Thank you leomac, I hope that the new mayor pushes things along. I believe that all the commercial units are sold now so hopefully we'll see a site with facilities soon.

Hi,
not heard about the commercial units other than a rumour that San Fransisco bar bought one but I do wonder how anyone could make money there as most of the time, apart from August, its like the rest of spain - a ghost town.
would be nice to think it could be a thriving community but even some of the spanish use it as a weekend retreat.

Its sounding positive now, we are hoping to out again in September. We were hoping things were at a stage we could get the habitation certificate.

We would like to inform all this forum members that we have won a case that creates an important precedent for many Herrada del Tollo and San Jose purchasers who voted in favour of the creditors's agreement, and face now that Banks rejects the payment of the guarantee claiming that same release and payment extension period agreed with developer apply to bank guarantees.
Valencia First Instance Court nº 15 has finally supported GM LEGAL EXPERTS arguments, ruling that the release and payment extension period just affects the developer, but don't apply to bank guarantees.

ANOTHER COURT RULES THAT RELEASE AND PAYMENT SCHEDULE AGREED ON MEETING OF CREDITORS' AGREEMENT DON'T APPLY TO BANK GUARANTEE
Although this is a controversial issue, every time more and more Courts are ruling that release and payment schedule accepted by the purchaser on the meeting of creditors' agreement don't apply to Bank Guarantees.

SAN JOSE INVERSIONES Y PROYECTOS URBANÍSTICOS SA GOES INTO LIQUIDATION
Later in November 2014 San Jose Inversiones y Proyectos Urbanísticos requested the liquidation of the company, claiming that there are unable to meet the payment scheduled agreed on the meeting of creditors (80% on deposits, within 5 years: 10% on 2015 and 70% on 2016).
The Court has accepted their request, so the company has gone into liquidation, and creditors' agreement is not longer valid.
As you probably already know, San Jose did sign generic bank guarantees with different banks to cover deposits paid for most of their developments (El Pinet, Albatera Golf...). Now that San Jose is being liquidated, our opinion is that the only realistic way to get deposits refunded is to sue Banks. We are aware that many buyers were reluctant to do it because they accepted San Jose's payment proposal. But that's not longer a problem, so we encourage purchasers to seek for advice. IMPORTANT PRECEDENT FROM HIGH COURT: DEPOSITARY BANK IS LIABLE FOR BUYERS'S DEPOSITS, ALTHOUGH ACCOUNT WASN'T CALLED SPECIAL AND INDIVIDUAL BANK GUARANTEES WEREN'T GIVEN
A major step has been taken towards the application of 57/68 Act: new High Court judgement states that depositary banks could face liability no matter if the account wasn't called special and no individual bank guarantees weren't given.
This is a major achievement that reinforce the advice about this matter that we have been given to our customers through the years, and could involve the end of the nightmare for many buyers who still are under the belief that there was no hope to recover their money.
