Hi all,
I had a meeting yesterday with a company in Alicante with regard to the going ons at El Pinet/San Jose. I have been aviced that to be asked to pay for a community fee on a site that has not been handed over to the residents from the builder is illegal and that without COH the properties should not be used.
I was also adviced that without the COH I should not be paying any SUMA on the property and that I can now claim any payments back
as I have not furnished or used my villa yet in acordence with Spanish law

Has everyone received their invoices for SUMA from 2006 onwards. I finally received one large invoice for the last 5 years...with interest. I have queried this through my lawyer.

Just received my bill for 2010/ 2011 for electric and water that I have not used. Maybe its now time that the people who are not going to pay join together and instruct a solicitor to fight this.

My understanding is that if you are the legal owner of a property in Spain you are still liable for suma Spanish Yearly property tax(IBI) whether you have lived in it or not.
House-owners are also required to pay an annual charge for refuse collection etc. Is this what you are referring to when you talk about a refund?

Current situation with the developer San Jose. Approximate build
initiation dates and agreements underway with Iberdrola and the Town
Hall.
The builder has indicated that work would commence in September / October
approximately on the apartments in block M-1 and then proceed with M-11 and M-15.
M-6 and M-7 at this stage do not have a starting date.
According to the Developer there is a verbal agreement with Iberdrola for work to
commence on the required work on site and a signed agreement should be in place
soon. The scheduled completion for this is three to six months from the start date.
The Town Hall in Elche, have advised the developer that they will not take into account
the gardens that have not been completed at the time of issuing the certificates of
habitation, although these will have to be completed at a later stage.
On 11 aug. the above was sent. Note 'Verbal agreements.'

Has anyone noticed that we are being charged twice for the electric and water.
I have an electric/water bill for what I have used during July (and rightly so)
Yet I have a demand for 100/150e community fee for July which includes 80/130e towards electric and water that I have not used, taking off the original community fee of 20e

From what I read into the 'bills'.
The €42 includes the payers , paying off the non payers debts as they see it...I know its crap it is still the SJ account. , That is just as UNFAIR as the Non res paying for the residents. It will be very interesting to see the comparative figures,
As I understand the 'ES' crowd still contribute nothing'.
it is €7 just to have your meter read?. Nice one € 2100 for a days work

You are wrong......My bill has six increased payments starting in Feburary and ending in July a total of 600e which by the way I am not going to pay. I also have a bill for electric and water dated 06/07/2011 - 03/08/2011 which I will pay.
That is paying for the services twice in July.
If people that live at El Pinet think that I am going to pay for their electric and water that they have used, then think again.

Hi Gringo,
I see where you are coming from but like yourself, I was refuring to the community charge going to pay for the outstanding short fall. This being use of electric and water, as I don't go out there I am annoyed at the amount.
Having seen my new electric and water bills, I can see who will have to pay the extra money. If any of my bills shows usage when I'm not there I will want to know why! This message was last edited by 9_Palms on 21/08/2011.

What I think will be the most interesting set of figures is the overall consumption now the meters are in the properties, then remember how many people live there and the disproportionate use. I hear that the air cons are almost silent.
Does anyone have the details of how 'the community' was formed and the constitution?
May well be needed in 5 / 6 years when they get us to court,
Does this mean all get one paid for by whom?
