Hello folk, florence was wonderful.  So nothings changed then on the forum?... My case  was heard today by the Judge.  I wont hold my breath for the outcome but nice to know i'm at least that far.  Anyone else's case  been heard yet??

Fin   im not sure if your last post was aimed at me,  im not  trying to scare people off of pm   just sometimes its not right to try and explain/defend yourself to a few and leave all others to guess, i asked JA to say something not demanded (nor threatened)and im not devulging what she has said to me.  But like they say if you want to keep a secret dont tell anyone. In reality you cant trust noone with a secret.

I am posting this again as it got a bit lost

Some good answers from Maria on the general forum .hope we have all protected our investment correctly despite what SARC have been telling us.

Can anyone tell me what happens in the case of a developer going bankrupt regarding any chance of getting money back, when there is no bank guarantee? It is important to take into account  if you have/ have not started a judicial action for contract cancellation. But in everycase, you need to bring a good legal defense ( for your credit being classified as privileged and special) before the Judicial Administrators and the Judge dealing with the company´s creditors meeting.

Is there anything one can do in the early stages to improve the chances of getting any form of financial benefit? Just to bring good legal defense on the special character of the credit to the communication of credits to the Administrators ( that is actually done in early stages of the creditor´s meeting procedure)

What this means is that while SARC were persuading everyone to tell SJ/HdT that they still wanted their houses  and wanted the contracts honoured  they should  have been starting judicial action  to cancel the contracts and have the deposits recognised as special  and privileged. It is too late now should have been done in the early stages of the process .Won't matter if the houses are built but I wouldn't want all my eggs in the one basket  once again cheers SARC I am sure many will  thank you  for that advice in the long run  "Not " 
I am not saying SARC gave bad advice wittingly but it was bad advice all the same and many knew and tried to warn at the time.   JA

Yes FIN things are moving on . Just had an email apparently last week judge asked admin to get a move on with reporting back as  Spanish shareholders are kicking up a fuss and want to see movement  of and where abouts of funds as part of their legal proceedings . JA

Jon G, as I have mentioned before (repeating myself), for obvious reasons, it seems that many are no longer prepared to share informations, as facts get shot down by some. It has become a case of them and us, and it seems that they are now getting some results they hoped for, whilst others still wait for the information that was promised to be published on the other site.

Unfortunate really, as there are many innocent and genuine people out there who are suffering.

Just read a  couple of good  news articles one saying debt of SJ./HdT was 209 milion Euro other saying  50% buy out by Russian group was rejected by share holders .Every time I try to post , the articles return to Spanish I am such a techno dummy .will keep trying JA

Jon G, I wholeheartedly believe that is true.  My Lawyer has been trying for two weeks since SARC's claims to refinancing to ascertain the details. Categorically it was a no go. Just more wishfull thinking.

Unfortunately John G I think you are right It is  all down to greed , over speculation and dishonesty  . I was on a Spanish web site today ex employees of SJ ,share holders and a few who still had work and were supporting the company position as best they could. It was really sad guys with young families ,mortgages and zero income not sure how good the Spanish social security system is but my heart bled for them at least I still have a job and a roof over my head .
The dream is well and truly over but there are ways to get something back out of all of this .The important thing is to get smart proactive legal eagles if it is possible to find the funds .My pot is dwindling but  I am  still hoping for a quick result . 
I used to have my own business in the UK until I sold it .I have had lots of dealings with Lawyers over the years and always laughed  as at the end of the letter they would always say  " I await your instruction " I guess it is the same the world over they can advise but you must instruct . I have made it my business in all of this to understand all my options and the best chance of success and I instruct my lawyer  it is the only way . Don't sit back and think they will do the right thing,  make sure they  are being proactive and fighting for you . I want my Lawyer to be a stroppy , pushy  bolshy little sh **t that's what I am paying him  for. I don't want SJ ,Admin ,court or Bank to say  there's that nice lawyer  again . I want them to say oh no not this  wee sh**t again  hassle !  hassle ! and more hassle !.
If nothing else they wont forget him or me .We can only live in hope Good luck all .
Yes`what ever you want .Nothing would give me more pleasure than to see those who still want it ,  get their house but it is just not realistic now . IWMMBQ  JA

Hi All,
Despite the hystronic and at time very untruthfull postings the demise of SADM being declared is very premature. Despite your little groups selfish and very unnecessary rantings and attempts to derail SADM it has not succeeded.  If it is not gonig ahead why all this frantic whaffle prior to the administrators returning to the court and a decision being made? Most of you making these sniping remarks are either not purchasers or have BGs, those who do not have BGs are tottaly screwd if SADM folds. There is no money!
The best for all, apart from the nast BG group ( this does not mean all with BGs) is for SADM to go ahead.  So obvious question is.....What difference does it make to this little gaggle of yahoos if SADM goes ahead, as thank fully none of them want to be there ant way?

I have had an email from Spain and I do not think so, I am tired of you appearing to be very liberal with the truth.

As for what you are up to, I know what it is and if any one who does not have a BG thinks following you is a good idea they will have a nasty surprise. Will you share you BG payout with them by putting it in the pot of money for creditors?
