QUESTIONS ASKED AND ANSWERS RECEIVED FOLLOWING MEETING AT SAN JOSE OFFICE IN ORIHUELA ON 06-04-2010
Present – Bo Gottshalk (Community 3), Chris Keyworth (Community 2), Alec Aspden, Mick Kilburn (Community 1), Almudena Rodriguez, Juan Jose Rodriguez Penalver (San Jose)
PISCINAS - We need at least 3 pools in service for summer this year
ANSWER – Work is to start on the 2 out-of-service pools within the next two weeks
ANTENNA COLLECTIVA - At the moment we can only receive 4 channels on the community antenna, this has happened since the switchover to digital and a check on these antennae is required before the holiday period. Many Spanish property owners like to watch TV during the long holidays.
ANSWER – The antennae were checked by the Engineers last week and are receiving the full range of channels broadcast. They suggest that the fault lies with the set top boxes and owners will need to upgrade.
HABITATION CERTIFICATES - Are these to be applied for by San Jose? Or will the community committees have to apply.
ANSWER – These will be applied for by San Jose on completion and acceptance of the infrastructure works by Elche. This is forecast for 05-05-2010. It is possible that a partial completion certificate may be issued if programmed works for the laying of a new supply cable by the electric company is not completed before this. Both San Jose and the communities will be pushing for this.
ELECTRICITY BILLS - As we are continuing to promote the site to prospective buyers and not be negative, are San Jose going to continue with help to pay these bills until we have our own meters?
ANSWER – San Jose will endeavour to continue helping with electricity bills as and when possible. They are in the hands of their Administrators and any release of funds has to be authorized by them. Legally the Administrators have to ensure that the workers, social security payments, taxes and secured creditors receive their due payments first. San Jose will continue to try and make up payments as and when necessary. Earlier notice of receipt of bills will be sent to our Administrators and the communities.
SNAGGING - When can we expect repairs to the properties to be undertaken. There are several cases of handrails in the access towers having broken away from the supports (very dangerous), rendering is falling off some property walls and several garden walls are cracked. Several properties are also experiencing damp problems.
ANSWER – San Jose are aware of snagging works to be done on site. An inspection of these is to arranged involving Victor (San Jose Inspector), the Architect for the complex and representatives of the committees. The Architect will decide if these defects are covered by warranty/guarantees and instruct accordingly.
METER DEPOSITS - We have already paid 300 euros deposit (as written in the Escrituras) for the meter installations. Has this been handed over to the utility companies or are we going to have to pay again?
ANSWER – Owners who have already paid their deposits will not be required to pay again.
When will work recommence on the partially built houses/apartments and are any scheduled for demolition.
ANSWER – Work will only recommence on the partially built properties when the infrastructure works have been handed over to Elche. Exactly which properties will be finished and which demolished will only be decided at a later date.
PLAY AREAS - Are any to be provided within the development? And if so by whom, Elche or San Jose.
ANSWER – Play areas are to be provided within the green areas by both San Jose and Elche. San Jose are in discussion with Elche at this time to decide who will actual provide them. It is possible that a trade off may occur whereby these works are undertaken by just one of the parties.(San Jose have stated that the green areas/playgrounds do not have to be completed in order for the infrastructure certificate to be granted)
POOL AREA - The surrounding floor tiles to the pool in the apartments are very slippery when wet, can anything be done to them to improve the safety situation.
ANSWER – This area will be included in the snagging inspection with the Architect when the site visit is arranged.
UNDERGROUND GARAGE - When will access be permitted to the garage spaces? Several have been sold already and maybe more could be if they were accessible.
ANSWER – Access to these spaces cannot be given until an acceptable Fire Plan has been agreed and fire hoses etc have been installed. It is also necessary to have the meters installed in this area to be able to connect to sufficient mains pressure for the fire lines.
GAUDI APARTMENTS – Are the owners on El Pinet paying for the electric supply to these apartments?.
ANSWER – No, even though their supply is coming through the existing meters, they have a separate meter monitoring their usage and they pay to San Jose.
