Hi Brian mags...and Tony

Its a lot to digest is 81 pages of Spanish, legal and technical information from an administration.  I find that documents in English, like from communities and local government, solicitors and the like, in my mother tongue, are hard to understand and can very often be ambigous.

So while you are waiting to deliberate on the 81 pages of extended dialogue, can i bring your attention to the 2000..........(yes thats 2000......two thousand)  pages of creditors, thats people who are owed money.

Thats 81 pages of what you can argue about............and 2000 pages of what has no need for argument any more....its official.

I think its close to game over chaps

 The document is a lot of hype really. Its 81 pages of nothing that state that HDT can only stay afloat if santa Ana goes ahead but that they cannot do this without close to 5 million (with a further 1 million to pay legal fees to continue to expropriation of the land) They do not comment on any possible refinancing. It tells us nothing that we did not really know (like many public sector reports! No wonder TONY liked it!!!!!!) except interestingly enough the report states that part of its viability rests on owners not cancelling their contracts -  a secondary report will be presented following reactions regarding numbers of clients who will be resolving contracts

Therefore believe nothing about what Tony states. the reason that he is telling you not to resolve is that it is in HDT's interests for you not too. NOt your interests

It talks about a scaled down version of the site then the same old CRAP about having the golf course released at the same time as the first phases. (This is the same golf course that will be on the land that they don't own and the land which they don't have planning permission to build a golf course on)

It mentions that they have no cash (33k ish by memory - possible criminal charges then) and that they have assets worth more than their debts - based on current prices by "independent" cost advisor Every creditor plus the revenue is down as an ordinary creditor and there are hundreds and hundreds

How Tony can you see that this answers any questions whatsoever or is slightly positive? HDT have had seven month to try and find refinancing and have not. the situation is considerably worse now than it was seven months ago. 

TONY no interpretation in the world that exists will give a positive slant on this report

Not that I'm a vindictive person usually however joannie666 demonstrates a powerful point - "the report states that part of its viability rests on owners not cancelling their contracts " I for one have suffered enough at the hands of this organisation and after their appalling display of trying to oust us from our temporary homes at such a dreadful time of year..............if the least i can do is add my name to a list that potentially could bring down this company.......then i certainly WANT MY CONTRACT CANCELLED !

Hi Bob

Im with the San Jose Inversionnes administration, they have my money.  The administrators agreed to a sale of some of their assets yesterday.

They have the means to trade on and will be handing over properties, bulding, and have re-financed through their asset stripping and selling.

Its a decent result for that administration (potentially)

I think the truth of this whole situation can only be seen clearly if the SJ report  is compared to the  HdT report.It then becomes quite clear what their game plan was .There had to be a sacraficial lamb so to speak .The question is how was the money used where did it go and was it past between the two companies  ,was it moved around to make one company more viable .Do SJ want rid of the white elephant and all the problems that will go with it .Which branch of the company meant more  to those involved in trerms of  family history  branding  , reputation,and perhaps even emotionally.We all new that finishing  El Pinet was a priority for them but why ? JA


 

Just and add on to the bit in the report about the viability depending on purchasers not cancelling I think this is ridiculous surely it first and foremost depends on refinancing .I think this was put in as a cover to what the actual game plan is they can now gain some credibility by saying it was down to purchasers it did not go a head just as Tony and SARC are sure to say .Well I say Tosh.

I agree with you on this one and that is if SADM does not go ahead, then the creditors which pulled out will be blamed but i suspect that few of them if any like ourselves will not have a guilty conscience about it. I have always said that i would have prefered a scaled down version with only 1 golf course and a site perhaps half of the original size. I certainly would not be happy living there if it was a quarter or an eighth of its original size, which would seem the case if it went ahead  now with only a small percentage of people willing to continue. Most people do now seem to want their money back, so the facilities that would be given for only a small amount of people would not be very good. So is it viable? I personaly doubt it. Especially as there are so few buyers around. Its very sad like the whole issue, but there you go.

Hi All,

I would like to share the information with you all, that we shared with the SARC membership yesterday and it is posted below. Firstly I would like to deal with a couple of points:

Firstly I think that you will find that the majority of purchasers want thier properties, there are still more purchasers joining SARC and the  I WANT MY HOUSE campaign.

Secondly, the issue of down sizing is, I believe  only a possible short term stratergy for the development and I truly believe that, all being well SADM goes ahead that other people will want to purchase there. The reason for this is that it would be better to purchase on a development that had gone through the supervision of the court and is in the recovery phase rather than risk a development that may problems in the future and not go ahead.    

 

Dear All
 We  spoke to our solicitor today, who is also a Barrister and he has viewed the report but will give it an in depth read over the weekend,take notes and then seek clarification from the administrators and then give his clients a considered opinion.  He said that with a brief view that it looks positive for SADM being refinanced, that there are a lot of assets, little debt, which is mainly our deposits and he thinks that SADM is very attractive to investors. He also said that information concerning the refinancing negotaitions could not go in the report, as it is a public document and the negotiations are confidential commercial matters.
 
So please be patient and have a good Christmas. If we get any news from our solicitor or any other source we will let you know asap. We personally think it is looking positive but we want to read the document and for every one to be able to do the same .....

Tony and Brian, are you able to section yourself or does another Doctor need to arrange?

The quicker the better please.

 

1)name the barrister,

2)is the barrister in the uk,

3)has the barrister the first clue about spanish property,

4)does the barrister have history on the san jose previous,

5)why if san jose are flush with assets are they trying to evict santa ana owners who have moved to spain - not been able to move into house due to san jose incompetence - then offered apartments to sweeten them - then try and evict those buyers.

6)Did the barrister go to same doctor for his lobotomy.

 

If you and brian persist is lying to hard up ripped off buyers can you please put your full names and home addresses on this forum so that everyone else can take the appropriate legal action against you two morons

                     2. Our barrister is in Spain

                     3  much more than you do

                     4 He is dilligent with no conflict of interests

                     5 we are talking about HdT not SJ

                     Once again you have the audacity to call me a liar we / I have done nothing Illegal and if you read anything correctly we always tell people to make their own decision we do not tell anyone what to do we let them make their own choices.

 And I will not give my address out on line as it is not required. as for lying, are you looking into a mirror when you say that?

Maybe when a fully translated version is available then we can discuss this with a better Knowledge and understanding why try and rush people into making decisions when they don't have the full facts ? I certainly would not advise anyone to make a decision with out having seen and read the report translated completely and accurately would you?

1. When Tony /Brianmags  /SARC refer to a barrister they mean a procurador .

2. This is the same in Spanish as we would call a Barrister .

3. The rest of us undesrtood  (months ago) that  this is what we needed for certain procedures within the Spanish  court system .

4. Tony  /Brianmags/Sarc  have only recently discoverd this which is why they keep banding the "Barrister thing "about .

5. They do not realise that other purchasers have good lawyers and that we concentrate more on communications with our lawyers than we do with SJ/HdT .Who have lied to us repeatedly and continue to do so through SARC.

6 It therefore stands `to reason that SARC are ill informed morons as I have been saying for months now .

7.It also stands to reason that SARC/Tony Brianmags et al are being fed a lot of bull by a "Barrister " that SJ/HdT put them in touch with . Will they ever learn !!!!!!!

8 .It therefore stands to reason that anyone who is listening and believing what SARC have to say is in a very bad position .This has concerned me from day one and still does .

9.Yes Tony /Brianmags /Sarc  are morons

Question is if  ? Tony /Brianmags /Sarc  are so sure of getting their  house's and there was no need to do anything . Except support SJ/HdT and wait ,Then why did they employ  a  "barrister" .While telling others to do nothing ,and not to throw  good money after bad .Many have taken ther advise . Hi FIN

Correct me if I'm wrong (no doubt somebody will), but all Julie Anne has been asked for is the translation of a document in the public domain, i.e. the "inform", as she now has that in English.  Other people are getting it translated, however the suggestion made by some was that the SARC translation would be deliberately reworded to suit their aims.  If Julie Anne has a straight translation, therefore, would she mind posting that here?  I don't think anybody asked her to post information provided by her lawyer.
