Can I just ask you may well want your house and so do I if there is a choice, but what are you doing in the meantime, are you paying a solicitor to be put on the list or not?  My head is like the poppyfields at the minute!

Hi Sigranger and Malc and Fredhead,
we are purchseres for the UK just like most of you and we really beleive that we can influence the outcome of the administration process. We the purchasers are the key, we are the ones with the money that will make that banks think about profit v loss. If we speak with one very loud voice we can not be ignored, we have the combined spending power of almost 200 million Euros and money talks! it is time for us to work together and become actively engaged in the developemnt of SADM and have a voice with the adminisrators.

As for the creditors list that has been given to the Courts by San Jose you must maake sure that your name and your deposit is listed. The solicitor who acted for you with your purchase should be able to do this for you. Another member of the forum kindl sent the web address for the Spanish department listing the creditors. Its in Spanish but if you send the web address to your solicitor he/she should be able to check your listed and for how much. You need your deposit recognised so you can then decide whether you wish to purchase or try for the money.

Hi All,
I have found some one who will traslate the standard letters into Spanish, so all being well  the letters will be avialable soon and i will get names and addresses of where we need to sen them to
.
Presently (and it is growing) we have 16 who have declared  " I want my House "  and we speak at present for approximatly over 2 millions euros of purchase power and 900,000 Euros of deposits
We want our properties and we are coming together to createa financial pressure group and make it happen.
Remember that the administrators want to save San Jose and we need to get our message to them, the more that join and declare " I want my House" the louder our voice, the more financial clout we will have and the more they will listen to and be influenced by us. 

Why spend money to get your money back when we can all get together and demand our homes?

Join us, your nieghbours to be and fight for your property with us!

Oh, yes... you are fully right. Thanks for pointing that out.

We have been so involved in contract cancellation rights lately that I just left that other option out.

In that case, even when it is possible that the development will go ahead just forthe decission of administrators/company itself, it would also be advantageous if you buyers, make a direct statement/petition to administrators in that sense together with the registration of your credit.

Can anyone help me with a question that I have?  We were issued with a bank guarantee when we purchased our villa in SADM.  It has gone past its date and we wanted san jose to update it for us.  At this stage we were told that they were standing by all bank guarantees, as long as they were not presented to the bank, they were still valid.  They said they wrote and informed our solicitor(which she said she never got).  
Now when we heard about all of this we contacted our agent and solicitor and as lots of you know, nobody at this stage was aware of the problems and only til we told them did they start digging.  At the weekend we recieved an email from our solictor saying they needed to get our names on the creditors lists and because it was courts in Alicante, they needed to pay for solicitors and barristers there costing 1500 euro.  Now my question to all those who currently do have bank guarantees is, should we not already be down on a list of creditors by the company?  A bank guarantee is like an IOU if everything goes wrong (like now).  If this is the case why do we have to pay to be put onto this list?
I agree that the law firms are rubbing their hands together and already planning how they could spend our money.  They do have information to offer, but are they looking in the best interest of those who still want their house?  Or just what will pay them the most money?  Leaving the question, how much information can we take from them?

We too want our house, but only as part of the whole package, i.e. Golf course, hotel and all other planned amenities.  Without them  the investment would  be very diluted as the holiday rental would be much less appealing.

We would also like to have our house built as Jumilla is a beautiful part of spain to live in and i am sure that is why so many spanish have also bought there.

I am very confused.

Pilar advises that we are automatically creditors and will find our names on list at Court, solicitor advises that we need a barrister to ensure our name is on list .......???

I want my house - and am therefore prepared to wait until built - so why do I need to pay a barrister to put my name on list?

Options:

1.wait till house built if administrators continue to trade - OK
2.wait till go bust and get 'something in the pound' as a creditor
3.pay barrister to ensure my name on list, then if house is built I have paid a barrister when not needed
4.pay barrister to ensure my name on list, then if go bust, get penny in pound or whatever and lose even more paying barrister

My husband was talking this morning with our spainsh solictor.  She said that you have to pay for a barrister to represent you in court even though your name has been put down as creditors.  For this we have been quoted 1500euro as the solicitor and barrister has to be hired in Alicante where the courts are.  We said that we still want our house and her reply was that the main objective for us at the moment and what we need to concentrate on is getting our name down and getting out money back.  The company still seem to want to go on with the build and if it works out it is a bonus and we can go through that process but at the moment getting our deposits back needs to be a priority.  I too want my house for value for money, location and amenities there was nowhere else even came close.  If this falls through I do not want to settle for somewhere else but what if it doesn't happen?  We still don't want to have money floating about comewhere in Spain doing nothing for us.

                                   We too very much want our house. However, we are both coming up for retirement and as has been stated do not want to spend the next 5 or 10 years living on a building site. We want to live there with full amenities. How long will it take to sell the remaining 8000 or so properties? We went to the meeting in Birmingham on Sunday, and out of 70 people who were there [ representing 120 people] only a handful were in favour of having their property, the rest just wanted their money back. As we have paid 110,000 Euros already, and mortgaged half our house to do it, we need to do what is best to protect our investment,

Hi Lornab,

It costs nothing for your solictor to check on the website to see if you are on the list and if your deposit is listed corrcectly! I am disgusted that the solicitor who you have all ready paid to do your house purchase can not check that! Tell them to check with the Court if you have been listed , even if it is the cost of a letter it is far cheaper.

The solicitors want our money. I have told my solicitors to get the inforamtion for me regaing the listing and the deposit, i am the client and I am paying! So why Barrister etc. to start a case to get your money. Oh yes and they have the power of attorney and off they go........

A good solicitor truly acts on your behalf and gives you the options and does not lead you in to their preferd route. In the past adminisatration did lead to Court action to retrieve your money because the company could not be rescued but the law has changed and it can now. So how can solicitors make money out of our circumstances?

And as for the Birmingham meeting I was there! I heard them say it would take years to get our deposits back and if after we had paid 5% and it was going on to long we could allways pull out. That did not inspire me.

Every one think very carefully. There are people out there who just want our money. How long will it take? How much will you get back? What do you do in the meantime?

Yes it is very scarry but think very carefully wait and see what the administrators say then respond or go for legal costs now?

Me?   I want my house and I believe that the more of us that say that the more likely it will become.  i have now found the Spanish purchasers forum and contact details for Spanish and English papers and i am going to inform them that I want my House and ask them to do the same!

Hi.....we are on the Albatera site as you know, we were putting deposits on Santa anna on two Tulipans as off plan investments.  We decided not to because we couldnt get our heads around the size of the place.

Can i ask how many properties have deposits, how many built and how many still to come.

Also the commercial infrastructure, what is there now?  how many shops, pools, etc.  Im trying to get to grips with what is involved in the campaign to get your house?

Can you fill in some blanks for me please?

My point my friend is this.

If i want to re-locate then we will make a decision based on facts about where to put our money.
Albatera is a dodo, i need to find out if they are all dodo's.  Im trying to find out if SADM has WOMD (in financial terms of course)

You seem to be saying the administrators are the cavalry coming over the hill.  Like in the UK, administrators, insolvency practitioners, liquidators are interested in fees......and they are big fees, a lot bigger than abagados.

 I dont have to have a plot on sadm to have an interest on here, i have an interest in the company that is building that development and it may affect the outcome for me too.

Thank you for a speedy reply.

I am sorry for your loss at Albatera and I do appreciate your opinion. However, I and Brianmags went up to SADM and saw the trees planted around the contoured ground of the golf course. In April i was up there and they were out watering it.  They have commenced the build and down by the main road they have started putting in curbing and in the ones in the center they have placed plants.

The administrators are not the calvary they are independant rational people who will audit the books and looks at the projects, the projected income and payment schedules for debts. They will try to keep the company afloat and there is a political and economic imperative, is this why the law was changed in Spain. To enable buisneses to over come what can be short term and transient problems.

At this moment in time we do not to be made to rush into legal action we need to try to influence the process. Yet again as mentioned by Maria. There have also been some other solicitors who have said that the company could be saved and projects resumed. Is it not better to try to influence a positive out come rather than rush down a route  that costs us money and has no time scale or gaurantee of the financial outcome. it is most important that people ensure that they are on the list and the amount is correct. 

For those who are purchasers at SADM we need a voice and why would any one try to prevent us putting a united voice together. 

Any news on getting your money back from Albatera yet? It did say in last weeks CBN that it may go ahead.

Some people are joining the campaigne by sending me a private message. We now total 27 properties.
This gives us 3.6 million purchasing power and 1.53 million deposits to use as leverage.
