fee, up from €20 per month. Residents are to pay their own water and electricity, €30 per month.

I know that, under normal circumstances, all owners have to pay a community fee for upkeep etc etc. What I would like to know is how the €60 community fee is made up, itemised point by point. It can't be a figure grasped from the air ( or could it ! ).

I think I am missing something here.

Last year the residents paid €70 per month for services and the non-residents paid €40 per month, and yet we ended the year many thousands in debt.

This year it is proposed that the residents will pay €30 per month and the non-residents will pay nothing and we expect the books to balance.

How does that work?

My understanding was that last year as a non-resident I paid 40 Euros per month to San Jose and 20 Euros per month to the community. Residents paid 70 and 20. This was up to and including December 2009.  It might be worth pointing out that payments actually commenced in September 2008. New arrangements including minutes of the EAGM now appear on the Community website.

As far as I am aware San Jose and the Committee has used most , if not all, of the monies  to keep the developement going in other words to pay for ongoing electric and water costs amounting to many thousands of euros. I appreciate that quite a few owners have been advised by their legal representatives not to pay anything. Wake up this is Spain!! Do you realise that if we had all taken this advice the whole developement would now be dead and buried. Those of you who have enjoyed holidays here for the past 5 years or so without any contribution should bear this in mind!
