Firstly I would like to make it clear that I am a non payer of the community fee. On the grounds that this money is not for the benifit of the community, it is for raising money for the electric and water bills used by people that are ilegally living there. Yet when I have questioned this with the administraters I am told that according to the Horizontal Law a debt will be put on my property and I will be taken to court unless I do pay it.    What I dont understand is the fact that I am breaking the law by not paying the community fee, but the people that are living there in homes without Certificates of Habitaion which means according to Spanish law these properties are unfit for human habitation untill they have been inspected and issued with the said certificates are not breaking the law. I DONT UNDERSTAND THIS MAYBE SOMEONE COULD EXPLAIN THIS.    All this being said and changing the subject slightly lets say that the administaters are right and that the Horizontal law does apply to us then I would like to bring to the administraters attention plus the property owners of  El Pinet. that over the past few years owners have made changes to their properties without the permission of the community. According to the Horizontal Law any changes must be voted on at an AGM. This would inclued the instalation of swimming pools, fences, railings, sheds, out side air con units, sun blinds and the glazing in of patios and balconies, infact any alterations to the outside of a property must first seek the permission of the community. THIS HAS NOT HAPPENED and cannot be done in retrospect. My second question is why does the Horizantal Law apply to me but does not apply to the people that have made these changes. On another small point the people that have enclosed their balconies and patios have increased their living area and should be paying extra community fees than those that have made no alterations.    All the above comes under the Spanish Horizontal Law. So my third question is why has the Presidents, Committee and  Administraters allowed these people to break the law at El Pinet but bring the law down on my shoulders because I wont pay for what Im not using.

I WOULD LIKE SOME ANSWERS PLEASE   

And did the administrators have the right to publish a list of non payers in the first place? I dont know of any other community where this has happened. It was called  'name and shame' by some but I believe the whole thing was illegal and they were pushed into it by the usual suspects. And where is the shame in refusing to contribute to an illegal unfinished build? As the good doctor has said the whole thing is still illegal up to this very day and it is ignorance of the rights we have in spanish law which has allowed owners and investors to be railroaded into throwing good money after bad. If I refused to pay my coucil tax here in the Uk because of bad roads and unfinished buildings would you expect my neighbours to come round and cut off my utilities?

I see that my posting asking for answers have fell on blind eyes. I know that some of the committee read these postings, cant someone answer why they are being selective with the Horizontal Law at El Pinet.

This is an attempt by you to try and get this El Pinet forum closed. As this forum continues to expose you and your cronies for what you all are. Illegal residents of E l Pinet  who by way of your illegal occupancy have amassed bills which you want non residents who have obeyed Spanish Law to pay. I and others have brought this to the attention of the people that have the power to act and I would like you to know they agree with this version YOU YOU YOU SUBMITTED the thread you wrongly claim to not be YOURS. You shold hold your head in shame for bringing the whole of El Pinet into disrupte.

Vivendoo, made up of ex San Jose employees have nothing to do with the coh. That is for the council to issue when SJ have done the work that we have all paid them to do.

I do not know who asked vivendoo to take on that task, it is however, for those people only to pay their fees as they employed them.There have been many stories of  ' committee members ordering water ' ,' turning sevices on / off ' ' changing where the water or electricity goes' , residents complaining that it was 'their water' being used by non-res, tourists-renters.  All these are true. It will never be a community as there is now so much in built hatred of those that live there.

What BILLS have you got? You don't live there (yet)?  You have a contract with SJ but don't seem concerned about that, only the fact that we ' non payers' don' pay the bills of others. I am confused by that.
