SURELY a man of such intgreity and standing can go to an internet cafe, or better still whilst he is consulting "his solicitor re: libel / slander of his character" he could send it from there?

Thanks for your kind words in the posting (and yours Tony). It felt like a blow too many this morning reading it in black and white. Ive since had a lengthy conversation with my Lawyer this morning to clarify the Legal position regarding suing. Linda you didnt miss anything at all, that was precisely my view, and no they cant be sued privately with an empty pot (pity). We are all in this together as Creditors as we knew. It would appear that it isnt a private suing, but im now registered as a Creditor in two Courts for the both properties they havent completed on! I do have trust in this Lawyer and know he and his team are doing their very best to find a solution to secure my money on an alternative property.
I pushed the question of viability now of SADM going ahead. As far as he is concerned at this moment in time, their assets are down to around 200m from the original assessment of 300m given the current climate. He is perfectly willing to accept that they are trying to sell off the 'white elephant' as its now called and it maybe someone offers a very low figure which would then enable them to pay off their debts (?60mil was assessed). If the land was sold, new Contracts would have to be re-negotiated by a new developer/investor at new prices and conditions of sale etc. Im sorry tony/brian, categorically he has told me not to wait in vain as it will be a long drawn out process if it happens at all. They are very keen to keep current purchasers sweet but have nothing concrete to base anything positive on at this time. I know these comments are opinions, but I am not paying someone I wont listen to who is on the ground and speaking to SJ on a regular basis. It could be a long way off if ever and doesnt want me to take any more risks with this Company.
Some sales on Contracts at Playa will and are going through very very slowly. We fight on for now til the fat lady sings (thats me by the way comfort eating Brie!)

I have said for some time, best thing is to get them out of concurso, so they are not protected...wind them up and get the assets realised and the cash seized.
Otherwise it will be put into another....'safe place or venture',,,,,,,,,,,we will be the ones to suffer, not SJ..

Just picking up on your post, now i have got home.
You said the administrators cant even complete on contracts post VA.................what does that mean please?
I ask because, and this gets worse and worse to me.
If they have been writing out contracts after voluntary administration, it makes an absolute mockery of us to be honest. This was exactly the point i was making to 'i am going to my soilicitor' Tony and Brian last night. If anyone knew of trading during the VA..they should report it and have it stopped.
Has SARC been aware of this practice?
Is it just me that understands these implications, please tell me someone else realises them.
Or have i read this wrong Sal...does VA stand for something else??? Can you find out please
Also Sal.......if you have a new contract, written during a creditor protection arrangement, i think you have your money back if you have a solicitor who hasnt got learning difficulties.check it out

Hi B,
It was my short form for Voluntary Administration . We had a meeting with Pilar on the Thursday morning 8th May and an agreement of exchange was done. It then had to have the approval of her boss (who had already agreed in principle but wanted to check it over. It was due to be faxed to my Lawyer on the Thursday. 9th. Both my lawyer and I kept chasing Pilar and were fobbed off as to the delay (she hadnt had time to read it!!). The next day Friday 10th we read the Costa Blanca news and the article on their financial state ! They had to have known when I saw them and this alone took away every ounce of trust. They are willing and do lie to your eyes. Pilar was simply doing what she's told. as an employee and I dont hold her responsible , but it was disgusting behaviour, tho now not unsurprising. They knew I was flying back on the 14th and it was finally written and faxed to my Lawyer on the 14th after numerous phone calls and standing in their HQ Lobby! I had done a Power of Attorney while waiting for the Contract as he had a very bad feeling about this Company (understatement now - but also proved itself). So it must have been during the period of creditor protection if indeed the 14th May falls into that category. This is why then there was an long delay when we all had to wait for the appointment of the Administrators. They then wrote to my Lawyer in agreement to the exchange having studied it in July. Now this....
They have to sell all empty properties .. Lawyer said they had no legal right to sell in this period, but he still wants this for me than to wait as a general creditor and most certainly pin any dreams on SADM.
Any advise is welcomed always will be!

Sal So sorry to hear of your plight .Yet more disappointment it knocks you for six every time .
I have lost count of the times SJ have offered me false hope with lie after lie followed by devastating disappointment.
A lot of people on the forum think I have been too hard on the SARC leaders and yes at times I was and still am very rude to them . Believe it or not I am not a rude person but felt it necessary to try to save others from the heartache I have been through so many times because of SJ 's deceit . It made me so mad that SARC were trying to make others place hope in such a dodgy company as I knew them to be , others who in my opinion had been hurt enough.
All along I new SARC were being lied to. I could not believe they still believed what SJ told them .
I have received 3 lengthy e mails from my lawyer to day and I can assure you the feeling among the legal professions dealing with all of this is not the rosy picture SARC or SJ would have us believe.
Things for SJ are far from good and the last news letter they released is as we all thought (except for Brian mags and Tonymal ) is indeed just SJ trying to keep us all sweet . As I said I have been dealing with SJ for 5yrs and have seen many of these news letters over the years in fact I have about 6 of them regarding El Pinet . SJs rosy newsletters have on many occasions filled me with joy then let me down like a lead balloon.
My Lawyer has also informed me today that the bank has refused to pay out on my BG ,surprise surprise ! so he is now taking them to court,more expense .
Just a thought oI had today did anyone get documentation from their lawyer ie proof of being registered with the court as a creditor . I want to see every single document from now on and have it checked also it does appear there are a couple of guys getting really dodgy legal advice like being advised they will get there house.
I hope we can all start to really help each other now without SARC side tracking every issue .My Lawyer gave me a bit more info but I don't wish to share with SARC. They have insulted me so much and wasted so much of everyone's time and aided and abetted SJs lies . The worst thing they did was refuse to listen to any point of view other than their own or to people with a few more years experience under their belt in dealing with SJ and useless agents. Oh yes then there was that lunch we all paid for unforgivable what ever the Spanish custom ,SARC even got that wrong the custom is to luncheon once the deal is done and dusted looks like dining with SJ was a little bit premature. Can I just say that the last comment from JA reads that it was written with true sentiments, based on fact, and not like some comments on here, which are mis-quotes, puppets speaking words of others, inability to string two words together.
The real unfortunate point is that it seems that JA states facts and has more facts, which could help many, but is relutant to publish, for whatever the reason, because of "the few".
Bet she will end up getting a flood of PMs.

Thats kind JA. The situation we have all found ourselves in has bought out every raw emotion and as we're not able to get justice (yet) its bound to come out somewhere. Face to face it would be debating and your right about sharing information.. its the only free thing we have !
Why in heavens name cant they pay you on a BG? Its lunacy. Im not surprised at your frustration or anger. Years of let downs have that effect.
Dig deep, something has to come out of this. I have to believe it or i'll stop fighting for a solution - and my waist line is suffering from the extra wine to sooth the soul!

Dear all
sorry to disappoint you but some of us work in an enviroment that means that if we are required to transfer a critically ill patient then we stay at work and make sure they arrive safe into intensive care and are settled before going home I have been in work since 6am and only got home now so dont be so smug. I am really fed up with all this stupidity that is going on.
If any of you had some relivant information then I would be greatfull but no you just rant about spelling and gramer like it is going to kill you or corupt you sencabilities. Well I for one know that I have done some good today what about you.

Oh If only it was just about the spelling and grammar .Do you never listen to anything anyone tries to explain .I really cant be bothered repeating my self .Perhaps on your next day off you could read through what people say and try really hard to actually take on board what people are actually trying to tell you. Honestly ! I have no idea how you manage to communicate effectively with your patients .Scary .

Sorry, but as it is a job of work you do and presumably get paid for doing it, also, it is a career that you chose to do, so no pat on the head from me.
It is not only nurses that have to work.
Regarding start time, will be travelling from 5 o'clock in morning, to first meeting.
Yes, it will be profitable, therefore, I am not asking anyone for praise or a pat on head.
I can see where JA is coming from regarding certain things, and I do fear, as I believe some medical notes are still hand written.
