Tony shut up shut up shut up. many solicitors are doing lots of proactive things. To tell people to do nothing and just wait and "not waste money"is insulting.
I used to think that you were completely stupid tony but the more I hear you spout the more I think that you are actively seeking to manipulate owners - but I still think you are stupid besides

Now understand this My solicitor has advised me to await court date at which time |I will be given a straight choise either to carry on with purchase or become a creditor by waiting it will not cost me more money there is no advantage for me as a purchaser who dose not have a BG to go and become a creditor for getting my money back now, as I will not be awarded special status so my option is to wait

If that is the legal advice you have been given then that is our choice. Some of us have been given very different advice and are choosing different paths.as our costs are fixed regardless you cannot argue tat this is for the benefit of extra costs. This is called proper and proactive representation.
heed your lawyers advice and we will heed ours. But stop spouting and telling others what to do

Nice to hear from you and the very very bad advice you are trying to give people. I suggest that you explain why it is a sensible idea for people to spend ,money taking legal action when they do not need to. If SADM does not go ahead then it does and they do not want the property they can then become creditors at no cost.

It depends Tony about when san jose go bust (which they will and technically are) what creditor status owners will have . Now I have heard you comment about the groups and which you see us fall into but surprise surprise there are some quite talented lawyers on the case who disagree with you and I am compelled to believe profesionals rather than yourself. No offence meant but you have a very different definition of fact to the majority of people I know
many of us are paying a percentage of any monies recovered and therefore there is NO added cost to legal action bar some very small legal clerk fees which are well worth the outlay.
In answer to your question I am not giving advice. I believe people should get their own advice. I am merely discounting your advice. there is a big difference in the two.

Tony Because if you wait you will be an ordinary creditor if you act now have the contract reversed then you can then become a privileged creditor and your deposit protected under consumer law and be paid first with the proceeds of any assets that SJ has not yet hidden .I have said before all SJ are trying to do is off load 1st line creditors .Don't know why Almu mentioned the Russian buyers they are clearly out the picture now as for the American company she mentioned that is highly unlikely to be true .

No! Read linda's report and then that of the update. If 1 purchasers gets that status then we all get it, so advantage negated. And where is the money coming from any way you still have not proved it is there. Why are trying so hard to get people to do things that are not to their advantage?

when san jose go into liquidation their assets will be sold off and their relative worth split amongst creditors dependent upon their status. One advantage does not equal everyones. And again because Linda has something in her report it does not make it FACT (no offence meant Linda) and because san jose and the administrators tell you something it does not make it fact. FACT

Why are you hung up on the account with the money in?
Let me tell you something...this may hurt so sit down..
There probably is not an account with any money in........if thats the case the builder is not playing fair are they......so if they dont play fair, they will not get finance to carry on building.
Heres the deal Tony.....what you do is you wind them up, stop the payroll, take the mercs back and seize the assets.
Then you add it all up, and ask your lawyers to see if you have a claim against the way things should have been done, lawfully...then you get what money you can, as prefferentialy as you can.
Then you go stick it in a bank that has a fair chance of surviving the 3 day period it takes to cash the cheque......then draw it out and stick it under your mattress.
Then you close the website down and say last one out turn off the lights

Hi All,
I spoke to my solicitor on the 'phone this morning and he said that he trusts the information given to him by the court appointed administrator, who is a solicitor. He has been informed by the adminstrators that there is a LARGE number of purchasers who are waiting to see if they can have their properties.
So to those of you who deride and knock those of us who want our houses, kindly let us be, especially those of you with BGs or who are no even purchasers at SADM.

SJ are in discussions with nvestors to take over the parts of SADM where the people who want their houses, are proposed to be built........as i understand it.
Your post saying that there are a large.....sorry LARGE, number of people wanting to know if they can have their properties, is daft.......what do you mean?......everybody has been waiting to see if they can have their properties.....everybody has been waiting to see if they can have their money back.......nobody is letting anybody off the hook till the fat lady sings.
What exactly is your point?.................

666 appears to have a very blinkered out look ....I have said that those who want there money back can only get it if there is money in the company to pay them.....That happens if people buy their houses.....The 2 are not mutually exclusive, one supports the other.
Apart from that this is the I WANT MY HOUSE strand , and as i posted ealier my lawyer said that he was informed by the adminstrators that a large amount of purchasers wanted their properties. What is the problem with that? I would of thought that would be good news for those who want there money back. I would suggest though that before deciding to have your money back, check the time frame for repayment and for completion of your property.

Im giving up trying to explain the economics of the situation to you..............you have no concept of the position this construction company is in.
You seem to think the profit fom a few houses will support the completion of the site and the paying back of the lost deposits.
Cuckoo....cuckoo....cuckoo...........It wont......you have to seize the money thats left and let them start again...smaller, slimmer, better.....or someone else take it over...the whole thing is a millstone to the builders neck as well as to ours.
We have to cut and run with whatever money is left.
Whats this about ...check how long it will take to get your money back?....nobody knows that answer.....doh

i have been patient with you but you are being very daft. There is no money , so how can you take it and run? Those of us who are purchasers at SADM would like to protect our hard earned and hard to come by money and get what we paid for.....a property.
