There is still no news regarding the campsite.
I have used some of the information posted here to ask vivendoo some questions about community rules but as yet I have not recieved a reply.

I'll assume courtesy supply is still connected, which is fair surely if they dont live there and havent had the chance to put meters in yet?? Or are people without meters cut off?

Those still without meters could possibly be billed for estimated use until they are fitted? Don't know if this will be the case, but no property should get water and electric for free. Will put the question to the Administrators though.

I agree with JS there was plenty of notice, I also don't live there. Although my questions were not answered about safety and if the temporary supply to the properties was going to be tested.
I did like a lot of other take up the opportunity to have the meters fitted for better or worst though.

It will be interesting to hear what the Administrators reply to that question:
'no meters; no utilities' - fair enough but they cant actually do that because it's still an unfinished complex without COH. What about when M1 is finished eg? Do they shut that down until meters are installed? No.
OR
'people without meters are still connected to courtesy supply'. This will aggravate most of the complex who have installed meters!..
i'm guessing they'll side step the question because they'll be either be unlawful or unpopular either way they answer it. Im all ears though..

Are others finally realising that what they 'have been allowed to know' is limited in its truth. No coh. Not legal to be there, therefore bills for community etc can not exist.. Threats to get bailiffs to brits but not Spanish nationals ??? oh its not legal to live there.
The 'administrators' will give the reply they are being paid to give.

Surely the simple answer to those without meters is that the community pay for them to be fitted so that they can be billed for their usage.............................not the best solution but the only option given the circumstances...................................they will then be liable for the cost of the meterers , their actiall usage and the on going 42euro

I have been advised by my Spanish lawyer that we should ALL recognise the community and work together to find a solution.
We should ALL pay the 42 Euro from now on (personally I am not paying for any arrears) and obviously our individual metered utility usage bills.
The administrators (vivendoo) will represent us and seek legal advice in moving us closer to obtaining our COH's.
The time as come to stop playing us & Them games, you have meters and 42 Euro per month towards getting the site finished is nothing................just give it go for 12 months............................its £550 quid worth a punt surely!

My spanish lawyer has given me similar advice about the community and paying.
My understanding is the payment of €42 (community charge) is going some way to paying off the oustanding debt!

How many times have we heard pay this, pay that and we will get our COH. I think its a load of B*****KS(another word for rubbish) The COH should have been issued at the time of purchase and San Jose knew this. They took our money and run. This has been going on for six years now and without the COH we cant sell it, we cant furnish it nor use it ( legally )
This 42e is just another way of getting money from us to pay for outstanding electric/water bills that other people have used. Even with the meters fitted there wont be enough money in the pot to pay the bills as we all know that some people have not paid for meters so expect more power cuts
As for to quote ~ "the time has come to stop playing us and them games" you must be joking have you ever had your water or electric turned off by a resident, well I have and I know by who. SO WHAT GOES AROUND COMES AROUND but when they least expect it. Dont get me wrong this is not a threat, its a promise.
Us and them started in January 2010 when non residents were expected to pay for residents electric and water that they used. If you want them to stop playing us and them games THEN WIPE THE SLATE CLEAN AND START AGAIN.

Everything you say is true. Witnessed such events myself. Even heard people being happy at the prospect of turning properties off {illegal} Whole sections turned off at the behest of one.
It started years ago with 'just pay €20 a month you will get you coh in January', although a year was not given.
There have been several attempts to get meters. It had been described as impossible without coh in 2009. Clearly lies.
The horizontal law describes ' common elements' as being communal. I agree. If you have communal areas you pay for them. Water and electricity was not communal. It was also SJ's contract. We are told this all the time
A while back I argued that pools should be for owners. Some disagreed, possibly because they 'let' their property.
An email from a friend told me that a mini-bus load of kids turned up with their costumes as one of their friends was renting an appartment.
Not what owners expected.
Divine I, the 'fee' is about paying back the SJ debts NOT paying for what is being used now.
NOTE THE OWNER OF VIVENDOO WAS EMPOWERED BY SJ TO VOTE ON THEIR BEHALF. J H WAS ALSO EMPLOYED BY SJ.

Yesterday I received an e-mail regarding the campsite. In informacion it has been agreed it isa good idea by the Elche mayor. What a shame it will not be outside her front door.

I agree we should not be paying for SJ's debts or the debts of residents, and I will not be paying for anything prior to the new administrators being appointed, effectively wiping the slate clean.
However like it or not (and I'm in the 2nd category) I've been advised by my lawyer that what the committee are doing go forward is legal............................as long as they operate it professionally.........i.e. resolutions, agends, proxy votes etc etc..................and so far the new ones have.
Therefore I can either ignore this advice and carry on not paying (the consequences of which will probably be minimal as the commitee haven't got any funds to pursue debtors and they must treat ALL owners the same i.e. regardless of what country they reside in, so dont worry about the fact its easier to chase debt in the UK than elsewhere) or I can start paying in the hope and yes its a big hope and yes I've heard it all before, that we are starting to see a little light at the end of a very long tunnel!
What are the alternatives? Wait for SJ, Iberola & Elche council to sort it out.................yes that would be my preffered solution also, but like many other non residents I would still like to visit and use my property for a few weeks per year and if that's going to cost me 42 Euro per month plus paying for what I use in electric & water in my opinion it's worth paying................we may even get 3 well maintainted pools, some street lighting (security) and if water pumps fail which they do, a few residents that get it sorted..............as no one else is bothered.
What constructive alternatives are you suggesting?
I appreciate staying away and locking the place up until COH's are isued is an option, but if everybody did that would their be a site left? who knows...................
I urge you ALL to install meters and pay the 42 Euro for the next 6 or 12 months and see what happens, write to Vivendoo asking them to verify the make up of the 42 euro (as this hasn't been agreed formally until the next EGM or AGM) and tell them that they can sing for any outstanding debt.

Interesting comments about payments etc.
For all those who like useless information I have just calculated that from October 2008 when the fees were first introduced until July 2011 non-residents would have paid a grand total of 2120 Euros. 740 Euros of that total cover the period prior to January 2010 when no invoices were issued.
Regardless of the politics it would be interesting to know how many owners have made no contribution whatsoever since purchasing their properties in 2005/2006.
However, this is all in the past and I agree with DI that all owners should now pay for the meters and utility usage.

If it helps anyone we (3 to 4) used over the month about the same as in the uk. Air - con was on as necessary as was the tumble dryer on the day we departed. 14 on water meter, 403 on the electricity. That is about €75 .

Regarding the capsite.
I know it will be opposite us and frankly I don't want it. That aside, I was at the 'meeting' and know what was said in English and Spanish.
All I will say to others who may have future issues is that around that table were some people I would not trust at all.
There are others on this site who have given opinions and been mocked, but I would trust them more than some of those I sat with that morning.

Can you remind me where this campsite is going to be? I understand there will/maybe access issue through our residence. Maybe use our pools?
I had just had a bill for electric and water, as I haven't been out there for sometime it was €0 for electric and €4 for water. Either there is a tap dripping, a leaking joint/pipe or someone is running water off. No, the irrigation is not on. Things will start to grow and I'll have to cut things back when I go out there.
