Tony what about the loan HdT made to San Jose inversiones .Who does that money rightfully belong to ?
One other question Tony do you know who the two major shareholders of HdT who have a 50% share each are ?
You seem to know soooooooo much Tony answer these questions or can we all take it you and SARC know nothing and can not read or translate the report ! JA

As i said before, explain where the piece is your talking about, in clear terms, its hard to find and i got fed up.
My small group of friends, as you call them, seem to outnumber yours at the moment...(my dads bigger than your dad) I simply dont believe anymore that you have a healthy SARC membership who are active.
You dont have any influence on sarc going ahead and you know it. Its not up to the likes of you or I to decide if the build should carry on, or if the money has run out, or whats best for people. Thats for experts, not amateurs and dont tell us about your chartered barrister and lame accountant............thay simply dont know Tony..........fact
Its gone beyond that man, get real. The company dont give a toss about you or me or sarc or anyone else. You dont even get a letter from them. If it wasnt for eye on spai and my solicitor i wouldnt even know what was going on with them..........Tony...they are crap, face it. They are hanging on to the slim threads of re-financing while they hide behind an administration that has no proper teeth to rip into them
The only way there will be a resolution is to get them into receivership and quickly. That way you may be surprised about the outcome, there will be more money than you think and there could be another investor taking over and building. No one is going to re-finance them Tony....because its a cruel world and if they are left long enough they will go bust and a buyout or sale from the liquidator will be much cheaper. Thats why Woolworths stores were taken over one by one AFTER THE ADMINISTRATION WAS IN PLACE.....not before.thats daft isnt it, .........just like this one is....
The longer it takes the more of your money is going, going gone...............Wise up, you have no influence on events and you have been watching this long enough to know its a dead duck
Stop putting mis-information around and do whats best for your members. Get them the only result thats available, a wind up and an alternative...............your going nowhere..very fast at the moment. Hope they blame you if they dont have a solicitor to represent them, i fear it will be your fault through the mis-information given out.

The article seems good and is an extract of property law in Spain,.........it should be on the front page. It serves to remind everyone just how much this builder has worked outside the law and how dis-honourable they have been.
Im glad its re-highlighted.............everyone have a read of it and ask yourselves...........can you trust this builder to work effectively with you and can you trust them to give you what you pay for...........answer.NO.
So choices then...............want your house, from a builder who has taken your money under false pretence.
OR..........Want your money back and get them into liquidation and court to find out where this money, everyones money, has gone.
Its a no brainer to me...................
But twigitt (not his real name) has seen it all before (not like this he hasnt).............and Tony (not a wing commander) is clutching straws and Herrado Del Tollo (not proper builders) are just plain crooks who need feeding some more money to screw up all over again (not a good idea)

I agree FIN for someone who is leading SARC he is really in the dark but then SJ/HdT have treated him like a mushroom ( ie kept him in the dark and fed him b*ll sh*t )
I am fuming at the bit of the report that says that purchasers must be prevented from resolving their contracts and persuaded to stay with the build to save the company.It goes on to say that we must be persuaded to accept realistic build times new current prices and changes to the contracts .How dare they ?
At least now we know where Tony is coming from (SJ/HdTs corner ) If this company had any honour or regard for purchasers they should have kept us informed with the truth and communicated to us individually all along .Even if we all stay with the build this company can not be saved ,why should we give a stuff about them or trust them to change their spots and do the right thing in the future . SARC you have got to be joking .I will treat them in the same shoddy way they have treated me .They can go F .Regards JA .

The best part in the inform is the bit where the admin give their take on the reasons for the company going under then relate the reasons given by HdT/SJ all excuses,lies and damned lies . They even blame the drop in sales way before the credit crunch and property crash .DOOOOOH could it be their reputation for shoddy customer care and shoddy building/licensing practises led to a drop off in sales way before the crunch. .Their sheer arrogance angers and disturbs me deeply .

There is also something in the inform that is a misuse and misrepresentation of the true position and wishes of most purchasers ,wonder where that came from !!!!! All those who thought SARC were harmless and were acting honestly and in the best interest of purchasers and thought that SARC could do no harm , may now eat their hats . Regards JA

I agree Julie. as always you talk good sense. For anyone who thought tony was simply harmless and a little gullible think again. Tony may have been to begin with but has knowingly lied and manipulated.
Sorry for the language in advance justin but SCREW SAN JOSE. I will not sleep till you pay for the misery you have caused and god help me with every ounce of my strength I will stand up to you evil corrupt bas*******. Tony I fully hold you as part of that group. You disgust me as ever.
Lets keep up the fight and ensure they get what is coming to them. Julie dont worry the judge is well aware that most owners want their contracts resolved as he knows how many group actions exist and await to be heard from him. If anything it shows to him how slanted and misrepresntative the inform is!!

I still think it is unfair to blame Tony and i stand by that He has been very helpful to me
Firstly i blame myself and i think people should take responsibility for their own situation, i should have researched more and looked more in to the SJ company and secondly and rather more important i blame my then lousy lawyer who allowed me to part with 80000 euros, who lied about the licensing for Albatera, who lied about my bank guarantee and who i only recently discovered said that my bank guarantee did not need renewing because......... "Almudena told her it was not required" A lawyer being told how to do her job by someone who is not a lawyer PATHETIC
If anyone is to blame surely it must be our then lawyers who were employed to take care of us and protect our interest, they are supposed to act as professionals should, lets hope they are hauled in to court and made to answer for their part in all of this.
My appologies to all of you good lawyers in Spain, being professional in your career i am sure you will agree with what i have said.
If you don't agree with Tony and i for one don't believe Santa Anna will get finished and i have told him this, then you don't have to read the sarc reports etc or post on his threads, just stop blaming others and take responsibility for your own lives!

Your Bank Guarantee does not need renewing. BG's are valid until the property is built and LFO is received. There has been clarification on other threads on EOS - (to get the correct technical terms)
I hope this brings you some (albeit small) comfort

It is unfair to blame tony for us being in this position to begin with. I do blame him for continuing to dish out lies from corrupt developers however and trying to bully people into his way of thinking. I agree everyone should make their own decisions..so stop trying to play God Tony and tell everyone what they must do.
As for good legal advice. Some of us had this and got valid Bank guarantees and are still in the same mess as everyone else!!!!!

I know that is true what you have said, my bg has a date on it which is illegal
I also know now that there is a special kind of bg that you have to have which has a clause in it where the bank cannot refuse to pay out and does not require a judge's decision, unfortunately i do not have this kind and every good lawyer know's to ensure that you get one. This is why you and others have not been able to get your money back
